THIS STANDARD DOMESTIC WATER SYSTEM AND SANITATION SYSTEM
INSTALLATION AGREEMENT ("Agreement") is made on this ~~day o(S°\.)..N ,
2 Q;X:)("Effective Date") by and between COACHELLA VALLEY WATER DISTRICT, a piiblic
agency of the State of California ("CVWD") and City of La Quinta, a California municipal
corporation and charter city ("City"), and SILVERROCK PHASE I, LLC, a Delaware limited
liability company ("Developer"). CVWD, City, and Developer are collectively referred to herein
as "Parties" and singularly as "Party."
RECITALS
A. City and Developer are the owners of certain real property located in the
County of Riverside, California legally described on Exhibit "A" and depicted on Exhibit "B"
attached hereto and by this reference incorporated herein ("Developer Property").
B. City intends to contribute bond proceeds in an amount not to exceed the
amount identified and appropriated in the City's Fiscal Year 2018/19 Capital Improvement
Project budget for the construction SilverRock Way and domestic water and sanitation
facilities within SilverRock Way, as more specifically described in that certain Special
Domestic water System, Sanitation System, and Irrigation System Modification Installment
Agreement, by and between the Parties, recorded on September 13, 2019, as Instrument
No. 2019-0359003 in the Official Records of Riverside County, California ("Special
Agreement").
