Public Speaker: Mark Longstaff, Architect with McKinley Associates, San Diego, CA - introduced himself, stated that the proposed plans had been unanimously approved by all residents, enumerated some of the proposed facilities, and answered the Commission's questions. SUMMARY - This item was originally considered by the Planning Commission at its May 14, 2013 meeting, and continued to the June 25, 2013 meeting. At that meeting, the applicant requested a second continuance to the July 23, 2013, Planning Commission meeting to allow additional time to address revisions requested by the Commission. Prior to the July 23 meeting, the applicant requested an additional 60 days to allow review of their cellular network to determine any additional site needs. A continuance was granted to the October 8, 2013, Planning Commission meeting. Subsequent contact with the applicant indicated that a proposed redesign was being considered, in the form of a stealth date palm. Staff has viewed a completed site in Palm Desert that is proposed as the basis for the redesign, and is not supportive of such a design. As a result, the applicant has requested removal of the item from the Planning Commission calendar, to be re -noticed once an acceptable redesign has been brought forward, reviewed and appropriately vetted with the surrounding property interests (Attachment 1). Staff is supportive of this request. The Planning Commission may re -open the public hearing for testimony at its discretion. Although several designs and locations have previously been proposed by the Applicant and reviewed by both Staff as well as members of the Planning Commission, the Applicant understands that Staff is not yet completely comfortable with the options proposed thus far and wishes to continue to work with Staff to ensure the best possible design is proposed for the Cove neighborhood to ensure the satisfaction of both Staff and residents. Staff and the Applicant are in agreement that further research and more time will be required in order to accomplish this. EXECUTIVE SUMMARY: The construction of 40 homes is proposed on a previously -approved tract (Attachment 1). The proposed architectural and landscaping plans conform to the development standards of the La Quinta General Plan and Municipal Code. BACKGROUND Tentative Tract Map 32742 (Monterra) was approved in 2004. The City Council approved the final map on November 6, 2007. The 14-acre tract, located on Monroe Street between Avenue 54 and Airport Boulevard, consists of 40 single-family residential lots varying in size from approximately 10,000 to 15,000 square feet (Attachment 2 and Attachment 3). A retention basin lot is located at the southeast corner of the site. Access to the tract is on Monroe Street, and will be un-gated. An existing residential community is located to the south of Monterra, a private equestrian residence to the west, and vacant, un-entitled land is located to the north. PROPOSAL & ANALYSIS: Architecture: Four prototypical floor plans are proposed, each with two different front elevation treatments that have been designed to reflect Mediterranean and Spanish architectural P:\Reports - PC\2013\PC 10-8-13\PH 2_MONTERRA\1 MONTERRA PC REPORT - FINAL.docx Page 1 of 3 styles (Attachment 3, Sheet 1.1 - 4.4). All four plan types include four bedrooms (including attached casita), and 4.5 bathrooms. The floor plans range from approximately 3,030 square feet to 3,729 square feet. Architectural features include shutters, decorative iron accents, ornate garage doors, and stone wall facades (Attachment 3, Sheet C1 - C2). Exterior materials consist of stucco walls, stone veneer accents, and various shades of S-tile roofing. Exterior colors vary from light to medium earth tones, with darker trim colors. The architectural styles and layout of the proposed units are well designed, compatible with the existing surrounding residential communities, and are consistent with the development standards in the La Quinta Municipal Code. Landscaping: Preliminary landscaping plans for common area (perimeter, entrance, retention basin) and front yard landscaping plans are proposed (Attachment 3, Sheet LSP - L-7). The perimeter landscape plan primarily consists of shade trees and desert shrubs with pockets of turf meandering along the Monroe Street frontage (Attachment 3, Sheet L- 7). A perimeter wall that matches the existing wall for the community to the south is proposed. The community entrance includes trees and shrubs, a continuation of the proposed perimeter wall, and enhanced pavers for the driveway (Attachment 3, Sheet L-5). The retention basin will primarily consist of turf, with low- to moderate -water use plants and trees utilized around the slopes and perimeter of the basin (Attachment 3, Sheet L-6). Decomposed granite will cover all remaining planting areas. The typical front yard planting plans consists of turf areas with multiple trees, large shrub planter areas, and owner -customized planter areas (Attachment 3, Sheet L-1 - L-4). Plant materials consist of low- to moderate -water use plants and shrubs. Street side yards will be planted entirely with trees and shrubs, with no turf utilized. The proposed landscape plan is acceptable. The assorted species of plants add character to the community and provide diversity, while having the characteristics of being functional and low water efficient. Accent trees and shrubs are fully -utilized in complementing the architecture and layout of the residential units. Many of the plants are southwest desert species. COMMISSIONS/BOARD/COMMITTEE RECOMMENDATIONS: On September 18, 2013, the Architectural and Landscaping Review Board reviewed these