Pursuant to LQMC Section 9.100.130 (Special Events – Nonresidential), your permit is approved based on the following Findings: A. The event will not be detrimental to the health, safety and general welfare of the community in the area of the proposed event. B. There is adequate area to conduct the event and to accommodate the anticipated attendance. C. Sufficient parking will be provided for the anticipated attendance. D. Food service operations, medical facilities, solid waste facilities, sewage disposal methods and potable water service have been provided. E. Fire protection plans and facilities have been provided to the satisfaction of the fire marshal. F. Security plans, including security staffing levels, and facilities have been provided to the satisfaction of the La Quinta Police Department, per separate agreements with the Riverside County Sheriff’s Department. G. Public roadways providing access to the event are capable of accommodating the anticipated traffic volumes in a reasonable and safe manner with minimal disruption to local traffic circulation. 2 CONDITIONS OF APPROVAL Completion/confirmation prior to start of the event: 1. The applicant shall obtain all other applicable permits, if required, from the appropriate agencies (i.e. Fire Department, Building Department, Police Department, Alcohol Beverage Control, etc.). This includes applicable permits and contracts secured from City of Indian Wells, City of Indio, Riverside County Sherriff’s Department, County of Riverside, and California Highway Patrol. 2. Applicant shall adhere to Encroachment Permit 2022-0044 (ENC2022-0044), and all conditions as part of that. 3. All vendors conducting business in the City of La Quinta shall obtain a City Business License prior to each event. 4. CMS signs shall warn traffic of the event and applicant shall coordinate with La Quinta TMC beforehand to monitor and adjust timings at signal if needed. 5. Applicant shall secure approvals from other cities that event is running through and adhere to those approvals (City of Indian Wells and City of Indio). 6. The Design and Development Director may modify Conditions of Approval regarding operational conditions should it be determined, the proposed uses or conditions under which the events are being operated or maintained is detrimental to the public health, welfare, or materially injurious to property, improvements or other uses in proximity to the subject property, or if the subject property is operated or maintained so as to constitute a public nuisance. Completion/confirmation during the event: 7. The set-up and operation of the events shall be consistent with the attached exhibits and event information on file. 8. The event will not be detrimental to the health, safety and general welfare of the community in the area of the proposed event. 9. Security and volunteer personnel shall be easily identifiable to the public by the provision of uniformed personnel. Any designated private security personnel must be licensed by the State of California and possess a valid private security license. 10. Certain areas providing access to the event area are public and, as such, general public access may not be denied or restricted in any manner that extends beyond the limits of this event as approved. 3 11. The applicant shall conform to the City’s Noise Ordinance (Municipal Code Section 9.100.210) and specifically the following noise limitations during the event: Before 10:00pm: Sixty-five decibels (65 dB(A)) After 10:00pm: Fifty decibels (50 dB(A)) If the noise consists entirely of impact noise, speech or music, or any combination thereof, each of the noise levels specific above shall be reduced by five dB(A). 12. Surrounding roadways and intersections shall remain readily accessible for passage of emergency response vehicles and private vehicles. 13. The event is subject to spot inspections by the Police Department and/or City staff to ensure compliance with the conditions of this letter. Completion/confirmation after the conclusion of the event (if necessary): 14. The event route and any sites used shall be left clean and in its original manner after the event. Temporary trash receptacles shall be provided in and around the event areas. All event areas shall be left free of debris at the end of each day’s activities, and after the event concludes. 15. All signage shall be removed after event, or each sign is subject to a $50.00 fine. Removal of signs shall happen by end of day December 6, 2021. The City of La Quinta Police department reserves the right to bill the event sponsor for any lost police time, equipment, and/or any unforeseen loss that may occur due to the event that requires police action. 17. Any damage to public hardscape caused by this event shall be repaired as directed by the City Engineer. This includes but is not limited to sidewalks, curb and gutter, landscaping, and pavement especially within the surrounding public streets. FINAL ACKNOWLEDGEMENT/CONTACT INFORMATION By holding this outdoor event, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta (“the City”), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this temporary use permit. The City of La Quinta shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or preceding and shall cooperate fully in the defense. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein. The City of La Quinta reserves the right to revoke, suspend or void 4 this permit at any time. This decision may be appealed to the Planning Commission, provided the written appeal and filing fee of $1,505.00 are submitted to this Department within 15 calendar days. PON is staying at the Hyatt Regency Indian Wells for the duration with over 2000 room nights. PON recently acquired Schwinn bikes and will be celebrating their acquisition along with Management training during their visit. PON also purchased Indigo Auto Group Bike Tour The following information is to provide a clear and concise presentation of our plan to execute an e-Bike tour from the Hyatt IW to Empire Polo Club. No food or alcohol will be served/sold during this event. The Hyatt and Riverside Sheriffs will be providing Security during the staging and departure of the procession. I have known Brad and his family for over 30 years and their attention to detail and professionalism is unequaled. I have spent over 25 years organizing guide bicycle, hiking and jeep tours throughout the Coachella Valley and after looking at Brad's initial timeframe and plan for this event I believe he has succeeded in meeting two goals....creating the least impact on our local residents while providing the safest and most memorable experience for his guests. This group is gathering from all over the world and I can think of no better way to give them an experience in our incredible destination that will provide a lifelong memory. Pon in a 100% family owned organization that is based out of The Netherlands and operates in 32 countries with over 16,000 employees. Pon’s core business is mobility and although the name Pon is hardly ever communicated its brands are known to most. As world’s largest bicycle manufacturer Pon owns the strongest (U.S.) brands in the industry, examples are Schwinn, Mongoose, Cannondale, Cervelo and Santa Cruz which are 100% subsidiaries of Pon. In the desert Pon operates under the name of the IndiGO Auto Group, we operate dealerships in Rancho Mirage and Palm Springs focused on high-end European brands. Dealerships such as Audi, Jaguar/Land Rover, Bentley, BMW and Porsche are part of our group. During the Pon Management Days 400 of its managers will arrive in the Desert to learn about and discuss Pon’s Strategy for the coming 5 years. Most of our time here will be spend in a plenary setting at the Hyatt, however there is a need to include fitness in the program as well as showing the (inter)national guests our beautiful area. Considering we are the largest bicycle manufacturer and do need some exercise and fresh air it would only make sense for us to organize a bike tour. It is therefore that we would like to ask your permission to have our participants enjoy a bike ride from the Hyatt to the Polo Fields in Indio. We do not underestimate the organizational challenges and responsibilities that come with a bike ride like this as we have done these before in cities as Boston, Amsterdam and Barcelona.
