CASTRO, JR. This Amendment No. 1 (“Amendment 1”) to At Will Employment Agreement ("Agreement”) is made and entered into as of the ___ day of February 2022, ("Effective Date") by and between the CITY OF LA QUINTA ("City"), a California municipal corporation and DELFIN P. CASTRO, JR. (the “Employee”). RECITALS WHEREAS, on or about July 30, 2018, the City and Employee entered into an Agreement to employ the services of said Employee as the Design & Development Director to perform the functions and duties specified in the City of La Quinta Director Class Specification assigned to Design & Development and as provided by s tate or federal law, and to perform other legally permissible and proper duties and functions as the City Manager shall from time to time assign; and WHEREAS, the City and Employee mutually desire to amend the Agreement to define the Employee’s Annual Performance Review date; and WHEREAS, Section 6B shall be amended to define the Employee’s Annual Performance Review date as March 15 commencing on March 15, 2022 and continuing on March 15 every year thereafter for purposes of annual performance review and salary evaluation. NOW THEREFORE, in consideration of the mutual covenant herein contained, the parties agree as follows: AMENDMENT In consideration of the foregoing Recitals and the covenants and promises hereinafter contained, and for good and valuable consideration, the sufficiency and receipt of which are hereby acknowledged, the parties hereto agree as follows: 1.Section 6B is amended to read as follows: Section 6B – Salary. An annual performance and salary evaluation shall be conducted on March 15 and each year thereafter. All performance and salary evaluations shall be conducted in accordance with the City’s Personnel Rules. During the annual performance and salary evaluation, the City manager and the Employee shall develop performance-based metrics upon which the Employee’s performance and compensation adjustments shall be based.