plans and recommended approval of the site development permit as proposed and subject to the staff recommended conditions of approval (Attachment 4). The Committee discussed enhanced walkways, monument sign locations, and the landscaping palette. AGENCY & PUBLIC REVIEW: Public Agency Review: This request was sent to all applicable City departments and affected public agencies on July 19, 2013. All written comments received are on file and available for review with the Community Development Department. All applicable comments have been adequately addressed and/or incorporated in the recommended Conditions of Approval. Public Notice: This project was advertised in The Desert Sun newspaper on September 27, 2013, and mailed to all property owners within 500 feet of the site. To date, no comments have been received from adjacent property owners. Any written comments received will be handed out at the Planning Commission hearing. ENVIRONMENTAL REVIEW The Community Development Department has determined that this request has been previously assessed in conjunction with Environmental Assessment 2004-515 which was prepared for Tentative Tract Map 32742, which was approved on September 14, 2004. Compliance with the California Environmental Quality Act (CEQA) The Community Development Department has determined that this request has been previously assessed in conjunction with Environmental Assessment 2004-515 which was prepared for Tentative Tract Map 32742, which was approved on September 14, 2004. No changed circumstances or conditions are proposed which would trigger the preparation of subsequent environmental analysis pursuant to Public Resources Code Section 21166. 4. Architectural Design The architecture and layout of the units are compatible with, and not detrimental to, the existing surrounding residential land uses, and is consistent with the development standards in the Municipal Code. The units are concluded to be appropriate for the proposed location, and supplemental design elements (stone veneer accents, various shades of S-tile roofing, etc.) appropriately enhance the architecture of the units. 5. Landscape Design The proposed project is consistent with and implements the standards for landscaping and aesthetics established in the General Plan and Zoning Code. The project landscaping for the community, as conditioned, shall unify and enhance visual continuity of the community with the surrounding development. Landscape improvements are designed and sized to provide visual appeal. The permanent overall site landscaping utilizes various tree and shrub species to blend with the building architecture. Coverage under the State of California Construction General Permit must be obtained by the applicant; who then shall submit a copy of the Regional Water Quality Control Board's ("RWQCB") acknowledgment of the applicant's Notice of Intent ("NOI") and Waste Discharger Identification (WDID) number to the City prior to the issuance of a grading or building permit. 6. The applicant shall comply with applicable provisions of the City's NPDES stormwater discharge permit, LQMC Sections 8.70.010 et seq. (Stormwater Management and Discharge Controls), and 13.24.170 (Clean Air/Clean Water); Riverside County Ordinance No. 457; the California Regional Water Quality Control Board — Colorado River Basin Region Board Order No. 137-2013-001 1 and the State Water Resources Control Board's Order No. 2009-0009-DWQ and Order No. 2010- 0014-DWQ. A. For construction activities including clearing, grading or excavation of land that disturbs one (1) acre or more of land, or that disturbs less than one (1) acre of land, but which is a part of a construction project that encompasses more than one (1) acre of land, the Permitee shall be required to submit a Storm Water Pollution Protection Plan ("SWPPP") to the State Water Resources Control Board. The applicant or design professional can obtain the California Stormwater Quality Association SWPPP template at www.cabmphandbooks.com for use in their SWPPP preparation. B. The applicant shall ensure that the required SWPPP is available for inspection at the project site at all times through and including acceptance of all improvements by the City. C. The applicant's SWPPP shall include provisions for all of the following Best Management Practices ("BMPs") (LQMC Section 8.70.020 (Definitions)): 1) Temporary Soil Stabilization (erosion control). 2) Temporary Sediment Control. 3) Wind Erosion Control. 4) Tracking Control. D. The SWPPP and BMPs shall remain in effect for the entire duration of project construction until all improvements are completed and accepted by the City Council. E. The inclusion in the Master HOA Conditions, Covenants, and Restrictions (CC&Rs), a requirement for the perpetual maintenance and operation of all post -construction BMPs as required. 7. Permits issued under this approval shall be subject to the provisions of the Development Impact Fee and Transportation Uniform Mitigation Fee programs in effect at the time of issuance of building permit(s). 8. Approval of this Site Development Permit shall not be construed as approval for any horizontal dimensions implied by any site plans or exhibits unless specifically identified in the following conditions of approval. 9. Developer shall reimburse the City, within thirty (30) days of presentment of the invoice, all costs and actual attorney's fees incurred by the City Attorney to review, negotiate and/or modify any documents or instruments required by these conditions, if Developer requests that the City modify or revise any documents or instruments prepared initially by the City to effect these conditions. This obligation shall be paid in the time noted above without deduction or offset and Developer's failure to make such payment shall be a material breach of the Conditions of Approval. 