SPEV 2018-0040 2019 Desert Classic (01.09.2019) 78-495 Calle Tampico | La Quinta | California 92253 | 760.777.7000 | www.La-Quinta.org January 9, 2019 CASE NUMBER Special Event Permit 2018-0040 ACTIVITY/EVENT 2019 Desert Classic January 14 – 21, 2019 La Quinta Country Club/PGA West APPLICANT Mr. Jon Casey Desert Classic Charities 78080 Calle Amigo La Quinta, CA 92253 APPROVAL The Design and Development Department has reviewed and approved Special Event Permit 2018-0040, pursuant to LQMC Section 9.100.130 (Special Events - Nonresidential), based on the following Findings: A. The event will not be detrimental to the health, safety and general welfare of the community in the area of the proposed event. B. There is adequate area to conduct the event and to accommodate the anticipated attendance. C. Sufficient parking will be provided for the anticipated attendance. D. Food service operations, medical facilities, solid waste facilities, sewage disposal methods and potable water service have been provided. E. Fire protection plans and facilities have been provided to the satisfaction of the fire marshal. F. Security plans and facilities have been provided to the satisfaction of the sheriff. G. Public roadways providing access to the event are capable of accommodating the anticipated traffic volumes in a reasonable and safe manner with minimal disruption to local traffic circulation. This approval authorizes the applicant to conduct the event pursuant to compliance with all conditions of approval of this permit. The applicant must obtain any permits, as may be required below, in order to physically set up the event. CONDITIONS OF APPROVAL Completion/confirmation prior to start of and during the event: 1. Permits for any temporary structures (e.g. stages, bleachers, tents and/or canopies exceeding 400 square feet), stages or open flame devices shall be obtained prior to their installation. Prior to the event set-up, please contact the La Quinta Building Division and Riverside County Fire Safety for any additional requirements of the Fire Marshal. Applicant shall obtain inspection permits from the La Quinta Building Division and the Riverside County Fire department for inspection of structures and event set-up. Fire lanes shall be established and/or maintained during the event. 2. No fireworks, or open flame, or any other device emitting flame or fire or creating a glow capable of igniting combustibles shall be permitted. 3. Heating and Cooking Equipment- At least one 2A10BC fire extinguisher shall be provided at all vendor booths that are cooking. One Class K type fire extinguisher shall be provided for each vendor booth with a deep fat fryer. 4. Location of concession stand utilized for cooking shall have a minimum of 20 feet of clearance from other concession stands, cooking tents, outdoor cooking, and amusement rides. 5. Electrical heating, cooking equipment and extension cords shall be of a grounded type and approved for exterior use upon inspection. 6. Operations such as warming of foods, cooking demonstrations and similar operations that use solid flammables, butane or other similar devices which do not pose an ignition hazard, shall be approved upon inspection. 7. Extension cords- shall be over-current protected and/or ground-fault interrupter protected. No additional taps are to be in any device. (NO octopus, 2 way, 3 way taps, cube adapter or multi-plug extension cords). Quad boxes are approved if wired with 12/3 gauge wire or greater. All extension cords shall be of 12/3 gauge wire or greater with approved connectors. 8. Obstructing exits-Furnishings, decorations or other objects shall not be placed so as to obstruct exits, access thereto, egress therefrom, or visibility thereof. Hangings and draperies shall not be placed over exit doors or otherwise be located to conceal or obstruct an exit. 9. In occupancies in Group A- curtains, draperies, hangings and other decorative materials suspended from walls or ceilings shall meet the flame propagation performance criteria of CCR Title 19 in accordance with section 807.2 or be non-combustible. (CFC 807.1) 10. LP-Gas containers- shall be located outside and adequately protected to prevent tipping over, tampering, damage by vehicles or other hazards. Equipment such as tanks, valves, tubing and other related components shall be approved. 