SUBJECT: TEMPORARY USE PERMIT 2018-0008: POOL STORE SIDEWALK
SALE
Dear Ms. Clark:
The Design and Development Department has reviewed and approved your
request to hold a commercial event at the sidewalk area in front of The Pool
Store property at 78600 Highway 111. The approval of the event is granted
under Section 9.100.120 (Sidewalk sales and commercial events) of the La
Quinta Municipal Code subject to the following Conditions of Approval:
1.The event shall be held between 9:00am and 2:00pm on July 14, 2018.
2.The event area shall be monitored and secured at all times.
3.The event shall be contained within the sidewalk area as identified on
the plans submitted and attached as part of this application.
4.The set-up and operation of the event shall be consistent with the
attached exhibits and information on file.
5.Roadways, parking areas, and pedestrian and vehicular traffic aisles to
other businesses and activities in the vicinity shall be maintained
accessible at all times.
6.Adequate, legal, and ADA accessible pedestrian access shall be
maintained around tables and event area at all times.
7.The site shall be left clean and in its original manner at the conclusion of
the event.
8.Installation of the 10’ x 10’ tent should be secured with weights, via
bags of sand or salt. The applicant is responsible for the adequacy of
the means of connection, size, and weight of the bags to secure the
tent.
9. Any tents that measure or exceed 20’ x 20’ are not permitted as part of
this event. Approval for use of tents this size requires Building and Fire
permit approval.
10. Any damage to the public hardscape caused by this event shall be
repaired as directed by the City Engineer. This includes but is not
limited to sidewalks, curb and gutter, landscaping, and pavement
especially within the surrounding public streets and right of way.
By holding this event, the applicant agrees to indemnify, defend and hold
harmless the City of La Quinta in the event of any legal claim or litigation arising
out of the City’s approval of this project. The City of La Quinta shall have the
right to select its defense counsel at its sole discretion. Adherence to these
conditions, as outlined, will ensure that adverse impacts to surrounding
properties and businesses will be minimized. The City may elect to add
conditions to this application to mitigate any problems that arise not previously
