MUP 2021-0009 Andalusia Sales and Design Center (07.28.21) July 28, 2021 Nolan Sparks National Mortgage and Land Co 81570 Carboneras La Quinta, CA 92253 SUBJECT: MINOR USE PERMIT 2021-0009 ANDALUSIA SALES AND DESIGN CENTER Dear Mr. Sparks: The City of La Quinta Design and Development Department has reviewed and approved Minor Use Permit 2021-0009, for a Sales and Design Center site on Lots 42 and 43 within the Andalusia Development, subject to the information on file and attached and the following conditions of approval: Planning 1. The applicant/property owner agrees to defend, indemnify, and hold harmless the City of La Quinta (the “City”), its agents, officers and employees from any claim, or litigation arising out of the City’s approval of this project. This indemnification shall include any award toward attorney’s fees. The City of La Quinta shall have the right to select its defense counsel in its sole discretion. The City of La Quinta shall promptly notify the applicant of any claim, action, or proceeding and shall cooperate fully in the defense. 2. Per La Quinta Municipal Code (LQMC) Section 9.200.130, the use permit may be modified or revoked by the Design and Development Director, City Council, or Planning Commission, should they determine that the proposed uses or conditions under which it is being operated or maintained is detrimental to the public health, welfare, or materially injurious to property, or improvements in the vicinity, or if the property is operated or maintained, so as to constitute a public nuisance. 3. The sales and design center site shall be permitted to remain for two (2) years, beginning from the date of this approval, unless a time extension is applied for and granted by this Department. The Design and Development Director may extend the permit for up to one year, upon written request from the property owner. No fee will be charged to extend this permit. 4. Applicant shall secure approval of precise grading and building permit for construction of the Sales and Design Center site. 5. The following advertising devices or activities are expressly prohibited within or outside the project: banners, balloons, portable trailer signs, or human indicators/sign twirlers. Permitted signage can be found in LQMC Section 9.60.240. Fire 6. Fire Department Access: Provide a site plan for fire apparatus access roads and signage. Access roads shall be provided to within 150 feet to all portions of all buildings and shall have an unobstructed width of not less than 20-feet exclusive of curb-side parking, bike lanes and other roadway features. The construction of the access roads shall be all weather and capable of sustaining 40,000 lbs. over two axles for areas of residential development and 60,000 lbs. over two axels for commercial developments. Ref. CFC 503.1.1 and 503.2.1 as amended by the City of La Quinta. a. Fire Lane marking: Identification and marking of fire lanes, including curb details and signage shall be in compliance with Riverside County Fire Department Standards. 7. Requests for installation of traffic calming designs/devices on fire apparatus access roads shall be submitted and approved by the Office of the Fire Marshal. Ref. CFC 503.4.1 8. Construction Permits Fire Department Review: Submittal of construction plans to the Office of the Fire Marshal for development, construction, installation and operational use permitting will be required. Final fire and life safety conditions will be addressed when the Office of the Fire Marshal reviews these plans. These conditions will be based on occupancy, use, California Building Code (CBC), California Fire Code, and related codes, which are in effect at the time of building plan submittal. 9. Fire Sprinklers System: All new commercial structures 3,600 square feet or larger will be required to install a fire sprinkler system. Ref. CFC 903.2 as amended by the City of La Quinta. 10. Fire Alarm and Detection System: A water flow monitoring system and/or fire alarm system may be required and determined at time of building plan review. Ref. CFC 903.4, CFC 907.2 and NFPA 72 11. Knox Box and Gate Access: Buildings shall be provided with a Knox Box. The Knox Box shall be installed in an accessible location approved by the Office of the Fire Marshal. All electronically operated gates shall be provided with Knox key switches and automatic sensors for access. Ref. CFC 506.1 12. Addressing: All commercial buildings shall display street numbers in a prominent location on the address side and additional locations as required. Ref. The Installer shall keep the site work area(s) clear of unnecessary debris; and shall keep all work area(s) secured when unattended for the duration of the installation period. 19. The Installer shall clean the site of all unnecessary debris and clean all glass, chrome, and any other items before vacating the site and final Owner sign-o. 20. Wiring and Conduit is to be concealed in both new and existing partitions with all outlets, switches, and similar devices mounted in recessed junction boxes with flush cover plates. Surface mounted conduit, wiremold, outlets, etc. will not be permitted. Demolition, Cutting and Patching 1. The Contractor is responsible for all demolition, cutting and patching required to facilitate new finishes by Contractor or others. 