FISCAL IMPLICATIONS: None at this time. BACKGROUND AND OVERVIEW: On September 15, 2009, the City Council adopted Resolution No. 2009-075 establishing the La Quinta Housing Authority ("Housing Authority") and declaring that the City Council will serve as the Housing Authority's governing body pursuant to the Housing Authorities Law (California Health and Safety Code Section 34200 et seq.). In order to operate the Housing Authority with this structure, the City Council created an independent Housing Commission, whose function is to review and make recommendations on all matters to come before the Housing Authority except emergency matters and matters the Housing Commission itself elects not to consider. On October 20, 2009, Ordinance No. 473 was enacted which formally created the La Quinta Housing Commission. Housing Authorities Law determined the Housing Authority's responsibilities may include, but are not limited to the following areas: Lease or rent any dwellings, houses, accommodations, lands, buildings, 008 structures, or facilities embraced in any housing project and establish and revise the rents or charges for them; • Own, hold, and improve real or personal property; • Purchase, lease, obtain option upon, acquire by gift, grant, bequest, devise, or otherwise, any real or personal property or any interest in property; • Acquire any real property by eminent domain; Sell, lease, exchange, transfer, assign, pledge, or dispose of any real or personal property -of any interest in it; • Investigate living and housing conditions so as to improve such conditions; Determine where there is a shortage of decent, safe, and sanitary accommodations for persons of low income; Make studies and recommendations relating to the problem of providing dwelling accommodations for persons of low income; • Engage in research, studies, and experimentation on the subject of housing. • Adopt and announce regulations for a plan and selection of applicants to assure equal opportunity and nondiscrimination on the grounds of race, color, or national origin. • Conduct an audit at least once a year by a certified public accountant or a public accountant. Within thirty (30) days after the Housing Authority has submitted a matter to the Housing Commission for its review and recommendation, the Housing Commission shall make and file its report thereon with the Housing Authority. If the Housing Commission does not report upon the matter within thirty (30) days after its submission by the Housing Authority, the Housing Commission shall be deemed to have waived its review and recommendations concerning the matter and the Housing Authority may thereafter take action on the matter without the report of the Housing Commission. The Housing Commission's Work Plan for 2010-201 1 contains staff recommendations for trainings and objectives the Commission is tasked with accomplishing during the upcoming fiscal year. Attachment 1 provides, an outline of the Commission's Work Plan. FINDINGS AND ALTERNATIVES: The alternatives available to the Agency Board include: 1. Approve the Housing Commission Work Plan for Fiscal Year 2010-2011; or 2. Do not approve the Housing Commission Work Plan for Fiscal Year 2010-201 1; or 40. 009 3.
