The following findings are applicable to the approval of this Minor Use Permit: A. The land use proposed is consistent with the General Plan, which designates the property for Low Density Residential Development. B. The use as proposed is consistent with the provisions of the Zoning Code, in that the RL setbacks and other related development standards have been shown to be in compliance through prior plan checks for these units. C. Processing and approval of this minor use permit is in compliance with the provisions of the California Environmental Quality Act (CEQA). This proposal represents a temporary sales office use of an approved residential use, which ultimately implements TR 31816 as previously certified under CEQA. D. Approval of this minor use permit will not create conditions detrimental to the public health, safety and general welfare, or injurious to or incompatible with other properties or land uses in the vicinity. All surrounding properties are or will be developed as residential land uses, consistent with the use of the subject property. E. The access, parking and circulation, as proposed with this minor use permit, will not result in excess traffic congestion or safety hazards. The use on -street parking for the sales office and model home will not substantially conflict or otherwise interfere with the existing traffic circulation pattern. The sales office/model home use within the unit on Lot 17, and the model home on Lot 18, shall be converted back to residential use prior to any final certificate of occupancy and/or final inspection being completed or conducted. All trap fencing shall be removed, along with any other commercial occupancy improvements necessary for the temporary sales/model home uses, as may be required by the La Quinta Building and Safety Department. The 1,000 deposit on file shall not be returned until final inspection of both units has been. completed. 2. All necessary commercial modifications for the authorized uses, such as for handicapped access, fire and life safety, etc. shall be provided in accordance with the requirements of the La Quinta Building and Safety Department. 3. This approval shall remain valid until the sale and occupancy of the last residential unit, inclusive of Lots 17 and 18, or until March 21, 2009, whichever occurs first. An extension may be granted by the Community Development Director, pursuant to Section 9.60.250.F of the Zoning Code. 4. The applicant/developer agrees to indemnify, defend, and hold harmless the City of La Quinta from any legal claim or litigation arising out of the City's approval of this project. The City of La Quinta shall have the right to select its defense counsel at its sole discretion. The City may impose additional conditions to this application to mitigate any problems that arise not previously addressed herein. This decision may be appealed to the Planning Commission pursuant to Section 9.200.120, provided the application requirements of said Section are met within 15 days from the date of this letter.