10. Developer shall reimburse the City, within thirty (30) days of presentment of the invoice, all costs and actual consultant's fees incurred by the City for engineering and/or surveying consultants to review and/or modify any documents or instruments required by this project. This obligation shall be paid in the time noted above without deduction or offset and Developer's failure to make such payment shall be a material breach of the Conditions of Approval. PROPERTY RIGHTS 1 1 . Prior to issuance of any permit(s), the applicant shall acquire or confer easements and other property rights necessary for the construction or proper functioning of the proposed development not limited to access rights over proposed and/or existing private streets that access public streets and open space/drainage facilities of the master development. Conferred rights shall include irrevocable offers to dedicate or grant access easements to the City for emergency services and for maintenance, construction and reconstruction of essential improvements. Streets shall have vertical curbs or other approved curb configurations that will convey water without ponding, and provide lateral containment of dust and residue during street sweeping operations. If a wedge or rolled curb design is approved, the lip at the flowline shall be near vertical with a 1 /8" batter and a minimum height of 0.1'. Unused curb cuts on any lot shall be restored to standard curb height prior to final inspection of permanent building(s) on the lot. IMPROVEMENT PLANS As used throughout these Conditions of Approval, professional titles such as "engineer," "surveyor," and "architect," refer to persons currently certified or licensed to practice their respective professions in the State of California. 13. Improvement plans shall be prepared by or under the direct supervision of qualified engineers and/or architects, as appropriate, and shall comply with the provisions of LQMC Section 13.24.040 (Improvement Plans). 14. The following improvement plans shall be prepared and submitted for review and approval by the Public Works Department. A separate set of plans for each line item specified below shall be prepared. The plans shall utilize the minimum scale specified, unless otherwise authorized by the City Engineer in writing. Plans may be prepared at a larger scale if additional detail or plan clarity is desired. Note, the applicant may be required to prepare other improvement plans not listed here pursuant to improvements required by other agencies and utility purveyors. A. PM 10 Plan (Update) 1 " = 40' Horizontal B. Final WQMP (Plan submitted in Report Form) C 10 E. All On -Site Signing & Striping Plans shall show, at a minimum; Stop Signs, Limit Lines and Legends, No Parking Signs, Raised Pavement Markers (including Blue RPMs at fire hydrants) and Street Name Signs per Public Works Standard Plans and/or as approved by the Engineering Department. On -Site Precise Grading Plans are required to be submitted for approval by the Building Official, Community Development Director and the City Engineer. On -Site Precise Grading Plans shall normally include all on -site surface improvements including but not limited to finish grades for curbs & gutters, pad elevations, building floor elevations, wall elevations, parking lot improvements and ADA requirements. 15. The City maintains standard plans, detail sheets and/or construction notes for elements of construction which can be accessed via the "Plans, Notes and Design Guidance" section of the Public Works Department at the City website (www.la- quinta.org). Please navigate to the Public Works Department home page and look for the Standard Drawings hyperlink. 16. The applicant shall furnish a complete set of all approved improvement plans on a storage media acceptable to the City Engineer (currently mylars). 17. Upon completion of construction, and prior to final acceptance of the improvements by the City, the applicant shall furnish the City with reproducible record drawings of all improvement plans which were approved by the City. Each sheet shall be clearly marked "Record Drawing" and shall be stamped and signed by the engineer or surveyor certifying to the accuracy and completeness of the drawings. The applicant shall have all approved mylars previously submitted to the City, revised to reflect the as -built conditions. The applicant shall employ or retain the Engineer Of Record during the construction phase of the project so that the FOR can make site visits in support of preparing "Record Drawing". GRADING 18. The applicant shall comply with the provisions of LQMC Section 13.24.050 (Grading Improvements). 19. Prior to occupancy of the project site for any construction, or other purposes, the applicant shall obtain a grading permit approved by the City Engineer. 20. To obtain an approved grading permit, the applicant shall submit and obtain approval of all of the following: A. A grading plan prepared by a civil engineer registered in the State of California, B. A preliminary geotechnical ("soils") report prepared by a professional registered in the State of California, C. A Fugitive Dust Control Plan prepared in accordance with LQMC Chapter 6.16, (Fugitive Dust Control), and D. A Best Management Practices report prepared in accordance with LQMC Sections 8.70.010 and 13.24.170 (NPDES Stormwater Discharge Permit and Storm Management and Discharge Controls). E. A WQMP prepared by an authorized professional registered in the State of California. All grading shall conform with the recommendations contained in the Preliminary Soils Report, and shall be certified as being adequate by soils engineer, or engineering geologist registered in the State of California. The applicant shall furnish security, in a form acceptable to the City, and in an amount sufficient to guarantee compliance with the approved Fugitive Dust Control Plan provisions. Additionally, the applicant shall replenish said security if expended by the City of La Quinta to comply with the Plan as required by the City Engineer. 