Ratify the La Quinta Housing Authority Fiscal Year 201 1 /2012 Annual Report to
the California Department of Housing and Community Development.
EXECUTIVE SUMMARY:
California Health and Safety Code ("HSC") Section 34328 states that "at least
once a year a (housing) authority shall file with the clerk of the respective city or
county and with the Department of Housing and Community Development an
annual report of its activities for the preceding year."
Housing Authority staff prepared the La Quinta Housing Authority Annual Report
for Fiscal Year 201 1 /2012. This Annual Report was submitted to the California
Department of Housing and Community Development ("HCD") on October 25,
2012. The report was due on October 151; however, staff completed it after the
due date and submitted it to HCD upon completion. Staff consulted with HCD, and
there are no penalties for late submittals. The reports are simply received by HCD
and kept on file. A copy must also be available for viewing in the City Clerk's
office.

None.
BACKGROUND/ANALYSIS:
The Annual Report for the City of La Quinta Housing Authority (Attachment 1)
covers all the activities that have occurred during the 201 1 /2012 Fiscal Year,

including housing unit compliance with affordability requirements, activities
concerning existing debt obligations, as well as land transactions and
development. The report must specifically document any notice of terminations
issued to domestic violence victims or terminations of Section 8 vouchers held by
domestic violence victims, whether the termination notices resulted in the victim
vacating the premises, and any steps the Housing Authority may have taken to
assist the victim(s). The property managers for the La Quinta Housing Authority -
owned properties report that no termination notices were issued, nor are they
aware of Section 8 voucher terminations related to domestic violence victims.
(Note — Section 8 of the United States Housing Act of 1937 provides rent subsidy
vouchers to very -low income renters.)
The report must include all debt obligations issued during Fiscal Year 2011 /2012.
There were no bonds issued; however, the La Quinta Housing Authority assumed
all loans and financing agreements owned by the former La Quinta Redevelopment .
Agency. These are listed on Table 1(a) and Appendix A of the attached HCD
report. All land transactions and development activities that occurred during the
year must be listed, such as property purchases, rehabilitation, leases, land sales,
operational changes, and establishment of special trust funds. The La Quinta
Housing Authority actions that fall under these categories relate to the use of 2004
and 2011 housing bond proceeds for Washington Street Apartment Rehabilitation,
funding of silent second trust deeds for rehabilitated foreclosed homes, and the
funding of Coral Mountain Apartments.
At least 20% of Housing Authority -owned properties must be available to lower -
income persons. The La Quinta Housing Authority is compliant — of the 100 units
(28 Cove rental homes and 72 Washington Street Apartment units), 98% are
available to very -low income persons and 2% are available to low-income persons.
The La Quinta Housing Authority elected to be the Housing Successor to the La
Quinta Redevelopment Agency on January 17, 2012. Because all affordable
housing activities for Fiscal Year 201 1 /2012 must be listed, the annual report
includes properties, covenants, agreements, and assets assumed by the La Quinta
Housing Authority upon redevelopment dissolution, which occurred in February
2012.
Staff contacted HCD regarding what happens to the annual reports once received.
HCD staff indicated that the reports are simply received and kept on file; there is
no review process. Because the report has been prepared in the name of the
Housing Authority, and in case there are questions with regards to the report from
HCD or members of the public, staff believes it is prudent for the Authority Board
to approve the report.

ALTERNATIVES:
The Authority Board could elect to not ratify this report, direct staff to revise the
report and resubmit the revised version to the California Department of Housing
and Community Development.

Resolution No. 2009-005, confirming that both aforementioned findings have been met to establish a
housing authority in accordance with the California Housing Authorities Law (Health and Safety Code
Section 34200, et. seq.). The Authority adopted Bylaws and Rules of Procedure on October 6, 2009 by
Resolution HA 2009-001, which was amended by the Authority on March 15, 2011.
ABx1 26 dissolved redevelopment agencies in California effective February 1, 2012. Health and Safety
Code Section 34176(b)(2) allows the local housing authority to assume all rights, powers, assets,
liabilities, duties, and obligations associated with the housing activities of a dissolved redevelopment
agency. On January 17, 2012, the La Quinta Housing Authority adopted resolution HA 2012-002,
electing to be the "housing successor" to the dissolved La Quinta Redevelopment Agency.
Health and Safety Code Section 34179 requires the formation of oversight boards to approve
transactions related to former redevelopment agencies. The Oversight Board of the Successor Agency
to La Quinta Redevelopment Agency was established on March 7, 2012. The Oversight Board
subsequently approved the transfer of affordable housing properties to the La Quinta Housing Authority
on April 18, 2012 via resolutions OB 2012-008 and OB 2012-009.