2. Unless noted otherwise, all demolished debris, material, equipment, and fixtures become the property of the Contractor who is responsible for its safe removal from the site. Disposal of demolished material shall be in accordance with applicable rules, regulations and ordinances of authorities having jurisdiction over this project. Carefully remove materials, equipment, and fixtures designated for re-use or salvage and deliver them to the appropriate party. 3. Prior to starting work, erect temporary barriers around the permitter of the project to prevent the spread of dust and other contaminants to adjacent areas of the building. Maintain dust proof barriers throughout the course of construction or until no longer required. Remove barriers and repair any damage caused by their installation to match adjacent surfaces. 5. Maintain the function and integrity of rated partitions and other fire rated assemblies. Repair or replace damaged portions with new construction to match existing and have repair work approved by the Building Inspector. 6. Maintain the function and integrity of existing fire, life safety and security systems during demolition and construction. 7. New pipe, conduit, and duct penetrations of fire rated assemblies are to be constructed in accordance with an underwriters laboratory tested design. such work. Changes which modify the contract amount must have the approval of Vertical Design and Owner before commencement of such work. 9. All graphics and colors provided must conform to scale, specifications, and PMS numbers where provided. 10. All work shall be done in accordance with all applicable codes and to the highest standards of trade practice. 11. Prior to commencing any work, the Fabricator or Installer who is awarded all or part of fabrication and/or installation shall review with the Owner, Architect, and Vertical Design the phasing of their work and secure approval from all parties. Submit to the Architect and Vertical Design a master schedule of the awarded work one (1) week after the contract signing. 12. All interior finish and trim materials are to meet Class III flame spread ratings of 76 to 200, or per applicable code. 13. Fabricator and Installer are responsible for obtaining and paying for all applicable permits and certificates required of their work. 14. The Fabricator shall warrant that all merchandise is free of defects in material or workmanship and shall provide Owner with a written warranty to replace or repair any merchandise that fails to conform to above for a period of no less than one (1) year from date of final acceptance. 15. The Installer shall provide and install adequate blocking for all wall hung and wall supported items except for those items which are hung from items not in contract. 16. The Installer shall patch and repair all existing surfaces as required of work prior to applying new finishes. All openings, voids, or unfinished surfaces created by removal or alteration of existing work, shall be closed or patched and finished as necessary to match existing continuous surfaces or new finishes required. 17. All hangers, channels, rods and other misc. support steel shall be installed by the installer as necessary for the support of suspended equipment (signage) and shall be fastened to the existing structure in such a manner as to not compromise its existing structural integrity or fire rating. General Notes Note: The terms Fabricator, Contractor and Installer apply to any entity who performs or is awarded all or part of these functions to conform to the design documents, for this project. In some instances these terms may apply to the same entity. General Notes for Fabrication and Installation of this Project 1. Do not scale the drawings. 2. The contract documents are complementary, and what is required by one shall be as binding as if required by all. The Fabricator and Installer shall coordinate all required portions of work in contract scope. 3. Fabricator shall conform to these drawings and specifications and submit to Vertical Design samples for all finishes included in their scope of work before commencement of such work. 4. For the purpose of bidding process, proprietary names identifying items of work are used solely to describe the standard of the product or the color of the finish, unless the items of work are explicitly noted as not having an equal. Fabricator shall secure approval of any substitutions from Vertical Design. Any items approved for substitution should be submitted to Vertical Design for final approval. 5. All dimensions are to the exterior face of the finished material unless otherwise noted. All elevations are noted from finish floor elevations. Unless shown otherwise, position all doors 4” min from outside face of jamb to wall. 6. All dimensions of existing work and all dimensions required for work that is connected with work in place shall be verified by the Fabricator and Installer. In addition, the Fabricator shall verify all finishes and notify Vertical Design of any discrepancies before performing any work. 7. The Fabricator or Installer shall notify Vertical Design of any discrepancies in the fabrication documents immediately and shall not proceed or allow sub-fabricators to work in those areas until said discrepancies are resolved. 8. When changes are required, for any reason, notify Vertical Design before performing any work. Changes which alter the contract documents must have the approval of Vertical Design before commencement of Qualifiers All ideas, design arrangements, or plans indicated or represented by these drawings are owned by, and remain the sole property of Vertical Design.
