The following suggestions and examples I feel will be helpful to the owner of the affected property, the Title companies and the Assessor's office. 1. Lot Line Adjustments a. Record a document with a proper metes and bounds description and if possible a map reflecting the new lot line in relation to the old lot line. b. When there is an exchange o ty in- volved, the property owners should ade aware that they have t)to clear title. Our suggestion wouladDe d that Grant as a condition for final approval, Deeds properly filled out, with correct legal descriptions, signed and notarized be turned in to your office to be recorded at the same time as the notice of Lot Line Adjustment (L.L.A.). C. We feel that the applicant should be made aware that the Assessor's office will not complete the L.L.A. if either or both par- cels have delinquent taxes. This could be accomplished by a statement in the appli- cation for L.L.A. (R&T Code 2612.5). 2. Mergers a. Record a document with a proper metes and bounds description and if possible a s a reflecting the new parcel boundary with solid heavy line and the old interior par- cel lines dashed with a fine line. How people acquire title to separate par- cels of land can be a problem. The acqui- sition has to be the same for all parcels before we can merge them into one assess- ment or parcel. Example: 1. Party A acquires Parcel 1 Party B acquires Parcel 2 Parties A&B acquire Parcel 3 Example: 2. Husband acquires Parcel 1 as separate property Husband and Wife acquire Par- cel 2 as joint tenants In each of the above examples we could not merge the parcels until all parcels had the same vesting. In order to make the vestings the same: Example: 1. Parties A and B would have to record deeds to put both names on parcels 1 and 2. Example: 2. The husband would have to deed to his wife and himself to put Parcel 1 in both names or the wife would have to deed her in- terest in Parcel 2 to the husband. The above also affect Parcel Maps or Tracts when you have two or more parties owning separate parcels and the New Parcel configuration does not match the old. We had such a case where 4 individuals owned 4 separate parcels and they had a Parcel Map recorded which by the new parcel configurations created 12 new assessments for a 4 parcel Parcel Map. c. As with L.L.A.'s we cannot merge parcels if any one or all parcels have delinquent taxes (Revenue and Taxation Code 2612.5). This should be brought to the attention of the applicant. Attached are examples of an L.L.A. and merger. The examples show the existing property lines and the proposed lines, and the legal descriptions give a full metes and bounds description of the proposed property lines.
