SPEV 2018-0016 Master Craftsman's Expo (09.19.2018) 78-495 Calle Tampico La Quinta, CA 92253 760.777.7000 September 19, 2018 CASE NUMBER Special Event Permit 2018-0016 ACTIVITY/EVENT 2018 West Coast Artists Master Craftsmen’s Expo November 2-4, 2018 (10:00 am – 5:00 pm) La Quinta Civic Center Park APPLICANT Ms. Ronda Mills West Coast Artists P.O. Box 759 Acton, CA 93510 APPROVAL The Design and Development Department has reviewed and approved Special Event Permit – Non-Residential 2018-0016, pursuant to LQMC Section 9.100.130 (Special events-nonresidential), based on the following Findings: A. The event will not be detrimental to the health, safety and general welfare of the community in the area of the proposed event. B. There is adequate area to conduct the event and to accommodate the anticipated attendance. C. Sufficient parking will be provided for the anticipated attendance. D. Food service operations, medical facilities, solid waste facilities, sewage disposal methods and potable water service have been provided. E. Fire protection plans and facilities have been provided to the satisfaction of the fire marshal. F. Security plans and facilities have been provided to the satisfaction of the sheriff. G. Public roadways providing access to the event are capable of accommodating the anticipated traffic volumes in a reasonable and safe manner with minimal disruption to local traffic circulation. This approval authorizes the applicant to conduct the event pursuant to compliance with all conditions of approval of this permit. The applicant must obtain any permits, as may be required below, in order to physically set up the event. CONDITIONS OF APPROVAL Completion/confirmation prior to start of the event: 1. Notice shall be given to existing property owners and residents within 500 feet of the event areas prior to event, informing them of the provisions, restrictions and event conditions that will affect area traffic patterns and other routine daily operations in the area. The notice shall include the date, time, hours of operation, description of event, and name and contact phone number of the local contact person and the police department. Notice shall be issued no later than fourteen days prior to event, and completed no more than seven days prior to the event. Proof of noticing shall be provided to Design and Development department no later than seven (7) days prior to event. 2. The applicant shall provide a contact person information sheet, listing all designated event liaisons and their contact information. Specifically, event management staff shall be identified, with their respective 24-hour contact phone numbers. This list shall be submitted to the Design and Development Department no later than 7 days prior to event. 3. Permits for any temporary structures (e.g. tents and/or canopies exceeding 400 square feet), stages, portable generators or open flame devices shall be obtained prior to their installation. Prior to the event set-up, please contact the City of La Quinta (City) Building Division and Riverside County Fire Safety for any additional requirements, including Special Inspection Permits . Fire lanes shall be established and/or maintained during the event. 4. Smoking shall not be permitted in any tent or canopy or in any adjacent area where hay, sawdust or any other combustible materials are stored or used unless approved by the fire inspector. “NO SMOKING” signs shall be posted in all tents and canopies. 5. The minimum fire extinguisher (2A10BC) coverage shall be provided in every tent and canopy as per the following: a) 200 to 500 aggregate square feet of floor area: One 2A-10BC b) 501 to 1000 square aggregate feet of floor area: Two 2A-10BC c) Each additional 2000 square feet of floor area: One 2A-10BC 6. Extinguishers shall be securely installed and mounted 3-5 from ground. Fire extinguishers shall be inspected at time of final inspection. 7. Portable generators shall be shielded to prevent accidental contact with guests. Generators and internal combustion sources shall be separated from tents/canopies by a minimum of 20 feet and shall be isolated from the public. 8. Any lighting shall be directed away from surrounding roadways and surrounding residential properties. No spot or searchlights are permitted. 9. If any ground excavations are required, please contact Underground Service Alert (USA) at 1-800-227-2600 or 1-800-422-4133. This service is free of charge provided USA is given two days notice prior to commencement of work. 10. All temporary electrical wiring to any concession/vendor spaces shall be secured to prevent physical hazards to the public and participants. Wiring/cords shall not be subjected to environmental or physical damage. 11. All extension cords shall be over current protected and or ground fault interrupter protected. No additional taps are to be in any device. (NO octopus, 2 way, 3 way taps, cube adapter or multi-plug extension cords). Quad boxes are approved if wired with 12/3 gauge wire or greater. All extension cords shall be of 12/3 gauge wire or greater with approved connectors. 12. LP-Gas containers shall be located outside and adequately protected to prevent tampering, damage by vehicles or other hazards. Equipment such as tanks, valves, tubing and other related components shall be approved. 13. At least one 40BC or Class K type fire extinguisher shall be provided for each kitchen with a deep fat fryer, power generator, transformer, cooking operations and at locations where flammable or combustible liquids are stored or dispensed. 