SUBJECT: MODIFICATION BY APPLICANT 2019-0006 OKURA
Dear Mr. Lumsden:
The Design and Development Department has reviewed your request for a
modification to the existing commercial building located at 78-480 Highway 111.
The modifications include a new color pallet for the exterior walls. It has been
determined that said plan modifications are minor, will not result in a significant
change in the project as approved by the decision making authority, and comply
with the spirit and intent of the Point Happy Specific Plan. This proposal only includes
changes, substitutions and adjustments to the approved color palette. Therefore,
the design modification is approved as shown on the attached exhibits, subject to
the following conditions of approval:
1. The applicant/property owner agrees to defend, indemnify, and hold harmless the
City of La Quinta (the “City”), its agents, officers and employees from any claim, or
litigation arising out of the City’s approval of this project. This indemnification shall
include any award toward attorney’s fees. The City of La Quinta shall have the right
to select its defense counsel in its sole discretion. The City of La Quinta shall promptly
notify the applicant of any claim, action, or proceeding and shall cooperate fully in
the defense.
2. Additional changes, substitutions or adjustments shall be sent to the Design and
Development Department for review.
