Reduction of front and side yard setbacks TRACT MAP NO. 13640 (EA 10720) La Quinta Properties, Ltd. (Hearings opened at 9:45 A.M. and closed at 10:34 A.M.) PRESENTATION: Mr. Libiez presented the subject application together with all maps pertinent thereto, surrounding property owners having previously been notified accord- ing to the provisions of Ordinance No. 348. Mr. Libiez stated that the applicant pro- posed to develop 396 single family attached and detached units in clusters, surrounded by open space and with a central lake theme. Environmental Assessment No. 10768 was submitted and a negative declaration was filed on June 11, 1979 with no appeals filed within the specified time period. Mr. Libiez added that the design limits the access. on Eisenhower to two and it conforms with standards. for Road Department circulation system. Staff recommendation was approval, subject to attached conditions and with findings of the staff. 8 2 4 JULY 26. 1979 Roy Stephenson, County Road Department Engineer, stated that they wanted to amend the Road Department letter dated June 19, 1979 and change the access distance from 660 foot intervals along Eisenhower Drive to 220-foot intervals. (Chairman Olesen asked that all persons desiring to give testimony, either for or against, to rise and be sworn. Mr. Olesen administered the oath to those desiring to give testimony.) Box 2125, Palm Springs, California Maurice Sherrill, Counsel for Coachella Valley County Water District, 3737 Main Street, Riverside, California • Mr. Brewton stated that there were a number of consultants present to answer any questions. He told how the project was developed from results of their Hidden Palms project. They had 200 units and 800 customers. They got feedback from those sales and implemented them into this plan. He stated that the lake would serve as storage capacity for storms. It would cover 8 acres. He added that they planned to build in four phases. When questioned by Councilmember Branson about parking, Mr. Brewton stated that Condition 12 called for 12 parking spaces for one bedroom units and 2% spaces for two bedroom units. He stated that each unit would have a 2-car garage and they felt that would satisfy the requirement with visitor parking on the street (one 'side only). Mr. Padavick stated that the Board of Supervisors was considering amending the ordinance regarding parking for multi -family units where sufficient parking within the development is not provided, necessitating public street parking. He added that this did not apply in this project. Under Condition 2, Mr. Brewton stated that 4 structures were permitted as models. He stated that they have six different floor plans and need 6 models to show their project. Mr. Padavick stated that he did not believe that the Building Department would issue permits for models until the map was recorded. Mr. Manning agreed that a portion of the map would have to be recorded before permits would be issued for models and he asked that Condition 2 be deleted. Mr. Spiegelman stated that he was the court -appointed receiver -for the La Quinta Water Company. He stated that the La Quinta Water Company is a private utility chartered by the Public Utilities Commission of California. This development is on property located within the boundaries of the La Quinta Water Company. A dispute exists between the. developer and the La Quinta Water Company over the issue of providing domestic water. He added that the developer had contracted with the Coachella Valley County Water District to provide domestic water within its geographic area. Coachella Valley County Water f JULY 26, 1979 District has no existing service within the boundaries of the La Quinta Water Company.. Mr. Spiegelman stated that they.,could•.provide .water; at a lower cost than Coachella Valley County Water District. 'He added•that La Quinta Water Company had a priority right to serve them water. He stated that, until this dispute was resolved, it would . be inappropriate to approve this development because of litigation which would commence and a delay would result. Mr. Manning advised that, when a dispute like this arose, it was referred to the Water Quality. Control Board and the Environmental Health Department. It would not be a concern of the Council. Mr. Brewton stated that his client had not entered into any contract with Coachella Valley County Water District. He added that they had commitments from both companies, but had no dispute. Mr. Sherrill stated that the proposed development was within the boundaries of the • Coachella Valley County Water District and they had an obligationand duty as well as a right to serve any territory within their boundaries. He stated that the developer had come to their agency and they had given their letter indicating willingness and ability to serve them. Mr. Sherrill stated that the La Quinta Water Company was in court - appointed receivership and it was their desire and intention to acquire the facilities of that company. If necessary, they will condemn it. He stated that it had been the policy of the Coachella Valley County Water District to acquire other water companies. He concluded by stating that if there was a dispute, it was between the water districts and the developer.. Mr. Meskey stated that the La Quinta Water Company was a private company whereas the Coachella Valley County Water District was a public agency. He added that they have the ability to provide water service and both the water district and the water company have the right to provide it. Mr. Hamilton stated that he was a land planner and would be glad to answer any questions. He pointed out drawings of their elevations that had been set up for the Council's review. Regarding the variance, Mr. Libiez stated that the applicant was requesting a variance to the front and side yard setbacks. Ordinance requires 10 ft. front and rear setbacks and 5 ft. side setbacks. Applicant was proposing to reduce the front yards below the 10 ft. and side yards to "0" in some areas. Mr. Libiez stated that staff could not support the variance for the front yard reduction, but agreed that the "0" lot line on one side yard would be a good planning procedure. This would give a 10 ft. clearance between structures vital for fire protection. Recommendation was approval of the variance subject to attached conditions, with the front and rear setbacks conforming and a "0" lot line on one side only. Mr. Libiez stated that staff had requested the applicant to furnish a list of lot numbers that would be affected by the "0" lot line and a letter had been received to that effect. Mr. Brewton stated that they agreed with staff except for the front yard setback. Ten feet would not permit parking in the driveway in front of the garages and they would derive an additional 5 ft. green belt area.