14. Location of concession stands utilized for cooking shall have a minimum of 20 feet of clearance from other concession stands, cooking tents, outdoor cooking, and rides. 15. Electrical heating, cooking equipment, and extension cords shall be of a grounded type, and approved for exterior use upon inspection. 16. Operations such as warming of foods, cooking demonstrations and similar operations that use solid flammables, butane or other similar devices which do not pose an ignition hazard, shall be approved upon inspection. 17. Roadways/traffic aisles to structures and activities in and around the event will be maintained accessible to emergency vehicles at all times. The applicant may be required to provide a fire lane of sufficient width for emergency vehicle access on Avenida La Fonda if required by the Fire Marshal. The applicant shall post “NO PARKING” signs to keep the lanes clear during the event hours as well as posting of advance notification signs of said restriction at least 48 hours prior to the event as required by the City Engineer. 18. The applicant shall obtain an encroachment permit for the off-site directional signs, promotional signs, pole banners and traffic controls placed in the City’s right-of-way that are allowed and as conditioned with this permit. Traffic control plans shall be submitted along with the permit application for City approval. Please contact Amy Yu at (760)777-7047 for assistance on obtaining an encroachment permit. The content, number, types, and sizes for the signs shall be reviewed under the encroachment permit and is not approved per this special event permit. As the applicant proposes to place signs in City street rights of way, the signs shall conform to Section 9.160 of the La Quinta Municipal Code (the Sign Ordinance) and the conditions set on the encroachment permit for said signage. Installation, design, maintenance and removal of the signs shall conform to the standards set forth in Section 9.160.070 of the Sign Code, and the conditions listed in this letter. 19. Prior to use of the off-site unpaved parking lots, the applicant shall comply with the requirements for Fugitive Dust Control per Chapter 6.16, LQMC. The applicant shall provide written evidence acceptable to the City Engineer to ensure that construction and stabilization of the unpaved parking lots for the event are pursuant to Chapter 6.16. 20. The applicant shall provide access for the residents on Avenida Nuestra, Calle Guatamala, Calle Hueneme, Calle Iloilo, Calle Jacumba and Calle Kalima, their guests, mail carriers, and companies delivering to them from Desert Club Drive via Calle Fortuna or Calle Cadiz and Avenida Nuestra and as determined by the City of La Quinta. The residents living on the south side of Avenida La Fonda within the event area, their guests, mail carriers, and companies delivering to them shall be allowed access to the westbound one-way Avenida La Fonda and as determined by the City of La Quinta. Additionally, the applicant shall provide a simplified traffic control plan to residents showing the access routes and restrictions to be in force during the event. Proof of providing this plan shall be provided to the City’s Planning department no later than 7 days prior to event. 21. If any traffic signals are going to be put into all red flash during the event, a note shall be added to the Traffic Control Plan to notify the traffic signal maintenance staff when they are to be placed into flash and when they are to be put back into full color operation. 22. In general, the traffic control plan appears complete, but additional signs may be required after issuance of this Special Event Permit if deemed necessary by the City Engineer. The Traffic Control Plan shall be approved prior to issuance of any applicable encroachment permit. 23. The parking plan and use of vacant lots shall be modified if any lots become unavailable or additional lots are to be utilized. 24. The applicant shall secure and provide proof of approval from owner(s) of vacant lot(s) to be used for parking purposes. 25. The applicant shall remove all non-applicable traffic control devices on Calle Tampico and Avenida La Fonda during non event hours. 26. The City of La Quinta reserves the right to require modifications of the work be made at permittee’s sole cost for proper sight distance requirements per guidelines in the AASHTO “A Policy on Geometric Design of Highways and Streets, 5th Edition” or latest, in the installation of all appurtenances abutting and within the public street right-of-way. 27. The applicant shall provide adequate proof of insurance to the City of La Quinta for event. Insurance shall be provided a minimum of thirty (30) days prior to event. 28. All vendors shall obtain a City Business License. All vendors shall obtain City business license no later than thirty (30) days prior to event. 29.The applicant shall obtain and adhere to a City of La Quinta Facility Use Agreement that allows use of the Civic Center Park for the event dates. 30.The applicant shall contact and contract with Burrtec Waste on installation of portable toilets and arrangement of trash pick up. 31.In the event that the La Quinta Arts Foundation delivers notice to the City of an alleged copyright infringement (e.g. cease and desist), the City shall have the right to suspend or revoke this permit through the City’s suspension or revocation proceedings, unless or until such dispute is resolved. Completion/confirmation during the event: 32.Set up and operation of the event shall be consistent with the site plan, event information, and traffic control plan on file and attached to this letter. 