21. The applicant shall maintain all open graded, undeveloped land in order to prevent wind and/or water erosion of such land. All open graded, undeveloped land shall either be planted with interim landscaping, or stabilized with such other erosion control measures, as were approved in the Fugitive Dust Control Plan. 22. Grading within the perimeter setback and parkway areas shall have undulating terrain and shall conform with the requirements of LQMC Section 9.60.240(F) except as otherwise modified by this condition. The maximum slope in the first six (6) feet adjacent to the curb shall not exceed 4:1 when the nearest edge of sidewalk is within six feet (6') of the curb, otherwise the maximum slope within the right of way shall not exceed 3:1 . All unpaved parkway areas adjacent to the curb shall be depressed one and one-half inches (1.5") in the first eighteen inches (18") behind the curb. 23. Building pad elevations of perimeter lots shall not differ by more that one foot higher from the building pads in adjacent developments. 24. The applicant shall minimize the differences in elevation between the adjoining properties and the lots within this development. 25. Prior to the issuance of a building permit for any building lot, the applicant shall provide a lot pad certification stamped and signed by a qualified engineer or surveyor with applicable compaction tests and over excavation documentation. Each pad certification shall list the pad elevation as shown on the approved grading plan, the actual pad elevation and the difference between the two, if any. Such pad certification shall also list the relative compaction of the pad soil. The data shall be organized by lot number, and listed cumulatively if submitted at different times. DRAINAGF 26. Stormwater handling shall conform with the approved hydrology and drainage report for Tract Map No. 32742. Nuisance water shall be disposed of in an approved manner. 27. The applicant shall comply with the provisions of LQMC Section 13.24.120 (Drainage), Retention Basin Design Criteria, Engineering Bulletin No. 06-16 — Hydrology Report with Preliminary Hydraulic Report Criteria for Storm Drain Systems and Engineering Bulletin No. 06-015 - Underground Retention Basin Design Requirements. More specifically, stormwater falling on site during the 100 year storm shall be retained within the development, unless otherwise approved by the City Engineer. The design storm shall be either the 1 hour, 3 hour, 6 hour or 24 hour event producing the greatest total run off. 28. Nuisance water shall be retained on site. Nuisance water shall be disposed of per approved methods contained in Engineering Bulletin No. 06-16 — Hydrology Report with Preliminary Hydraulic Report Criteria for Storm Drain Systems and Engineering Bulletin No. 06-015 - Underground Retention Basin Design Requirements. 29. In design of retention facilities, the maximum percolation rate shall be two inches per hour. The project shall be designed to accommodate purging and blowoff water (through underground piping and/or retention facilities) from any on -site or adjacent well sites granted or dedicated to the local water utility authority as a requirement for development of this property. 31. No fence or wall shall be constructed around any retention basin unless approved by the Community Development Director and the City Engineer. 32. For on -site above ground common retention basins, retention depth shall be according to Engineering Bulletin No. 06-16 — Hydrology Report with Preliminary Hydraulic Report Criteria for Storm Drain Systems. Side slopes shall not exceed 3:1 and shall be planted with maintenance free ground cover. Additionally, retention basin widths shall be not less than 20 feet at the bottom of the basin. 33. Stormwater may not be retained in landscaped parkways or landscaped setback lots. Only incidental storm water (precipitation which directly falls onto the setback) will be permitted to be retained in the landscape setback areas. The perimeter setback and parkway areas in the street right-of-way shall be shaped with berms and mounds, pursuant to LQMC Section 9.100.040(B)(7). 34. The design of the development shall not cause any increase in flood boundaries and levels in any area outside the development. 35. The development shall be graded to permit storm flow in excess of retention capacity to flow out of the development through a designated overflow and into the historic drainage relief route. 36. Storm drainage historically received from adjoining property shall be received and retained or passed through into the historic downstream drainage relief route. 