OBJECTIVES OF THE HOUSING AUTHORITY
The Authority was established to own rental properties in the City of La Quinta that were scheduled for
substantial rehabilitation, and to hold title to vacant properties that will be developed with single and
multi -family housing. A detailed inventory of Authority properties is presented in Tables 1a, 1b, and 1c.
The Authority contracts with private entities to manage the occupied properties. The Authority's
objectives are:
• To provide safe and sanitary housing opportunities for La Quinta residents;
• To rehabilitate properties that exhibit unsafe or unhealthy characteristics; and
• To increase, improve, and preserve the community's affordable housing stock.
CONTENTS OF THE HOUSING AUTHORITY S ANNUAL REPORT
This Annual Report has been developed to:
• To summarize the Authority's activities during FY 2011-12, including any bond issuances, and
loan or finance agreements that the Authority has entered into;
• To show compliance with requirements of HSC Section 34312.3 such as the minimum amount
of housing units affordable to lower income in projects assisted by the Authority, and document
established base rents and/or maximum rental payments for lower income households; and
• To document any domestic violence tenancy or Section 8 voucher termination as required by
HSC Section 34328.1.
HOUSING AUTHORITY DEBT OBLIGATIONS
Pursuant to HSC Section 34328.1, the Authority must provide a complete report of all bond, loan and
financing agreement transactions during the prior fiscal year. Authority activities permitted by HSC
Section 34312.3 include issuing bonds, loans and financing agreements for multi -family rental housing
projects. The Authority has not issued any bonds related to affordable housing in FY 2011-12.
However, the Authority assumed from the dissolved La Quinta Redevelopment Agency, enforcement
responsibility for 622 affordability covenants within privately -owned, former redevelopment -agency
assisted properties (Table 1d); six long-term loans made by the dissolved La Quinta Redevelopment
Agency to various developers to construct affordable apartment developments (Table le); and 107
sewer subsidy loans, 419 silent second trust deed loans, and 2 residential rehabilitation loans
(Appendix A).
LAND TRANSACTIONS AND DEVELOPMENT
HSC Section 34312.3 permits housing authorities to undertake activities related to:
• the development, rehabilitation, or financing of housing projects;
• the purchase, sale, lease, ownership, operation, or management of housing projects assisted by
the Authority; conveyance of surplus lands to a developer for permitted purposes; and
• establish a special trust fund or account funded with bond proceeds or developer funds.