11. TENTS AND CANOPY(S)- plans shall meet the requirements of the 2013 California Fire Code. Tents and temporary membrane structure having an area in excess of 400 square feet shall obtain a permit by submitting plans to the Riverside County Fire Department. High-Wind Evacuation Plan – Tent supplier and event coordinator shall understand that the use of the tent or canopy in winds at 40 mph or greater is not permitted. Event coordinator is responsible to take necessary actions to stop occupancy and use of the tent or canopy when winds of 40 mph or greater are observed or expected. 13. Seating Access- Title 19 requires, table and seating access width. Aisle access ways shall provide a minimum of 12 inches of width plus.5 inches width for each additional foot or fraction thereof, beyond 12 feet of aisle access-way length, measured from the center of the seat farthest from an aisle. The length of travel along the aisle access-way shall not exceed 30 feet from any seat to the point where a person has a choice of 2 or more paths of egress travel to separate exits. 14. No Smoking- Smoking shall not be permitted in any tent or canopy or in any adjacent area where hay, sawdust or any other combustible materials are stored. NO SMOKING signs shall be conspicuously posted in all tents and canopies open to the public and wherever otherwise specified by the fire inspector. 15. Extinguishers- At least one 2A10BC type extinguisher shall be provided every 75 feet for all vendor tent areas. 16. Alternative Anchorage – The alternative concrete weight ballasting is approved with the conditional requirement that each of the tent or canopy legs to be affixed or secured to the weight ballast. The leg shall be secured within an area of the lowest 12-inches, so as to prevent the possibility of the legs to move or “walk”. 17. FIRE LANES- No fire-lanes, fire hydrants or any other Fire Department appliances shall be blocked or obstructed. 18. ALL MOTOR VEHICLES- shall be parked in designated parking areas. Designated Fire Lanes are to be kept open with minimum of 20 feet unobstructed access width at all times. Fire lanes shall be clearly outlined in an approved manner throughout the event grounds by posting “NO PARKING FIRE LANE”. 19. GENERATORS AND INTERNAL COMBUSTION POWER SOURCES- Shall be separated from temporary membrane structures, tents, canopies by a minimum of 20 feet and be isolated from contact with the public. And will have an extinguisher assigned to each generator. 20. CROWD MANAGERS- A minimum of 1 trained crowd manager for every 250 persons in attendance is required to be functioning during the hours of the event. The Crowd Manager's duties shall follow the requirements of CFC 403.12.3.3. 21. Portable generators shall be shielded to prevent accidental contact with guests. Generators and internal combustion sources shall be separated from tents/canopies by a minimum of 20 feet and shall be isolated from the public. 22. Any lighting shall be directed away from surrounding roadways and surrounding residential properties. No spot or searchlights are permitted. 23. If any ground excavations are required, please contact Underground Service Alert (USA) at 1-800-227-2600 or 1-800-422-4133. This service is free of charge provided USA is given two days notice prior to commencement of work. 24. All temporary electrical wiring to any concession/vendor spaces shall be secured to prevent physical hazards to the public and participants. Wiring/cords shall not be subjected to environmental or physical damage. 25. The applicant shall comply with the City of La Quinta encroachment permit issued for the event, under ENC2019-0002. 26. All vendors shall obtain a City Business License. The serving of food and alcoholic beverages during the event shall be subject to the rules and requirements of the Riverside County Health Department and State of California Alcoholic Beverage Control, respectively. 27. Separate Structure Other Than Building Permit required from the Building Division, submittal shall include detailed site plan showing all viewing structures, stages and tents with structure dimensions, proposed stairways, ramps and doorways, and have structural calculations prepared to the 2016 California Building Code provided justifying their installation. The City of La Quinta Wind Design is 110 mph (Ultimate) / 85 mph (Nominal) Exposure C and is within the Seismic Design Category D2. 