This agreement is made and entered into between the City of La Quints and DS Waters.
PURPOSE:
To provide after hours emergency supplies and services to the City 24/7/365 to enable the City
to provide continuity of government during emergency situations.
11. TERM:
The length of this agreement shall be five (5) years from the date of signing or until at which
time it is cancelled in writing by either party, which cancellation becomes effective 30 days
upon delivery to the other party.
III. RESPONSIBILITIES:
1. The City of La Quints will be responsible to:
a. make requests for water to DS Waters, by an authorized City staff;
b. provide the locations and requirements in each request;
c. process invoice payments through normal finance office procedures, within 30
days upon receipt of invoice;
d. assist DS Waters in delivery access by notifying law enforcement andJor
providing a City vehicle escort as needed to facilitate delivery to City facilities.
2. DS Waters will be responsible to:
a. provide at least two (2) after hours phone numbers of key staff (answering
services are not acceptable) and or other means of contact for emergency
requests;
b. provide emergency response any day of the calendar year during the term of this
agreement regardless of holidays, time of day or weekend periods;
c. provide additional deliveries of supplies and services under the terms of this
agreement if the emergency so demands;
d. obtain a City of La Quints business license, if required, in order for the City to pay
for any services/supplies/equipment provided under this agreement.
