Marquita San Clemente, CA 92672 SUBJECT: MODIFICATION BY APPLICANT 2018-0003 ENZO’S BISTRO AND BAR PROPOSED OUTDOOR PATIO EXPANSION Dear Mr. Mclellan: The Design and Development Department has reviewed your request for a modification to the commercial property at 78121 Avenida La Fonda. The modification includes new construction for purposes of an expanded outdoor patio area of approximately 1,800 square feet, including decorative pavers, bocce ball court, outdoor lighting, and rear fence. The area of the patio expansion was approved for a 1,800 square foot building expansion under VUP2013-048 when the facility was previously known as the Crabpot restaurant. The applicant has not abandoned the building expansion plans and the VUP entitlement is still active until October 11, 2018. The design does not result in changes to front elevations and will not change the building footprint of the existing Enzo’s restaurant building. Additionally, It has been determined that said plan modifications are minor, will not result in a significant change in the project as approved by the decision-making authority. Therefore, the design modification is approved as shown on the attached exhibit, subject to the following conditions of approval: 1. Separate Commercial Remodel permit will be required, the following is a list of items that will be necessary to obtain building division approval: 1. Add notes to plan that reconcile numerical designations. 2. Engineering required for the proposed vertical structures, such as posts for festoon lighting. 3. Accessible route around and through the proposed outdoor improvement area required. 4. Electrical plan and lighting energy compliance forms required for the proposed exterior lighting. 5. Health Department and CVWD Approval required for proposed improvements. 6. Provide means of egress analysis that includes all occupants that will egress through the existing courtyard area with the additional occupants of the proposed outdoor area. MBA 2018-0003 approves the outdoor patio expansion area identified in Attachment 1 as modified by the conditions of approval. 2. The two employee parking spaces adjacent to the alley as identified in Attachment 1 shall be reconfigured to the west property line to allow an unobstructed pedestrian access to 78-495 Calle Tampico La Quinta, CA 92253 760.777.7000 the proposed patio access gate proposed adjacent to the west elevation of the existing building. Final design of the parking stalls and final rear fence gate shall be included with rear outdoor patio design upon Commercial Remodel Permit submittal and approved by the Design and Development Director. 3. The applicant shall identify an alternative fence material to chain link. Final rear fence and gate design shall be included with the Commercial Remodel Permit submittal and approved by the Design and Development Director.