37. The applicant shall comply with applicable provisions for post construction runoff per the City's NPDES stormwater discharge permit, LQMC Sections 8.70.010 et seq. (Stormwater Management and Discharge Controls), and 13.24.170 (Clean Air/Clean Water); Riverside County Ordinance No. 457; and the California Regional Water Quality Control Board — Colorado River Basin (CRWQCB-CRB) Region Board Order No. R7-201 3-0011 and the State Water Resources Control Board's Order No. 2009- 0009-DWQ and Order No. 2010-0014-DWQ. A. For post -construction urban runoff from New Development and Redevelopments Projects, the applicant shall implement requirements of the NPDES permit for the design, construction and perpetual operation and maintenance of BMPs per the approved Water Quality Management Plan (WQMP) for the project as required by the California Regional Water Quality P:\Reports - PC\2013\PC 10-8-13\PH 2 MONTERRA\3 MONTERRA PC COAS - FINAL.doc Printed October 3, 2013 Page 8 of 12 PLANNING COMMISSION RESOLUTION 2013- CONDITIONS OF APPROVAL - RECOMMENDED SITE DEVELOPMENT PERMIT 2013-929 MONTERRA (MONTERRA HOLDINGS, LLC) OCTOBER 8, 2013 Control Board - Colorado River Basin (CRWQCB-CRB) Region Board Order No. R7-2013-001 1. B. The applicant shall implement the WQMP Design Standards per (CRWQCB- CRB) Region Board Order No. R7-201 3-0011 utilizing BMPs approved by the City Engineer. A project specific WQMP shall be provided which incorporates Site Design and Treatment BMPs utilizing first flush infiltration as a preferred method of NPDES Permit Compliance for Whitewater River receiving water, as applicable. C. The developer shall execute and record a Stormwater Management/BMP Facilities Agreement that provides for the perpetual maintenance and operation of stormwater BMPs. UTII ITIFS 38. The applicant shall comply with the provisions of LQMC Section 13.24.110 (Utilities). 39. The applicant shall obtain the approval of the City Engineer for the location of all utility lines within any right-of-way, and all above -ground utility structures including, but not limited to, traffic signal cabinets, electric vaults, water valves, and telephone stands, to ensure optimum placement for practical and aesthetic purposes. 40. Existing overhead utility lines within, or adjacent to the proposed development, and all proposed utilities shall be installed underground. All existing utility lines attached to joint use 92 KV transmission power poles are exempt from the requirement to be placed underground. 41. Underground utilities shall be installed prior to overlying hardscape. For installation of utilities in existing improved streets, the applicant shall comply with trench restoration requirements maintained, or required by the City Engineer. The applicant shall provide certified reports of all utility trench compaction for approval by the City Engineer. Additionally, grease traps and the maintenance thereof shall be located as to not conflict with access aisles/entrances. CONSTRUCTION 42. The City will conduct final inspections of habitable buildings only when the buildings have improved street and (if required) sidewalk access to publicly -maintained streets. If on -site streets in residential developments are initially constructed with partial pavement thickness, the applicant shall complete the pavement prior to final inspections of the last ten percent of homes within the development or when directed by the City, whichever comes first LANDSCAPE AND IRRIGATION 43. The applicant shall comply with LQMC Sections 13.24.130 (Landscaping Setbacks) & 13.24.140 (Landscaping Plans). 44. Landscape and irrigation plans for landscaped lots and setbacks, medians, retention basins, and parks shall be signed and stamped by a licensed landscape architect. 45. All new and modified landscape areas shall have landscaping and permanent irrigation improvements in compliance with the City's Water Efficient Landscape regulations contained in LQMC Section 8.13 (Water Efficient Landscape). 46. The applicant shall submit the final landscape plans for review, processing and approval to the Community Development Department, in accordance with the Final Landscape Plan application process. Community Development Director approval of the final landscape plans is required prior to issuance of the first building permit unless the Community Development Director determines extenuating circumstances exist which justifies an alternative processing schedule. NOTE: Plans are not approved for construction until signed by the appropriate City official, including the Community Development Director and/or City Engineer. Prior to final approval of the installation of landscaping, the Landscape Architect of record shall provide the Community Development Department a letter stating he/she has personally inspected the installation and that it conforms with the final landscaping plans as approved by the City. If staff determines during final landscaping inspection that adjustments are required in order to meet the intent of the Planning Commission's approval, the Community Development Director shall review and approve any such revisions to the landscape plan. 47. The applicant or his agent has the responsibility for proper sight distance requirements per guidelines in the AASHTO "A Policy on Geometric Design of Highways and Streets, 5th Edition" or latest, in the design and/or installation of all landscaping and appurtenances abutting and within the private and public street right-of-way. 48. Front yard landscaping for each dwelling shall consist of, at minimum, 36" box trees (i.e., a minimum 2.5 inch caliper measured three feet up from grade level after P:\Reports - PC\2013\PC 10-8-13\PH 2 MONTERRA\3 MONTERRA PC COAS - FINAL.doc Printed October 3, 2013 Page 10 of 12 PLANNING COMMISSION RESOLUTION 2013- CONDITIONS OF APPROVAL - RECOMMENDED SITE DEVELOPMENT PERMIT 2013-929 MONTERRA (MONTERRA HOLDINGS, LLC) OCTOBER 8, 2013 planting), 5-gallon shrubs, and groundcover. Double lodge poles (two-inch diameter) shall be used to brace and stake trees. To encourage water conservation, no more than 50% of the front yard landscaping shall be devoted to turf. 49. A no -turf front yard option shall be provided for each plan type. MAINTENANCE 50. The applicant shall comply with the provisions of LQMC Section 13.24.160 (Maintenance). 