As part of our review of the referenced applications, the affected utility districts are copied in order to determine any impacts to their existing or planned easements and/or facilities. In balancing the applicant's desire for expedited review against an adequate window for comments to be made, received and analyzed as needed, there are occasions where pertinent comments are not received until after approval of an application. Attached is a copy of an IID letter received after the established comment period, that could significantly affect the proposed lot line adjustment. The application was 'fast -tracked' as directed, and approved the day the comment period closed (3/26). My question to Jerry was whether we should incorporate a type of 'hold - harmless' clause or condition, as the circumstances of such an approval might leave the City open to a certain degree of liability. Is this a realistic concern and, if so, what would be your direction/advice for such a standardized clause? Even though this box is in an easement, it will be totally on lot 209 after the lot line is shifted. That is not a problem unless the owner of lot 209 doesn't like that, or plans for a driveway over the box. Also care will have to be taken to insure that the service (electrical) running to house on lot 210 is not in trespass across lot 209 by short cutting out of easement to the house on lot 210. One way to eliminate the potential driveway and/or trespass problem is to cause the box to be relocated to the revised lot line. IID will relocate our equipment on a charge customer basis. Enclosed are the original approved Exhibits A (legal descriptions) and B (parcel configurations); these items must be filed for recordation by Riverside County along with deeds to the subject properties. A copy of the recorded deeds must be submitted to the Community Development Department along with any future permit application(s).