On November 15, 2011, the Authority approved an appropriation of proceeds of the 2011 La Quinta
Financing Authority and 2011 Agency bond issues for capital projects related to affordable housing
development by the Authority. Capital projects include the Washington Street Apartments, an adjacent
vacant parcel, and the possible acquisition of a dilapidated mobile home park.
On December 6, 2011, the Authority approved an appropriation to fund silent second trust deeds, which
facilitated the sale of 6 remaining rehabilitated foreclosed homes to very -low and low income
households.
On April 17, 2012, the Authority authorized a $29,000,000 loan and appropriation of remaining
redevelopment low -mod housing funds to Coral Mountain Partners, L.P. This loan is pursuant to a
Disposition and Development Agreement ("DDA") executed by the dissolved La Quinta Redevelopment
Agency and assumed by the Authority upon redevelopment dissolution. The DDA facilitates the 55-
year lease of Authority -owned land to Coral Mountain Partners, L.P. for the construction of 176 multi-
family apartments affordable to very -low and moderate income households. Anticipated completion
date is spring 2014.
On June 5, 2012, the Authority approved the implementation of the Washington Street Apartments
Rehabilitation Project, affirmed the status of 2004 and 2011 housing bond proceeds as housing assets,
and approved amending the Recognized Obligation Payment Schedule to reflect the project and related
expenditures. This action was taken to affirm the project as an enforceable obligation for purposes of
ABx1 26 and AB 1484 (Redevelopment Dissolution Act), and to approve the use of housing bond
proceeds to fund the project. This project will substantially rehabilitate 72 dilapidated units affordable to
very -low income seniors (over age 62) and disabled adults, and will include the construction of 24 new
units, a commons building, and associated facilities on the property.
HOUSING UNIT COMPLIANCE
As set forth by HSC Sections 34328 and 34328.1, housing authorities are required to:
• Show compliance with requirements of HSC Section 34312.3 such as the minimum amount of
housing units affordable to lower income in projects assisted by the Authority, and document
established base rents and/or maximum rental payments for lower income households; and
• Document any domestic violence tenancy or Section 8 voucher termination as required by HSC
Section 34328.1.
The following subsections provide a summary of the Authority's progress toward the requirements listed
above.
Housing Affordability Requirement
Pursuant to HSC Section 34312.3, not less than 20 percent of the units assisted by the Authority, or 15
percent in targeted areas, must be affordable to persons of low income. A targeted area is defined by
Section 103(b) (12) (A) of Title 26 of the United States Code as either "a qualified census tract in which
70 percent or more of families have income which is 80 percent or less of the statewide median family
income' or an area of "chronic economic distress." HSC Section 34312.3(2)(A) also states that not less
than one-half of the 20 or 15 percent required units must be available to persons of very -low income, if
the housing development is financed by Authority bonds. Development projects must also be approved
by the local governing body and the local school district prior to construction or ownership.
Nevertheless, the power to finance, own, build, and/or operate a housing development allows the
Authority to take on a more active role in the creation and maintenance of housing for low income
families.

TABLES
Tables I — 1c provide an inventory of the real property assets owned or managed by the Authority,
and include a breakdown of the current and anticipated income levels at each property where
applicable. The Authority is soliciting developers for several vacant properties in Tables 1a — 1c, and
will ensure that current and future housing units assisted by the Authority meet the requirements of
HSC Section 34312.3.
Table I — The Authority has assumed enforcement responsibility for 622 affordability covenants within
privately -owned, former redevelopment -agency assisted properties.
Table 1e — provides a listing of the six (6) tong -term loans made by the former La Quinta
Redevelopment Agency to affordable housing developers. These loans have been assumed by the
Authority due to redevelopment dissolution.
Appendix A - The Authority has assumed 107 sewer subsidy loans, 419 silent second trust deed loans,
and 2 residential rehabilitation loans, all of which provide affordability covenants on these properties.
Sewer subsidy and silent second trust deed loans are not repaid unless there is a default on
affordability covenants. Interest assessed only if there is a default on affordability covenants.

Base & Maximum Rents
HSC Section 34312.3 establishes guidelines to determine base and maximum rents that a housing
authority can charge for units reserved for lower income households. According to HSC Section
34312.3, if a housing authority establishes base rents, they shall be adjusted for household size
pursuant to Section 8 of the United States Housing Act of 1937 (42 U.S.C. Sec. 1437f) ("Section 8").
Additionally, HSC Section 34312.3 states that rental payments for lower income households living in
projects financed by any bonds issued after 1986 shall not exceed the amounts calculated pursuant to
Section 8. Table 2 provides a calculation of the maximum rental payments that the Authority can charge
for lower income households units.

The Authority is currently in the process of analyzing rental payments and will make any necessary
adjustments to bring properties into compliance with HSC Section 34312.3.
Domestic Violence
State law requires that a housing authority annually disclose data related to domestic violence incidents
in units owned or operated by the housing authority. Specifically, the data must include:
• Data on termination of tenancies and/or Section 8 vouchers of victims of domestic violence in
housing authority units.
• Summary of steps taken by the housing authority to address any termination of tenancies and/or
Section 8 vouchers of victims of domestic violence.
In Fiscal Year 2011-12, there were no terminations of tenancies or Section 8 vouchers of victims of
domestic violence in units owned or operated by the Authority. In the future, information on any
terminations of victims of domestic violence will be presented under separate cover to protect the
privacy of the parties involved.
