LQ Executive Order No. 05 Amended 1 2020-04-21 - Outdoor Recreation Activities Prohibited 78-495 CALLE TAMPICO, LA QUINTA, CA 92253 EXECUTIVE ORDER NO. 5 AS AMENDED ORDER GOVERNING LIMITED USES FOR OUTDOOR RECREATION AT PARKS, TRAILS, AND RECREATIONAL COURTS IN THE CITY EFFECTIVE IMMEDIATELY Date of Executive Order: March 24, 2020 Date AS AMENDED: April 21, 2020 Pursuant to Chapter 2.20 of the La Quinta Municipal Code and City Council Resolution No. EM 2020-001, the City Manager for the City of La Quinta hereby ORDERS the following: 1. Pursuant to the AMENDED ORDER OF THE HEALTH OFFICER OF THE COUNTY OF RIVERSIDE AND OF THE COUNTY EXECUTIVE OFFICER AS DIRECTOR OF EMERGENCY SERVICES, dated April 20, 2020, all “public and private gatherings” (as defined therein) within the jurisdiction of the Riverside County Public Health Officer were and remain prohibited, subject to certain exceptions, including exceptions set forth in Sections 1(i) and 1(j) of the amended county order relating to parks, trails, and other outdoor areas and non- contact outdoor sports. This order, as amended, is issued to implement the amended county order for limited re-opening and uses of outdoor recreation facilities and equipment in the City of La Quinta. 2. Subject to the limitations in this order, parks, trails, and other outdoor areas may be used for walking, jogging, hiking, biking, equestrian activities, and other non-contact outdoor sports, such as golf, pickleball, and tennis. Activities that create contact with individuals, fixed objects or shared items, such as picnic tables and playgrounds, activities involving groups of children, adult or children team sports, spectator sports, or other similar public or private events and gatherings are prohibited. 4. Subject to subsequent order from the City Manager, all skate parks located in the City of La Quinta are closed and shall remain unavailable for use, or used by, the public; however, dog parks in the City of La Quinta are hereby re-opened for the limited uses authorized in this order and subject to the social distancing and face covering requirements that are applicable to other outdoor areas in the City of La Quinta. 5. All child play equipment located on or at any park or recreational area located in the City of La Quinta is hereby closed and to be sealed off from public use until subsequent order from the City Manager. No person, child or adult, may touch or use the child play equipment at the parks and recreation areas subject to this order for whatever purpose, whether that use is for the purpose for which the child play equipment was installed or otherwise. All public restrooms at any park, trail, outdoor area, or recreation area in the City of La Quinta shall remain closed from public use until subsequent order from the City Manager. 6. All outdoor recreational courts and their ancillary equipment located in the City of La Quinta, used for a sport or activity that requires or allows two or more persons to touch a single ball or other tangible object to engage in continuous play of that sport or activity, such as tennis courts and pickleball courts, are hereby re-opened for the limited uses authorized in this order and subject to the social distancing and face covering requirements that are applicable to other non-contact outdoor sports in the City of La Quinta; furthermore, only “singles play” is authorized for non-contact racket sports (such as tennis and pickleball), and any waiting areas or spectator areas used for waiting shall follow social distancing requirements. 78-495 CALLE TAMPICO, LA QUINTA, CA 92253 7. All hiking trails, and public parking lots available for use at trail heads, in the City of La Quinta are hereby re-opened for the limited uses authorized in this order and subject to the social distancing and face covering requirements that are applicable to other outdoor areas in the City of La Quinta; however, street parking for hiking trails and around trail heads shall remain prohibited until subsequent order from the City Manager. 8. This order is issued to best protect the public health and welfare and follows the most recent orders and directives from the California Department of Public Health as implemented by Riverside County Public Health Office. Any subsequent order from the City Manager shall be based on further direction, if and when issued, from the California Department of Public Health or the Riverside County Public Health Officer, including any further direction on the Internet Web site for the California Department of Public Health, at: https://covid19.ca.gov/stay- home-except-for-essential-needs/ and Riverside County Public Health Office at: https://www.rivcoph.org/coronavirus, or successor Web sites established by the state department or county public health office. 9. The Assistant to the City Manager is hereby directed to coordinate, deploy, and monitor the limited re-opening and uses of outdoor recreation facilities and equipment in the City of La Quinta, subject to this order, with notices to the public and any other reasonable means necessary or appropriate. 10. This order applies to all parks, trails, and other outdoor areas, and any outdoor recreation facilities and equipment, in and throughout the City of La Quinta whether public or privately owned. The City of La Quinta, however, may re-open any city- owned public park or other city-owned recreation facility in its discretion to facilitate compliance with the limited uses authorized by this order. 11. This order does not supersede City Manager Executive Order No. 2 dated March 18, 2020. Executive Order No. 2 shall continue to be in effect, and parks owned by the City of La 78-495 CALLE TAMPICO, LA QUINTA, CA 92253 Quinta and subject to Executive Order No. 2 shall also be governed by this order to the extent this order is applicable. 12. Any use of parks, trails, and other outdoor areas for walking, jogging, hiking, biking, equestrian activities, and other non- contact outdoor sports, such as golf, pickleball, and tennis, shall comply with any other generally applicable use requirements, or limitations of said use, set forth in the La Quinta Municipal Code. This order shall remain in effect until terminated or amended by subsequent order from the City Manager. This Executive Order is issued because a Local Emergency, as defined in Section 2.20.020 of the La Quinta Municipal Code, has been proclaimed by the City Council of the City of La Quinta to exist due to the threat of the existence and spread of novel coronavirus disease 2019 (COVID-19) in and throughout the city. All of the findings set forth in the recitals to Resolution No. EM 2020-001 adopted by the City Council are hereby incorporated by reference into this Executive Order. This Executive Order is issued, pursuant to Sections 3, 5, and 8 of Resolution No. EM 2020-001 and Section 2.20.100, Subsections (A) and (B), of the La Quinta Municipal Code, under which the City Manager has the authority and power to issue executive orders for any matters related to the Local Emergency. This Executive Order is issued in furtherance of the authority and power to address the Local Emergency as provided in the California Emergency Services Act, Chapter 7 (commencing with Section 8550) of Title 2 of the Government Code, and implemented by Chapter 2.20 of the La Quinta Municipal Code. Any violation of this Executive Order may be determined to be a misdemeanor and punishable by a fine or imprisonment, or both, pursuant to Section 8665 of the Government Code, Section 2.20.140 of the La Quinta Municipal Code, and any other state or city law as may be applicable.