51. The applicant shall make provisions for the continuous and perpetual maintenance of perimeter landscaping up to the curb, access drives, sidewalks, and stormwater BMPs. FEES AND DEPOSITS 52. The applicant shall comply with the provisions of LQMC Section 13.24.180 (Fees and Deposits). These fees include all deposits and fees required by the City for plan checking and construction inspection. Deposits and fee amounts shall be those in effect when the applicant makes application for plan check and permits. FIRE DEPARTMENT 53. For residential areas, approved standard fire hydrants, located at each intersection, with no portion of any lot frontage more than a maximum of 500 feet from a hydrant. Minimum fire flow for all residential structures shall be 1000 GPM for a 2- hour duration at 20 PSI. 54. The required water system, including fire hydrants, shall be installed and accepted by the appropriate water agency prior to any combustible building material being placed on an individual lot. Two sets of water plans are to be submitted to the Fire Department for approval. 55. Applicant/Developer shall mount blue dot retro-reflectors pavement markers on private streets, public streets and driveways to indicated location of the fire hydrant. It should be 8 inches from centerline to the side that the fire hydrant is on, to identify fire hydrant locations. 56. Residential fire sprinklers are required in all one and two family dwellings per the California Residential Code. Contact the Riverside County Fire Department for the Residential Fire Sprinkler Standard. 57. The minimum dimension for gates is 20 feet clear and unobstructed width and a minimum vertical clearance of 13 feet 6 inches in height. Where a one- way road with a single traffic lane provides access to a gate entrance, a 38-foot turning radius shall be used. 58. Gates may be automatic or manual and shall be equipped with a rapid entry system (KNOX). Plans shall be submitted to the Fire Department for approval prior to installation. Automatic gate pins shall be rated with a shear pin force, not to exceed 30 pounds. Gates activated by the rapid entry system shall remain open until closed by the rapid entry system. Automatic gates shall be provided with backup power. 59. Fire Apparatus access road and driveways shall be in compliance with the Riverside County Fire Department Standard number 06-05 (located at www.rvcfire.org). Access lanes will not have an up, or downgrade of more than 15%. Access roads shall have an unobstructed vertical clearance not less than 13 feet and 6 inches. Access lanes will be designed to withstand the weight of 80 thousand pounds over 2 axles. Access will have a turning radius capable of accommodating fire apparatus. Access lane shall be constructed with a surface so as to provide all weather driving capabilities. COMMUNITY DEVELOPMENT DEPARTMENT 60. The location of the side wall for all instances of Plan 1 shall be adjusted to facilitate the use of the attached golf cart space. Final wall location shall be reviewed and approved by the Community Development Department prior to issuance of a building permit. EXECUTIVE SUMMARY: The City of La Quinta is proposing to upgrade existing light poles and install eleven additional light poles at the La Quinta Sports Complex (Attachment 1). With the recommended conditions of approval, which address hours of operation and noise, the proposed lighting complies with the development standards and design guidelines of the La Quinta General Plan and Municipal Code. BACKGROUND The City of La Quinta is in partnership with the Desert Sands Unified School District (DSUSD) for shared use of existing school and playfield facilities. The La Quinta Middle School Sports Complex on Avenue 50 is an example of this partnership (Attachment 2). Currently, the Sports Complex fields are used for baseball, softball, football and other playfield activities weekdays and weekday evenings as well as daytime use on the weekends (Attachment 3). The City has a facility use agreement with DSUSD to use the fields from 4:00pm to 10:00pm Monday through Friday, and 7:00am to 10:00pm Saturday and Sunday. Full use of the Sports Complex is currently limited in the evenings due to the current lighting being inadequate. P:\Reports - PC\2013\PC 10-8-13\PH 3 LQ SPORTS COMPLEX LIGHTING\1 LQ SPORTS COMPLEX LIGHTING REPORT - FINAL.docx Page 1 of 3 PROPOSAL & ANALYSIS: The City is proposing to upgrade the existing poles and install eleven additional light poles to illuminate the seven baseball fields, a single football practice field, and a batting cage area at the Sports Complex (Attachment 4 and Attachment 5). The 24 existing poles, which are 70-feet tall with two to five lighting fixtures each, will be re- wired to allow lighting control for individual fields. Each of the 11 new poles, which will also be 70-feet tall, will be mounted with three to eight 1500-watt metal halide bulbs fitted with full visors. The aluminum visors are designed to minimize light spill and glare, keeping the lighting focused onto the playing field. Lighting for evening practices and games will be turned on at dusk (approximately 5:00pm in the Fall, 7:00pm in the Spring), and automatically turned off no later than 10:00pm. This schedule is consistent with the existing lighting schedule for the Sports Complex. The Community Services Department manages field and lighting scheduling, and only City staff can turn on field lights, which can be done on -site or remotely. Sports associations have access to turn off