28. Structural Observation is required by the Engineer of Record, each structure shall be reviewed for conformance with the approved structural calculations and have a stamped and signed letter submitted to the Building Division prior to the event per the requirements in Section 1704 of the 2016 California Building Code. 29. Additional comments may still apply based on further review of separate applications with the Building Division. Completion/confirmation during the event: 30. The use of amplified equipment for music presentations is permitted, provided that all provisions of the City of La Quinta’s Noise Ordinance (LQMC 9.100.210) are complied with. 31. The use of amplified equipment for a music concert on Friday January 18, 2019 and Saturday, January 19, 2019 from 5:00 p.m. – 7:00 p.m. each day is permitted, provided that all provisions of the City of La Quinta’s Noise Ordinance (LQMC 9.100.210) are complied with, with the exception of the Noise Standard temporarily being raised from 60 dB(A) to 75 dB(A) for this time period. During this time period, the noise standard will be temporarily raised to 85 dB(A) for the western-most neighboring homes and the applicant shall implement noise limiters, gates, or compressors per technology mitigation measure #2 from the noise study dated January 12, 2018 and on file. 32. Noise emitting from generators for the scoreboards must comply with all provisions of the City of La Quinta’s Noise Ordinance (LQMC 9.100.210). 33. Certain areas providing access to the event area are public and, as such, general public access may not be denied or restricted in any manner that extends beyond the limits of this event as approved. 34. No on-street parking outside the approved event area may be utilized for valet parking services. All on-street parking areas shall remain available for public use. 35. Security personnel shall be easily identifiable to the public by the provision of uniformed personnel. All designated private security personnel must be licensed by the State of California and possess a valid Private Security license. 36. Public property shall not be defaced by paint or other types of permanent materials such as pen, markers, etc. 37. The serving of food at the event shall be subject to rules and requirements of the Riverside County Health Department. 38. Smoking shall not be permitted in any tent or canopy or in any adjacent area where hay, sawdust or any other combustible materials are stored or used unless approved by the fire inspector. NO SMOKING signs shall be posted in all tents and canopies. 39. No fireworks, or open flame, or any other device emitting flame or fire or creating a glow capable of igniting combustibles shall be permitted. 40. All motor vehicles shall be parked in designated parking areas. Designated Fire Lanes are to be kept open with minimum of 20 feet unobstructed access at all times. Fire lanes shall be clearly outlined in an approved manner throughout the event grounds by posting “NO PARKING FIRE LANE”. 41. Staff shall be available to remove the temporary road closures so as to provide emergency access at Pete Dye Entrance at all times during the event. 42. As the applicant proposes to place signs in City street rights of way, the signs shall conform to Section 9.160 of the La Quinta Municipal Code (the Sign Ordinance) and the conditions set on the encroachment permit for said signage. 43. All required traffic control and dust mitigation measures shall be implemented by the applicant at no cost to the City of La Quinta. Dust control measures shall be employed during all event activities, pursuant to Chapter 6.16 of the Municipal Code. 44. Applicant to provide manual traffic control by Police Department officers at the roundabout if determined to be necessary by the Public Works Director. Completion/confirmation after the conclusion of the event (if necessary): 45. The event sites used shall be left clean and in its original manner after the event. Temporary trash receptacles shall be provided in and around the event areas. All event areas shall be left free of debris at the end of each day’s activities, and after the event concludes. 46. All signage must be removed at the conclusion of the event, or each sign is subject to a $50.00 fine. Please contact the Code Compliance Department at (760) 777-7050 regarding removal of signage. 47. Any damage to public hardscape due to the installation and/or removal of the directional signs shall be repaired as directed by the City Engineer. This includes but is not limited to sidewalks, curb and gutter, landscaping, and pavement especially within the surrounding public streets. FINAL ACKNOWLEDGEMENT/CONTACT INFORMATION By holding this outdoor event, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta (“the City”), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this temporary use permit. The City of La Quinta shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or preceding and shall cooperate fully in the defense. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein.
