TUP 2021-0003 Lowes Christmas Tree Lot (11.19.21) November 19, 2021 Alexis Kaiser Lowes Home Improvement LLC 78865 Highway 111 La Quinta, CA 92253 SUBJECT: TEMPORARY USE PERMIT 2021-0003 LOWES CHRISTMAS TREE LOT Dear Ms. Kaiser: The Design and Development Department has reviewed and approved your request to establish a temporary Christmas tree sales lot within the Lowes parking lot. The approval of the event is granted under Section 9.100.080 of the La Quinta Municipal Code subject to the following Conditions of Approval: 1. The Christmas tree sales lot shall not be in operation before the Thanksgiving holiday (November 25, 2021) and shall be removed and the premises cleared of all debris and restored to pre-event conditions no later than January 8, 2022. Specifically, the event may be open on the following dates: November 25, 2021 – January 8, 2022; Monday through Sunday, between the hours of 7:00 a.m. and 8:00 p.m. Event setup may begin no sooner than November 20, 2021. 2. The location of the event is limited to the Lowes parking lot, per the attached site plan. Traffic aisles shall not be blocked. 3. Applicant shall provide final payment for all permits, including this one, prior to any set up and/or operation. 4. Applicant shall comply with Conditions of Approval attached from Riverside County Fire. 5. The facility shall not engage in the sale of any merchandise not directly associated with Christmas trees and Christmas decorations. 6. The applicant shall comply with all regulations and conditions from building permit BSPN2021-0030 and BELC2021-0147. 7. A temporary fence surrounding the Christmas tree lot is permitted. The proposed fence shall be constructed of chain link fencing material and shall not exceed a height of six (6) feet. No other temporary structures are proposed or permitted as part of this permit. 8. Temporary lighting shall not be directed towards surrounding properties. All temporary lighting shall conform to the City’s Outdoor Lighting Ordinance; Section 9.100.150 of the City’s Municipal Code. 9. If portable generators are used for electricity, they shall be shielded to prevent accidental contact with guests. If extension cords are used, they shall be ground-secured to prevent tripping. Power equipment (i.e. chain saws, etc.) shall not be operated before 7:00 a.m. 10. Roadways, parking areas, and pedestrian traffic aisles outside the proposed area shall be maintained accessible at all times. 11. Signs shall be restricted to one banner sign per street frontage, each sign not exceeding thirty-two square feet. Banners may be placed on the temporary fence or adjacent within the parking area, but not on Highway 111. Other signs and advertising devices such as pennants, flags, A-frame signs, are prohibited. 12. Adequate trash receptacles shall be provided. 13. A security guard is permitted on-site if needed during the operations of the Christmas tree sales lot. No overnight camping, either in tents or vehicles, is permitted as part of this permit. 14. By holding this Christmas tree sale, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City’s approval of this project. The City of La Quinta shall have the right to select its defense counsel at its sole discretion Adherence to these conditions, as outlined, will ensure that adverse impacts to surrounding properties and businesses will be minimized. Future submittals SHALL be submitted well in advance to allow time for adequate review and response to initial comments or corrections. Scaled site plans of the affected area shall be required and a clear description of use or activities.) (PENDING ENGINEERING FOR SEPARATE PERMIT APPLICATIONS SUBMITTAL AND APPROVAL) • EXTINGUISHERS - At least one 2A10BC fire extinguisher, with a current service tag (within one year), shall be provided within every 75 feet of travel distance. • EXIT SIGNS AND EGRESS LIGHTING - Tents with side walls shall have illuminated exit signs and means of egress lighting pursuant to CFC Chapter 31 when the tent has an occupant load of 50 or more. • NO SMOKING - Smoking shall not be permitted in any tent or canopy or in any adjacent area where hay, sawdust or any other combustible materials are stored. NO SMOKING signs shall be conspicuously posted in all tents and canopies open to the public. • OBSTRUCTING EXITS - Furnishings, decorations or other objects shall not be placed so as to obstruct exits, access thereto, egress therefrom, or visibility thereof. Hangings and draperies shall not be placed over exit doors or otherwise be located to conceal or obstruct an exit. • DECORATIVE MATERIALS - Curtains, draperies, hangings and other decorative materials suspended from walls or ceilings shall meet the flame propagation performance criteria of CCR Title 19 in accordance with section 807.2 or be non-combustible, when the tent has an occupant load of 50 or more. Ref CFC 807.1 • HIGH-WIND EVACUATION PLAN - The tent supplier and event coordinator shall understand that the use of the tent or canopy in winds at 40 mph or greater is not permitted. Event coordinator is responsible to take necessary actions to stop occupancy and use of the tent or canopy when winds of 40 mph or greater are observed or expected. FLOCKING AND FLAME RETARDANCY: All trees sold for commercial use to businesses, schools, churches, or health care facilities shall be flame retarded and bear a tag with the information of when it was treated and what material was used during the treatment. Provide a copy of the CA State Fire Marshal registration of you or your company being recognized as a Limited Applicator. Flocking shall be done with non-flammable materials. The flocking area shall be noted on the site plan. FIRE SAFETY INSPECTION: All tree lots will be required to have a fire safety inspection.