lights earlier than 10:00pm as field play concludes. Staff finds the proposed outdoor lighting acceptable as the La Quinta Sports Complex is an existing facility and the proposed lighting plan is designed to maximize flexibility of use while providing adequate lighting with minimal spill. Furthermore, by permitting additional outdoor lighting at the Sports Complex, the City will be providing further opportunity for field use, of which a community need currently exists for such. The City's lighting consultant has designed a lighting plan that provides the most appropriate lighting with the least impact upon adjacent properties. The lighting consultant has recommended the proposed lighting design in order to provide adequate illumination necessary for the identified sports with minimal nuisance. As previously noted, the eleven new light poles will stand at 70 feet in height, allowing the light to be focused downward onto the playing surface. This design has the advantage of providing a wider area of illumination and a higher angle of reflectivity from the field surface. A lower pole height would focus the light more horizontally across the field, resulting in greater light spill upon surrounding properties. The existing lighting fixtures at the Colonel Mitchell Paige Middle School playfields (90- foot tall) and La Quinta Park (80-foot tall) are approved in the same manner; focusing light on the playfields while minimizing nuisance light spillover. The lighting engineer has provided photometric plans identifying a maximum illumination of 65 foot candles and an average of 30 foot candles on the playing surfaces. The proposed amount of lighting is considered the minimum necessary to properly illuminate the playfields. Staff has recommended a condition of approval to deactivate all field lighting by no later than 10:00pm, which is the same time the reduced night time decibel standard provided in the City's Noise Ordinance (§9.100.210) takes effect. Furthermore, all amplified noise (megaphones, speakers, etc.) will be conditioned to be prohibited from use on and around the football field. AGENCY & PUBLIC REVIEW: Neighborhood Meeting: A neighborhood informational workshop was held at the Boys & Girls Club on April 11, 2013. Representatives from the City and the lighting consultant facilitated the event. Immediate surrounding property owners and the Parc La Quinta and Rancho La Quinta HOA staff were notified of the meeting. One resident from Rancho La Quinta attended the workshop in order to gather information. Public Agency Review: This request was sent to all applicable City departments and affected public agencies on August 28, 2013. All written comments received are on file and available for review with the Community Development Department. All applicable comments have been incorporated in the recommended Conditions of Approval. Public Notice: This project was advertised in The Desert Sun newspaper on September 27, 2013, and mailed to all property owners within 500 feet of the site. To date, no comments have been received from adjacent property owners. Any written comments received will be handed out at the Planning Commission hearing. ENVIRONMENTAL REVIEW The Community Development Department has determined that this project is exempt from environmental review pursuant to Sections 15301 (Existing Facilities) and 15314 (Minor Additions to Schools) of the California Environmental Quality Act. SPORTS COMPLEX LIGHTING REPORT - FINAL.docx Page 3 of 3 PLANNING COMMISSION RESOLUTION 2013- A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA QUINTA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT 2013-153, REHABILITATION AND EXPANSION PLANS FOR FIELD LIGHTING AT THE LA QUINTA SPORTS COMPLEX CASE NO.: CONDITIONAL USE PERMIT 2013-153 APPLICANT: CITY OF LA QUINTA WHEREAS, the Planning Commission of the City of La Quinta, California did, on the 8t" day of October, 2013, hold a duly noticed Public Hearing to consider a request by the City of La Quinta for approval of rehabilitation and expansions plans for field lighting at the La Quinta Sports Complex, generally located at 78-900 Avenue 50, more particularly described as: APN: 646-070-001, 646-070-002, 646-320-037 WHEREAS, the Community Development Department published a public hearing notice in The Desert Sun newspaper on September 27, 2013, as prescribed by the Municipal Code. Public hearing notices were also mailed to all property owners within 500 feet of the site; and, WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did make the following mandatory findings pursuant to Section 9.210.020 of the Municipal Code to justify approval of said Conditional Use Permit: 1 . Consistency with General Plan The proposed use is consistent with the General Plan land use designation of Major Community Facilities. The City's General Plan policies relating to Major Community Facilities applies to existing or planned municipal, educational or public facilities. The proposed field lighting project rehabilitates existing facilities, and the new poles have been planned since 2007, as part of the La Quinta Sports Complex Renovation Project 2. Consistency with Zoning Code As conditioned, the proposed use is consistent with the provisions of the zoning code. The continued use of the site as a lighted playfield will have minimal impacts on the surrounding land uses and will conform to the development standards applicable to the use. Compliance with CEQA Processing of this Conditional Use Permit for the proposed use is in compliance with the provisions of the California Environmental Quality Act. The Community Development Department has determined that this project is exempt from environmental review pursuant to Sections 15301 (Existing Facilities) and 15314 (Minor Additions to Schools) of the California Environmental Quality Act. 4. Surrounding Uses As conditioned, approval of the application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. The proposed use is completely contained within an existing playfield, is an adequate distance from existing residential uses, and conditions of approval have been incorporated to mitigate potential lighting and noise conditions. