MUP 2018-0004 Planet Fitness (09.06.2018) September 6, 2018 Mr. John Ranous Nationwide Permits 7325 Vinton Avenue #8 Los Angeles, CA 90034 SUBJECT: MINOR USE PERMIT 2018-0004: 78-987 Highway 111 PLANET FITNESS OPERATION Dear Mr. Ranous: The Design and Development Department has reviewed and approved your request to establish a fitness center located at 78-987 Highway 111. Approval of this application is subject to the attached exhibits for the Minor Use Permit and the following Findings and Conditions of Approval: FINDINGS 1. Consistency with the General Plan: The land use is consistent with the General Plan land use designation of General Commercial. The City’s General Plan policies relating to General Commercial encourage a full range of retail, office, resort, and institutional businesses within the City, and the proposed fitness center use maintains those policies. 2. Consistency with Zoning Code: The proposed development, as conditioned, is consistent with the development standards of the City’s Zoning Code. The Site Development Permit has been conditioned to ensure compliance with the zoning standards of the Regional Commercial zoning district and other supplemental standards as established in Title 9 of the La Quinta Municipal Code. The building is within Parcel 6 of the Washington Park Specific Plan (SP1987-011) which established a parking ratio of 5 parking spaces per 1,000 square feet of building area regardless of the use. Under this requirement, 74 parking spaces would be required for the fitness center. Under the La Quinta Municipal Code requirement 75 parking spaces would be required for a health club at a ratio of 1 parking space per 200 square feet of building area. The applicant proposes to dedicate 91 existing parking spaces for the fitness center, which exceeds the Specific Plan and the Zoning Code parking standards. 3. Compliance with CEQA: Processing and approval of the permit application are in compliance with the requirements of the California Environmental Quality Act. The project was determined to be exempt from CEQA pursuant to 15301, Existing Facilities, as the fitness center consists of the operation and minor alteration of existing facilities. 4. Surrounding Uses: Approval of the application will not create conditions materially detrimental to the public health, safety, and general welfare or injurious to or incompatible with the properties or land uses in the vicinity. The fitness center is a permitted use in the Regional Commercial District with approval of a minor use permit and is consistent with surrounding nonresidential uses such as retail uses, medical office, and personal service, and restaurants. CONDITIONS OF APPROVAL 1. The applicant/property owner agrees to defend, indemnify, and hold harmless the City of La Quinta (the “City”), its agents, officers and employees from any claim, or litigation arising out of the City’s approval of this project. This indemnification shall include any award toward attorney’s fees. The City of La Quinta shall have the right to select its defense counsel in its sole discretion. The City of La Quinta shall promptly notify the applicant of any claim, action, or proceeding and shall cooperate fully in the defense. 2. The applicant shall obtain all necessary building permits from the City’s Building Division, and is responsible for meeting all applicable plan check submittal requirements. Plans submitted for building permit plan check shall include an accurate vicinity map. 3. Any establishment providing, or person performing massage will need a license pursuant to LQMC 5.32.020 A & B. 4. No person 18 or under can operate the tanning equipment as an employee, or have it used on them as a client. 5. Lighting in the parking lot shall operate the entire night due to the 24- hour operation of Planet Fitness and shall be consistent with the La Quinta Municipal Code outdoor lighting requirements. The applicant shall coordinate with the Design and Development Director or his/her designee prior to certificate of occupancy to ensure proper operation of parking lot lighting. Any deficiencies shall be corrected prior to issuance of a certificate of occupancy. 6. Any alteration to the site plan, including expansion, reduction, and reconfiguration shall be reviewed by the Design and Development Department. Alterations deemed minor by the Department may be processed through a Modification by Applicant (MBA). Any major expansion of the use or substantial modification to the approved floor plan shall require an amendment of this minor use permit. 7. The applicant shall comply with all applicable provisions of the La Quinta Municipal Code (LQMC), including LQMC Chapter 9.210.020. 8. Separate sign permits are required from the Planning and Building Divisions for all new proposed signs. 9. Attachments 1 for MUP 2018-0004 is approved herein. FIRE DEPARTMENT 10. The approval of this plan/permit is subject to a final fire inspection. The following items to be ready at final inspection - 1. Key for premise (to be installed in knox box.) 2. Fire extinguisher distribution - 1 2a-10bc rated fire extinguisher every 75 feet of travel mounted 3-5.5' from floor. 3. Second exit door to be equipped with common knowledge - single action hardware. 4. Main set of doors to be provided with signage stating - "this door to be unlocked while occupied." 5. All illuminated exit signage and emergency lighting to be load tested at final inspection. 6. Max occupancy load to be posted at conspicuous location. ADVISORY 11. Tenant improvements may trigger requirement to update accessibility improvements outside of building depending on if the cost estimate exceeds the Valuation Threshold in the CBC. 12. The following conditions are being presented as items that will be necessary at the time of building permit and do not need to be review in the minor use permit approval process. 1. Allowable area analysis will be required to justify the existing buildings construction and proposed new occupancy groups. 2. Based on the observed scope of work this project would appear to exceed the 2018 division of state architect valuation threshold of $161,298.00 necessitating accessible path of travel upgrades. Complete analysis shall be performed by the applicant and a detailed report shall be provided as to how the project demonstrates accessibility compliance in existing buildings and facilities. 3. Plans shall be prepared for permitting to the applicable code at the time of submittal. 4. Additional comments may be required based on further information being provided for review. This decision may be appealed to the Planning Commission by any party who submits the necessary paperwork and filing fee of $1,505.00 to this office within 15 days of the date of approval of this permit.
