TUP 2019-0001 Lowes Seasonal Flower Sales (02.21.2019)February 21, 2019 Mr. Errol Pollard Lowes 78865 Highway 111 La Quinta, CA 92253 SUBJECT: TEMPORARY USE PERMIT 2019-0001 LOWES SEASONAL FLOWER SALES Dear Mr. Pollard: The Design and Development Department has reviewed and approved your request to establish a temporary flower sales lot within the Lowes parking lot. The approval of the event is granted under Section 9.100.090 of the La Quinta Municipal Code subject to the following Conditions of Approval: 1.The event may be open from date of this letter until May 1, 2019; Monday through Sunday, between the hours of 8:00 a.m. and 6:00 p.m. 2.The location of the event is limited to the Lowes parking lot. Traffic aisles shall not be blocked. No handicap parking stalls shall be blocked. 3.The applicant shall comply with fire prevention standards as approved and enforced by the Fire Marshal. The Fire Marshal can be contacted by calling (760) 863-8886. 4.The applicant shall secure an electrical permit if electric power is to be provided. 5.A temporary fence surrounding the Christmas tree lot is permitted. The proposed fence shall be constructed of chain link fencing material and shall not exceed a height of six (6) feet. No other temporary structures are proposed or permitted as part of this permit. 6.Roadways, parking areas, and pedestrian traffic aisles outside the proposed area shall be maintained accessible at all times. 7.Signs shall be restricted to one banner sign per street frontage, each sign not exceeding thirty-two square feet. Banners may be placed on the temporary fence or adjacent within the parking area, but not on Highway 111. Other signs and advertising devices such as pennants, flags, A-frame signs, are prohibited. 8.Adequate trash receptacles shall be provided. 9.A security guard is permitted on-site if needed during the operations of the lot. No overnight camping, either in tents or vehicles, is permitted as part of this permit. 10. Facility shall be removed and the premises cleared of all debris and restored to the condition prior to the establishment of the facility by May 2, 2019. 11. By holding this temporary sale, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City’s approval of this project. The City of La Quinta shall have the right to select its defense counsel at its sole discretion Adherence to these conditions, as outlined, will ensure that adverse impacts to surrounding properties and businesses will be minimized.
