MUP 2022-0015 Capistrano Model Home Complex Temp Generator (06.24.2022) June 24, 2022 Mr. Mario Ornelas D R Horton, America’s Builder 2280 Wardlow Circle Suite 100 Corona, CA 92880 SUBJECT: MINOR USE PERMIT 2022-0015: AMENDMENT TO MUP2021-0021 FOR TEMPORARY GENERATOR AT CAPISTRANO MODEL HOME COMPLEX AND SALES OFFICE Dear Mr. Ornelas: The City of La Quinta Design and Development Department has reviewed and approved Minor Use Permit (MUP) 2022-0015, an amendment to MUP2021-0021, for a temporary generator to power the sales office and model home complex within the Capistrano development, subject to the information on file and attached and the following findings and conditions of approval. The approval of this Minor Use Permit amendment does not extend the operational time limit of two (2) years as set forth in MUP2021-0021. FINDINGS • The proposal is consistent with the general plan and provisions of the zoning code. The proposal is in compliance with the requirements of the California Environmental Quality Act (CEQA) and would be exempt from CEQA pursuant to Section 15304, Minor Alterations to Land. • The proposal would not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. • The proposed use of the generator is temporary in nature and would be placed in an area consistent with ground mounted equipment in residential areas. The generator is located approximately 150 ft away from the nearest residence and is estimated to generate noise levels under the exterior noise level limits in the Noise section of the zoning code. CONDITIONS OF APPROVAL: 1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta (“City”), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Minor Use Permit amendment. The City shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or proceeding and shall cooperate fully in the defense. 2. Minor Use Permit 2022-0015 shall comply with all applicable conditions and/or mitigation measures for the following related approval: Minor Use Permit 2021-0021 In the event of any conflict(s) between approval conditions and/or provisions of these approvals, the Design and Development Director shall adjudicate the conflict by determining the precedence. 3. The temporary generator may be used until Imperial Irrigation District provides power to the site or up to 60 days, whichever comes first. The generator must be removed within 7 days of either occurrence. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein. This decision may be appealed to the Planning Commission by any party who submits the necessary paperwork and filing fee of $1,526.00 to this office within 15 days of the date of approval of this permit.
