MA 2019-0005 Davis Residence - 78645 La Jarita (Avenida) (04.04.2019)April 4, 2019 Mr. Rick Morris 51-525 Avenida Juarez La Quinta, CA 92253 SUBJECT: MINOR ADJUSTMENT 2019-0005 – Davis Residence Dear Mr. Morris: The Design and Development Department has reviewed your Minor Adjustment application (MA 2019-0005), pursuant to the City of La Quinta Zoning Code. You requested two modifications: the first to increase the building height from the permitted 17 feet to 17 feet and 11 inches, and the second to increase lot coverage from the permitted 50% to 51.3%. Staff has reviewed your request, and finds: 1.The requested increase in height from 17’ to 17’11” and building coverage from 50% to 51.3% are consistent with Section 9.210.040.C., insofar as they represents an increase in a numerical development standard of less than 10%. 2.The project is consistent with the General Plan, as it proposes a single family home in the Low Density Residential land use designation. 3.The project is consistent with the Zoning Code, insofar as Section 9.210.040 allows for up to three variations of up to 10% of development standards for single family home building permits. 4.The project complies with CEQA, insofar as it is categorically exempt under CEQA Guidelines Section 15305, Minor Alterations to Land Use Limitations. 5.Approval of this Minor Adjustment will not create conditions materially detrimental to the public health, safety and general welfare, or be injurious to or incompatible with other properties in the vicinity because an increase of 11 inches will be imperceptible from surrounding properties, the style of the home will be similar to that of other homes in the area, and homes in the area currently exist that exceed the 17 foot height limitation. In regards to the increase in lot coverage, the City does not have a maximum garage size standard, and the home and garage together fit within the required setbacks. All other development standards of the La Quinta Zoning Code are applicable and shall be adhered to in preparing plans for building plan check. Please note that the Zoning Ordinance allows up to three Minor Adjustments per lot, so that there now remains one Minor Adjustment request for this property.
