MOTION – A motion was made and seconded by Authority Members Peña/Evans to adopt Resolution No. HA 2018-002 approving the La Quinta Housing Authority Fiscal Year 2018/19 Budget as recommended: A RESOLUTION OF THE LA QUINTA HOUSING AUTHORITY APPROVING A BUDGET FOR FISCAL YEAR 2018/19 Motion passed unanimously. REMAND TO THE HOUSING COMMISSION AMENDMENT NO. 3 TO PROFESSIONAL SERVICES AGREEMENT WITH BECKY CAHA FOR HOUSING COMPLIANCE AND MONITORING SERVICES City Attorney Ihrke presented the staff report, which is on file in the Clerk’s Office. Authority discussed that Commissioners are required to attend the California state required ethics and compliance trainings; Commissioner Johnson has attended all required trainings; Commissioner Johnson was aware that this remand was being recommended. City Attorney Ihrke would attend the next Housing Commission meeting and would issue written communications to the Housing Commissioners reminding them of the Brown Act laws and regulations. Mr. Ihrke said it was the City’s standard practice to inform all new commissioners of the applicable state and municipal laws while serving on a commission, and to make sure each commissioner is aware that they are subject to these laws. Authority discussion followed regarding implementing an acknowledgement form for each commissioner to sign that they were made aware of the laws and regulations they are subject to while serving on a City commission, that they understand the rules, and agree to obey by the rules; the consequences associated with violation of these rules; violation of the rules is not acceptable; possible commissioner removal from service due to state and municipal law violations; right to due process; severity of Brown Act violations; the City provides commissioners with materials outlining these laws and rules – the “Commissioners’ Handbook.” Authority Member Radi asked staff to schedule an interview with Housing Commissioner Johnson to give him an opportunity to provide the Authority with an explanation for his apparent discussion of a Commission item with a majority of the Commissioners prior to the meeting being called to order, contrary to the Brown Act. Council concurred. MOTION – A motion was made and seconded by Authority Members Fitzpatrick/Radi to remand to the La Quinta Housing Commission, as a business session item, Amendment No. 3 to the Professional Services Agreement with Becky Caha for Housing Compliance and Monitoring Services. Motion passed unanimously. EXECUTIVE SUMMARY On June 19, 2018, the Housing Authority (Authority) remanded consideration of Becky Caha’s Professional Services Agreement back to the Housing Commission (Commission) due to potential Brown Act violations. Authority Members requested that Commissioner Johnson attend the July 3, 2018, Authority meeting to outline his perspective regarding what occurred at the June 13, 2018, Commission meeting. FISCAL IMPACT – None BACKGROUND/ANALYSIS At the June 19, 2018, meeting, the Authority Attorney recommended that the Authority remand consideration of Becky Caha’s Professional Services Agreement back to the Commission for consideration; the Authority voted to do so. Authority staff who attended the June 13, 2018, Commission meeting observed Commissioner Johnson discussing his views on this item with other members of the Commission prior to the start of the meeting. During the June 19 discussion, Authority Members requested that Commissioner Johnson be invited to the July 3 Authority meeting to outline what occurred. Staff has invited Commissioner Johnson and at his request, also invited Chair Rodgers. Both have indicated that they will attend. ALTERNATIVES There are no alternatives for Authority consideration. Spevacek, Executive Director BUSINESS SESSION ITEM NO. 1 9 10 City of La Quinta HOUSING AUTHORITY MEETING: July 3, 2018 STAFF REPORT AGENDA TITLE: APPROVE AMENDMENT NO. 3 TO PROFESSIONAL SERVICES AGREEMENT WITH BECKY CAHA FOR HOUSING COMPLIANCE AND MONITORING SERVICES RECOMMENDATION Approve Amendment No. 3 to Professional Services Agreement with Becky Caha to amend Section 2.1 – Contract Sum, not to exceed $70,000 per fiscal year; and authorize the Executive Director to execute the amendment. EXECUTIVE SUMMARY The La Quinta Housing Authority (Authority) entered into a Professional Services Agreement (Agreement) with Becky Caha (Consultant) for Housing Compliance and Monitoring Services. The Agreement was previously amended twice before to extend the contract term and scope of services. This year Consultant has experienced increased activity in prequalifying individuals for Authority invested properties like Watercolors and Cove single family homes, in addition to having to work on two foreclosures that had Authority affordability covenants placed on them, which has led to increased invoice amounts. FISCAL IMPACT A $10,000 budget adjustment for Professional Services (241-9101-60103) will increase the total available budget to $70,000 for 2017/18. BACKGROUND/ANALYSIS The Authority entered into an Agreement with Consultant in 2013. Since then the Agreement has been amended twice, to extend the contract term, and add to the scope of services. This fiscal year Consultant has experienced a significant increase in inquiries and pre- qualifications for the Watercolors Development, silent second trust deed homes for sale in the Cove Neighborhood, and the processing of two foreclosures that had affordability covenants on them. As a result, there are insufficient funds to cover consultant costs for the fiscal year. The Housing Commission met on June 27, 2018, and recommended approval of the contract amendment. BUSINESS SESSION ITEM NO. 2 11 ALTERNATIVES An alternative is not recommended as these services are critical to ensure adequate housing program oversight.
