MUP 2021-0002 Recycling Center at Costco (05.27.21) SENT VIA EMAIL May 27, 2021 Artashes Balyan 13027 Victory Blvd #715 North Hollywood, CA 91401 artashbalyan@yahoo.com SUBJECT: APPROVAL LETTER- MUP 2021-0002 RECYCLING CENTER AT COSTCO Dear Mr. Balyan: The City of La Quinta Design and Development Department has reviewed and approved Minor Use Permit 2021-0002 for a Recycling Facility located at 7995 Highway 111, in an existing parking lot in the Costco Shopping Center. The following findings can be made as required by the La Quinta Municipal Code Sections 9.100.190 Recycling Collection Facilities and 9.210.025 Minor Use Permits: 1. Consistency with the General Plan: The land use is consistent with the general plan. The proposal does not alter the approved land use for the property or affect land use on surrounding similar properties. The Recycling Facility provides a local service that meets the needs of the residents. It is consistent with the general plan goals and policies regarding balanced and varied economic base with a range of businesses and providing a broad range of goods and services to the community. 2. Consistency with Zoning Code: The proposed use is consistent with the provisions of the Commercial Park zoning designation and requirements of La Quinta Municipal Code Section 9.100.190 Recycling Collection Facilities. The facility shall be screened from public view and the property shall be maintained free of odor, litter, and other nuisances. The intent of the recycling is to collect nonhazardous recyclable materials which are then packaged for bulk transport. 3. Compliance with CEQA: Processing of this Minor Use Permit complies with the provisions of the California Environmental Quality Act. The Design and Development Department has determined that this project is exempt from environmental review pursuant to Section 15303 (Class 3) of the California Environmental Quality Act for new construction or conversion of small structures since the recycling facility contains a small footprint. 4. Surrounding Uses: Approval of the application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity in that this is a commercial operation located within a commercial area. The location is appropriate for the proposed use. The Minor Use Permit is subject to the following conditions of approval: 1. The applicant/property owner agrees to defend, indemnify, and hold harmless the City of La Quinta (the “City”), its agents, officers and employees from any claim, or litigation arising out of the City’s approval of this project. This indemnification shall include any award toward attorney’s fees. The City of La Quinta shall have the right to select its defense counsel in its sole discretion. The City of La Quinta shall promptly notify the applicant of any claim, action, or proceeding and shall cooperate fully in the defense. 2. Per La Quinta Municipal Code (LQMC) Section 9.200.130, the use permit may be modified or revoked by the Design and Development Director, City Council, or Planning Commission, should they determine that the proposed uses or conditions under which it is being operated or maintained is detrimental to the public health, welfare, or materially injurious to property, or improvements in the vicinity, or if the property is operated or maintained, so as to constitute a public nuisance. Applicant shall secure approval of building permit for installation of the recycling facility. 3. The recycling facility shall be maintained free of odor, litter and other nuisances at all times. 4. No reprocessing or recycling of materials into new products shall be permitted on site. BUILDING DIVISION 5. Applicant shall secure approval of building permit prior to installation of the recycling facility (Building Permit Application BOTH2021-0004). PARKING/CIRCULATION 6. All required off-street parking spaces shall be designed, located, constructed and maintained so as to be fully usable and accessible at all times. All off- street parking spaces shall be clearly marked with white or yellow paint or other easily distinguished material with each space marking consisting of a double four-inch-wide hairpin stripe, twelve inches on-center. 7. Accessibility compliance requirement shall be shown on BOTH2021-0004 plans. 8. Landscaping shall be properly maintained and trimmed to provide adequate site distance near drive aisles. MISCELLANEOUS 9. The applicant shall obtain and secure a city business license prior to operation. 10. Hours of operation shall occur only on the days and times specified in the Statement of Operations found in the Plan Set provided to the City by the applicant and on file. Changes to these hours that do not conflict with normal business hours may be approved by the Design and Development Director. 11. The City of La Quinta reserves the right to review and monitor the operation of this facility and modify Conditions of Approval regarding hours of operation, occupancy, and other operational conditions. This decision may be appealed to the Planning Commission by any party who submits the necessary paperwork and filing fee of $1,526.00 to this office within 15 days of the date of approval of this permit.
