ORD 058 ORDINANCE NO. 58 AN URGENCY ORDINANCE OF THE CITY OF LA QUINTA, CALIFORNIA, ESTABLISHING THE RATE FOR INDIVIDUAL RESIDENTIAL REFUSE PICKUP AND DISPOSAL SERVICE, AND ELECTING TO HAVE CHARGES PAYABLE FOR SUCH SERVICES FOR THE YEAR OF 1985 AND SUBSEQUENT YEARS, COLLECTED ON THE TAX ROLL PURSUANT TO SECTION 5473 OF THE HEALTH AND SAFETY CODE. The city council of the City of La Quinta does ordain as follows: SECTION. 1 This Ordinance is enacted pursuant to authorization contained in Sections 5471 and 5473 of the Health and Safety Code of the State of California. SECTION 2. The rate and charge for City-furnished garbage and refuse collection and disposal services for individual residences (curb service, once per week pickup of any combination of 6 cans, bags or bundles) is hereby established, prescribed and fixed at six dollars ($6.00) per month plus .35¢ per month dump fee surcharge: provided that such basic rate shall be decreased fifty cents (.50¢) per month for each residential account which is collected on the tax roll on a non-delinquent basis; and further provided that there may be added, at the option of the City, an appropriate amount to each account to reimburse the city for its costs and expenses related to causing such account to be collected on the tax roll. The basic rate and charge as prescribed in this Section shall be subject to future modification by ordinance or resolution of the City Council. SECTION 3. The City of La Quinta hereby elects to have charges, commencing with those for January, 1985 and for all subsequent months until such election is appropriately changed, established for City-furnished garbage and refuse collection and disposal services for individual residences, collected on the tax roll in the same manner, by the same persons, and at the same time as, together with and not separately from, the general taxes. SECTION 4. URGENCY ORDINANCE EFFECTIVE DATE. This ordinance is an urgency ordinance for the immediate preservation of the public peace, health, and safety of the City of La Quinta and it shall take effect immediately upon approval by a four-fifths vote of the City Council and signature by the Mayor and attestation by the City Clerk. It shall continue in full force and effect until repealed by ordinance of the City Council. The facts constituting the urgency are as follows: The City Council was first advised by the City's waste disposal contractor, SCI Services Inc., at it's regular meeting of June 19, 1984, that, if residential accounts are collected on the tax roll commencing January 1, 1985, the municipal customers thereof would receive an 8% reduction in refuse rate for residential services, reducing the present rate from $6.35 per month to $5.85 per month; that in order to adopt said rate and effect said savings, the City must conduct a hearing, and adopt a resolution approving the City Manager's report prescribing the charges for each residential parcel within the City and directing that said charges be collected on the tax roll; that said resolution and report, to be effective for collection on the 1984-85 tax rolls must be filed with the county auditor on or before August 10, 1984; that prior to the adoption of said resolution and report, Sections 5471 and 5473 of the California Health and Safety Code require the adoption of an ordinance electing to have such charges for the forthcoming year and for subsequent years collected on the tax roll. SECTION 5. POSTING. The city clerk shall within 15 days after the passage of this ordinance, cause it to be posted in at least the 3 public places designated by resolution of the City Council; shall certify to the adoption and posting of this ordinance; and shall cause this ordinance and its certification, together with proof of pos~i~g,~to'~entered in~he'!boOk .~f iOrdinanc. es.o~.~thiS!Ci~' APPROVED and ADOPTED this 3rd day of July, 1984.
