Yuba [Space above this line for Recorder's Use] D.T.T 40; Lease term is less than 35 years No prior recordings MEMORANDUM OF LAND LEASE AGREEMENT This Memorandum of Land Lease Agreement ("Memorandum") is made this 24 1vtday of 2018, between the City of La Quinta, a California charter city and municipal corporation, hereinafter referred to as "LESSOR," and Los Angeles SMSA Limited Partnership; dba Verizon Wireless, hereinafter referred to as "LESSEE." LESSOR ud LESSEE entered into a Land Lease Agreement (the "Agreement") on �� 2018, for an initial term of five (5) years, commencing on the Commencement Date, as described below. The Agreement shall automatically be extended for four (4) extension terms of five (5) years each, unless LESSEE terminates it at the end of the then current term by giving LESSOR written notice of the intent to terminate at least ninety (90) days prior to the end of the then current term. 2. LESSOR is the owner of that certain parcel of property located at 78106 Francis Hack Lane, City of La Quinta, California, APN 775-184-011, legally described on Exhibit "A," attached hereto and made a part hereof, and informally known as the "Fritz Burns Park'(the entirety of LESSOR's property is referred to hereinafter as the "Property"). ' LESSOR leased to LESSEE a portion of the Property described as the "Premises" in the Agreement, which, along with a non-exclusive license to use a non-exclusive parking space, is depicted in Exhibit `B," attached hereto and made a part hereof. LESSEE's rights of use for the Premises are more particularly described in the Agreement. 3. The Commencement Date of the Agreement will be (i) the first day. of the month in which LESSEE commences installation of equipment at the Property, (ii) the first day of the month in which LESSEE is granted a building permit by the governmental agency charged with issuing such permits, or (iii) ninety (90) days from the date on which the Agreement is executed by both parties, whichever occurs first. 4. The terms, covenants and provisions of the Agreement, the terms of which are hereby incorporated by reference into this Memorandum, shall extend to and be binding upon the respective executors, administrators, heirs, successors and assigns of LESSOR and LESSEE.
