Compliance with all findings is necessary to approve a Variance application. 1. Consistency with General Plan. How is the variance consistent with the General Plan? 2. Consistency with Zoning Code. How is the variance consistent with the provisions of the Zoning Code? 3. Compliance with CEQA. How is the variance in compliance with the requirements of the California Environmental Quality Act? 4. Surrounding Uses. Why will approval of the variance not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity? 5. Special Circumstances. What special circumstances are applicable to the subject property, including size, shape, topography, location, or surroundings, which, when the zoning regulations are strictly applied, deprive the property of privileges enjoyed by other properties in the vicinity subject to the same zoning regulations? 6. Preservation of Property Rights. Why is the granting of the variance necessary for the preservation of a substantial property right possessed by other property in the same vicinity and zoning district and otherwise denied to the subject property? 7. No Special Privileges. How will the variance not constitute a grant of special privileges which is inconsistent with the limitations placed upon other properties in the vicinity subject to the same zoning regulations? 8. No Land Use Variance. Would the request authorize a land use or activity not permitted in the applicable zoning district? If so, it cannot be approved. MINIMUM SUBMISSION REQUIREMENTS: ❑ Development plans (see separate plan submittal requirements sheet). ❑ A completed Environmental Information form with required fee, unless categorically exempted by the California Environmental Quality Act Guidelines or determined to be previously assessed. ❑ A notification package containing a scaled map or Assessor's map pages showing all properties within a 500-foot radius of the subject property (including continuously owned property); a typed list of the property owners and their mailing addresses within this 500-foot radius, and a typed list of the residents that reside contiguous to the subject property. Submit three (3) sets of typed, self-adhesive, addressed labels for the above property owners and residents that live contiguous to the subject property. They are lots 186, 239-240, 242-247 and they range from 8.8' to 11.3'. There is 1 lot where the block wall is over 8'. It is lot 167 and it is 8.5'. When the tamarisk trees were removed, the ground elevation at the walls dropped anywhere from a few tenths to a few feet. Do you need an exhibit with this information? Scott A.
