VARIANCE CITY OF LA QUINTA PLANNING & DEVELOPMENT DEPARTMENT 78-495 CALLE TAMPICO LA QUINTA, CA 92253 INSTRUCTIONS FOR VARIANCE APPLICATION Filing Procedure The applicant shall submit the following items: 1. A. completed application form. 2. Six (6) copies of sealed plans illustrating the specifics of the request. 3. Three (3) sets of mailing labels indicating the names and mailing addresses of property owners within 300 feet of the exterior limits of the property involved in this proposed project, one (1) photocopy of the above list, and one (1) set of assessor's maps indicating the above property. 4. The Planning Fee as established by the Municipal Ordinance. Procedure By The City Upon receiving a complete application package, the City will process and review the case as follows: 1. The application will be reviewed for adequacy and a determination is made whether an Environmental Impact Report (EIR) is required. 2. If and EIR is required, the applicant will be so notified and a Draft Environmental Impact Report must be submitted by the applicant. Additional fees are required for EIR's. 3. If an EIR is not necessary, or if one is filed when required, a date for Planning Commission review will be set. The Planning Commission holds Public Hearings on the second Tuesday of each month, beginning at 7:00 p.m. in the Council Chambers, at 78-495 Calle Tampico. 4. When processing the application, the Planning Commission will consider such factors as: a. Purpose of a Variance. "The purpose of the variance is to allow variation from the strict application of the terms of this chapter whereby reason of topography, extraordinary situation or condition of such piece of property, the literal enforcement to this chapter would involve practical difficulties or would cause undue hardship unnecessary to carry out the spirit and purpose of this chapter." b. Provisions for Granting a Variance. "The Planning Commission may grant a variance providing that it finds: (1) No special privilege is extended to one individual property owner, i.e., the circumstances must be such that the same variance would be appropriate for any property owner facing similar circumstance; and, (2) The granting of the variance will not be injurious to public welfare, nor to property in the vicinity of the application; and, (3) The variance shall be in harmony with the general purpose and intent of the Zoning Ordinance and General Plan; and, (4) A variance, if approved, shall be made subject to such conditions as are necessary to accomplish the purpose of these regulations; and, (5) In no event shall a variance be issued to allow a use not otherwise permitted in a zone."