33.The event shall not be detrimental to the health, safety and general welfare of the community in the area of the proposed event. 34.The applicant shall have traffic control attendants who will help with traffic control and pedestrian safety when entering and exiting the event. Attendants shall be responsible for monitoring safe pedestrian access through surrounding parking lots and streets. 35.Parking monitors shall wear light-colored clothing and reflective vests as needed. Flash lights shall be used after dusk. 36.No fire-lanes, fire hydrants or any other Fire Department appliances shall be blocked or obstructed. 37.All motor vehicles shall be parked in designated parking areas. Designated Fire Lanes are to be kept open with minimum of 20 feet unobstructed access at all times. Fire lanes shall be clearly outlined in an approved manner throughout the event grounds by posting “NO PARKING FIRE LANE”. 38.The use of amplified equipment for music presentations is permitted, provided that all provisions of the City of La Quinta’s Noise Ordinance (LQMC 9.100.210) are complied with. Due to the sensitive land-uses surrounding the La Quinta Civic Center Campus, music presentations and event noise shall not exceed 65 decibels at any time, measured from the perimeter of the event site. 39.Certain areas providing access to the event area are public and, as such, general public access may not be denied or restricted in any manner that extends beyond the limits of this event as approved. This includes residential access to the neighborhood south of the La Quinta Civic Center Campus. 40.Security personnel shall be easily identifiable to the public by the provision of uniformed personnel. All designated private security personnel must be licensed by the State of California, possess a valid Private Security license, and have a City of La Quinta Business License. 41. Public property shall not be defaced by paint or other types of permanent materials such as pen, markers, etc. 42. The serving of food at the event shall be subject to rules and requirements of the Riverside County Health Department. 43. All required traffic control and dust mitigation measures shall be implemented by the applicant at no cost to the City of La Quinta. Dust control measures shall be employed during all event activities, pursuant to Chapter 6.16 of the Municipal Code. Completion/confirmation after the conclusion of the event (if necessary): 44. The event sites used shall be left clean and in its original manner after the event. Temporary trash receptacles shall be provided in and around the event areas. All event areas shall be left free of debris at the end of each day’s activities, and after the event concludes. 45. All signage must be removed at the conclusion of the event, or each sign is subject to a $50.00 fine. Please contact the Code Compliance Department at (760) 777-7050 regarding removal of signage. 46. Any damage to public hardscape due to the installation and/or removal of the directional signs shall be repaired as directed by the City Engineer. This includes but is not limited to pole banner brackets, sidewalks, curb and gutter, landscaping, and pavement especially within the surrounding public streets. FINAL ACKNOWLEDGEMENT/CONTACT INFORMATION By holding this outdoor event, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta (“the City”), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this temporary use permit. The City of La Quinta shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or preceding and shall cooperate fully in the defense. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein. This decision may be appealed to the Planning Commission, provided the written appeal and filing fee of $1,505.00 are submitted to this Department within 15 calendar days. It will be advertised regionally. The participants that will participate will be regionally located artists from the Western United States. This is an event that we plan to build to a premier status. I cannot imagine that this event will attract more than 300 people at any one time, during the event. This event will not be fenced and it will not charge admission The anticipated number of staff members will be 5 of West Coast Artists’ staff and the others will be Independent Contractors, such as security, cleaning crew, rental facilities, etc. Participants will be able to load and unload their work and displays from the parking lots surrounding the park. They will move their vehicles to alternative parking. We will contract for then dirt lot at Calle Tampico and Desert Club Drive for the artists to park their vehicles in during the event. Participants will purchase their own Business Licenses for the City of La Quinta. West Coast Artists will carry a City of La Quinta Business License. Desert Security Services will provide Security for the event. West Coast Artists has non-profit status. We do not anticipate more than 100 artists for this first-time event. Regarding: Master Craftsmen’s Expo November 2 - 4, 2018 Time line: Artists begin set up at 6:00 am until 11:30 am. Event opens to public at Noon on Friday, November 2, 2018. Event closes at 5:00 pm on Friday, November 2, 2018 Opens at 10:00 am on Saturday, November 3, 2018 Closes at 5:00 pm on Saturday, November 3, 2018 Event opens at 10:00 am on Sunday, November 4, 2018 Closes at 5:00 pm on Sunday, November 4, 2018 Tear begins at 5:00 pm on Sunday, November 4, 2018, concludes at 8:00 pm on Sunday, November 4, 2018.
