N OTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the City of La Quinta City Council will hold a
PUBLIC HEARING on September 15, 2020 at 4:00 p.m. in the La Quinta City Hall
Council Chamber, 78495 Calle Tampico, La Quinta, California, on the following item:
APPLICANT: CITY OF LA QUINTA
LOCATION: Assessor Parcel Numbers 600-030-010 (46400 Dune Palms Road)
and 600-030-018
REQUEST: ADOPT AMENDMENTS TO CITY COUNCIL RESOLUTIONS NOS. 2018-
020 and 2019-038, REGARDING 46400 DUNE PALMS ROAD, AND
RESOLUTION NO. 2019-039 FOR ASSESSOR PARCEL NO. 600-030-
018, ALL BEING AMENDMENTS TO PREVIOUSLY PASSED
RESOLUTIONS OF NECESSITY FOR THE ACQUISITION BY EMINENT
DOMAIN PROPERTY INTERESTS LOCATED IN LA QUINTA, RIVERSIDE
COUNTY, CALIFORNIA, FOR THE DUNE PALMS ROAD WIDENING
PROJECT, AND THE DUNE PALMS BRIDGE PROJECT
LEGAL: APN 600-030-010; APN 600-030-018
Pursuant to Resolution No. 2018-020, the City of La Quinta (“City”) initiated an
eminent domain action entitled City of La Quinta v. Chin Family Properties Limited
Partnership, RCSC Case No. PSC 1803284, to acquire various rights of way for the
Dune Palms Road Widening Project. On or about September 17, 2019, the City
adopted Resolution No. 2019-038, making public necessity findings for the rights
of way on the same property required for the Dune Palms Bridge Project. Given
the scope of both takings on the same property, and the potential for additional
public uses for the remainder property, the City is now proceeding to amend the
resolution of necessity for the Bridge Project, Resolution No. 2019-038, to expand
the scope of the taking to encompass the entire Site Remainder, outside property
interests encompassed within Resolution 2018-020.
Likewise, the City passed Resolution No. 2019-039 on or about September 17, 2019
regarding the property bearing Assessor Parcel No. 600-030-018, to acquire rights
of way in connection with the Dune Palms Bridge Project. The City now proposes
to amend that resolution, to clarify various descriptions of Project improvements
and impacts.
California Code of Civil Procedure Section 1240.030 provides that the power of
eminent domain may be exercised to acquire property for a proposed public project
if the following conditions are established: (A) The public interest and necessity
require the project; (B) The project is planned or located in the manner that will be
most compatible with the greatest public good and the least private injury; (C) The
property sought to be acquired is necessary for the project; (D) The offer required
by Section 7267.2 of the Government Code has been made to the owner of record.
This Notice is sent to inform you that the City Council of the City of La Quinta will
be asked to decide as part of the amendment to Resolutions Nos. 2018-020 and
2019-038 if the above conditions are met concerning the City’s acquisition of the
remaining portions of the property at 46400 Dune Palms Road.
Please take notice that the City Council will consider both these amendments to the
referenced resolutions at a public hearing to be held on September 15, 2020, at
5:00 p.m. in the La Quinta City Hall Council Chamber, 78495 Calle Tampico, La
Quinta, California. Any person may submit written comments on any of the
contemplated actions listed above to the City Clerk prior to the Hearing and/or may
appear and be heard in support of, or opposition to, the proposed amendments to
the resolutions at the time of the Hearing.
Please be advised if you challenge the decision of any of the actions listed above in
court, you may be limited to raising only those issues that you or someone else
raised either at the Public Hearing or in written correspondence delivered to the
City Clerk, at, or prior to the Public Hearing. The applicable supporting document
files may be viewed by the public Monday through Friday 8:00 a.m. to 5:00 p.m.,

In the City's efforts to comply with the requirements of Title II of the Americans