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of La Quinta, California, as follows: SECTION 1. That the above recitations are true and constitute the Findings of the Planning Commission in this case; SECTION 2. That it does hereby approve Conditional Use Permit 2013-153, for the reasons set forth in this Resolution and subject to the attached Conditions of Approval. Any expansion of this use or substantial modification that results in a change of use shall require an amendment of this conditional use permit. Minor modifications to this Conditional Use Permit shall be considered by the Community Development Director in accordance with LQMC 9.200.090, and may require notification of surrounding property owners prior to such approval. All other amendments shall be processed in accordance with LQMC 9.200.100. 3. The Conditional Use Permit shall expire on October 8, 2015 and shall become null and void in accordance with La Quinta Municipal Code Section 9.200.080, unless a building permit has been issued. A time extension may be requested per LQMC Section 9.200.080. 4. Hours of operation for the field lights shall not extend beyond 10:00 p.m. Field lights shall only be operated as needed and shall be turned off when not in use. 5. As issuance of a building permit and inspections are to be arranged through the State Office of the Architect, the City of La Quinta shall be notified and permitted to conduct a courtesy inspection of the lighting prior to final installation. 6. Use of amplified sound generators (speakers, megaphones, etc.) is prohibited on or around the football field area. I live in Rancho La Quinta on Paso Tiempo and while I generally approve of the ball fields and the opportunities they provide for the youngsters of our community I do not think it is fair to provide such short notice to those who may be affected by this proposal if it is enacted. This is even more true as many of those residing in Rancho La Quinta are seasonal and for the most part do not return until late October or early November. The proponents should provide some engineering data as to the spread of the light from these new poles and that would go a long way to allowing meaningful input. Absent of objective information many residents, including me, would have to conclude this is not a good idea - we do not want to live under spotlights as if we were in Stalag 17. Please incorporate this email into the public comment. We have just recently been made aware that there is a proposal to expand the lightening on the neighboring fields to our community. We strongly disagree in allowing additional lightening. We look out to this lightening from our house which is on constantly regardless whether the fields are being utilized. We have often commented as we have driven by that no one is using the field and all the lights are still burning. Enjoyment of looking at the night sky is diminished due to the existing lights without the addition of more lightening. Lightening requirements by the City of La Quinta and neighboring Cities reflect the importance of being able to enjoy the night time desert sky. This proposal is in direct contradiction to what should be done on the property. Current lightening of fields should be managed and utilized when the fields are being used not allowed to be on wasting energy and negatively impacting others needlessly. Steps should be taken to mitigate the "existing lightening" using less intrusive lightening not adding more lightening. Thank you for your consideration. The material you sent to RLQ in preparation for the meeting was very helpful. Thank you. 1. LQ has agreement with DSUSD - DSUSD encompasses non-LQ cities. Is anyone with the DSUSD allowed to use the facilities? Does everyone who uses a field have to sign up for it in advance or can individuals come on an Ad Hoc basis? 2. Staff Report says "lighting being inadequate" but later on it sounds like it's not the lighting but that specific poles lights can't be turned on individually - so it sounds like the lighting is okay on existing poles - also no extra lights are planned for the current fields if I read correctly. 3. What is current usage and demand for fields - both day and evenings - since lighting on existing fields doesn't seem to be inadequate, I don't understand why Report says full use limited by the current lighting. 4. Are there other fields in La Quinta and have neighbors within 500 feet experienced/complained about light and/or noise? 5. Proposal and Analysis says existing poles have two to five lighting fixtures each. How many lights does this equate to? Because the proposed new poles are described in terms of number of bulbs - be nice to compare existing v. proposed. 6. Do the existing bulbs have "full visors"? 7. What are the decibel levels at the edges of the current lighting and other LQ fields? 8. Who is able to turn on lights? I understand that all lights are automatically turned off at 10 p.m. and that individuals using a field at night are able to turn off the lights before 10 p.m. 9. Why are amplified sound generators (speakers, megaphones, etc.) prohibited from use on or around the football field only? (#6 under GENERAL).
