EXECUTIVE SUMMARY The La Quinta Housing Authority (‘‘Authority’’) acquired property in 2012 when the La Quinta Redevelopment Agency was dissolved (Exhibit A of the attached Resolution). A portion was purchased with low- and moderate- income housing funds with the remainder being purchased with unrestricted funds (Exhibit B of the attached Resolution). Through this resolution, the Authority would exchange affordable housing property with comparable City-owned property (Exhibit C of the attached Resolution). This transfer will facilitate the construction of new single-family affordable housing and an arts and education center in the Village. FISCAL IMPACT - None. BACKGROUND/ANALYSIS The Authority property is located on Avenida Montezuma at Avenida Navarro is 1.16 acres. Previously, this property was two parcels; one was purchased with affordable housing funds and the other with non-housing funds, which did not carry affordable housing restrictions. The parcels were merged and transferred to the Authority when the La Quinta Redevelopment Agency was dissolved. Going forward, only the parcel purchased with affordable housing funds is required to continue to serve as affordable housing property, and would be exchanged for City property to facilitate the development of affordable housing. HA 2015 – A RESOLUTION OF THE LA QUINTA HOUSING AUTHORITY AUTHORIZING THE EXECUTIVE DIRECTOR TO TRANSFER CERTAIN REAL PROPERTY TO THE CITY OF LA QUINTA, TO ACCEPT CERTAIN REAL PROPERTY FROM THE CITY OF LA QUINTA, AND PROCESSING OF DOCUMENTATION REGARDING THE CONVEYANCES WHEREAS, the La Quinta Housing Authority (the “Authority”) is a public body, corporate and politic, organized and existing under the California Housing Authorities Law (California Health and Safety Code Section 34200 et seq.); and WHEREAS, the City of La Quinta is a municipal corporation and charter city under the Constitution of the State of California (“City”); and WHEREAS, pursuant to California Health and Safety Code Section 34315, the Authority has the power to sell, lease, exchange, transfer, assign, pledge, or dispose of any real or personal property or any interest in it; and WHEREAS, the Authority acquired certain real property in 2012, which is described in Exhibit A to this Resolution and incorporated herein by this reference (the “Property”), and a portion of that property was purchased with former La Quinta Redevelopment Agency Low and Moderate Income Housing Funds, which is described in Exhibit B to this Resolution and incorporated herein by this reference (the “Real Property’s Affordable Housing Portion”), and the remainder of the Property was purchased with unrestricted funds; and WHEREAS, a comparable City-owned site is available for the Real Property’s Affordable Housing Portion that may serve as a location for future housing, which is described in Exhibit C to this Resolution and incorporated herein by this reference (the “New Housing Property”); and WHEREAS, the Authority has appraisals of the current fair market value of comparable properties that reflect the fair market value of the Property; and WHEREAS, the Authority now desires to authorize its Executive Director to transfer ownership of the Property to the City and to accept the New Housing Property to be vested in the name of the Authority to accommodate the Real Property’s Affordable Housing Portion; and WHEREAS, this Resolution has been reviewed with respect to applicability of the California Environmental Quality Act (“CEQA”), the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et 7 Resolution No. HA 2015 – Real Property Transfer between City of La Quinta and Housing Authority Adopted: December 1, 2015 Page 2 of 7 seq., hereafter the “State CEQA Guidelines”), and the City’s environmental guidelines; and WHEREAS, pursuant to Section 15301 of the State CEQA Guidelines, the transfer of Real Property’s Affordable Housing Portion is exempt from environmental review under CEQA because the transfer will result in a continuation of an existing facility involving no expansion of use and is therefore exempt from environmental review, and any future development of the real property will require separate environmental review; and WHEREAS, all of the prerequisites with respect to the approval of this Resolution have been met. NOW, THEREFORE, BE IT RESOLVED by the La Quinta Housing Authority of the City of La Quinta, California, as follows: SECTION 1. The foregoing recitals are true and correct and are incorporated herein by this reference. SECTION 2. The governing body of the Authority hereby authorizes the processing of documentation transferring its ownership of the Property to the City and accepting from the City ownership of the New Housing Property to accommodate the Real Property’s Affordable Housing Portion. SECTION 3. The Executive Director, or designee, is hereby authorized and directed to take such other and further actions, and execute such other and further documents, as are necessary and proper in order to implement this Resolution on behalf of the Authority. SECTION 4. This Resolution shall take effect upon the date of its adoption.
