MUP 2022-0005 Madison St 54001 Modification to T-Mobile Telecommunication Facility (07.14.2022) July 14, 2022 Paulina Mendez SBA Communication 959 South Coast Drive, Suite 200 Costa Mesa, CA 92626 SUBJECT: MINOR USE PERMIT 2022-0005: T-MOBILE CELL SITE MODIFICATION 54001 MADISON STREET The Design and Development Department has approved your request to remove (15) antennas and replace with (6) antennas, (6) RRUs, add (1) new microwave dish, (1) new diesel generator and associated equipment, at an existing telecommunication facility located at 54-001 Madison Street. Approval of this application is subject to the attached exhibits for the Minor Use Permit and the following Findings and Conditions of Approval per La Quinta Municipal Code (LQMC) Sections 9.210.025 (F) and 9.170.090 (A-E): FINDINGS 1. Consistency with the General Plan: The proposed equipment at the existing telecommunication facility is consistent with the goals, objectives and policies of the General Plan, in that the proposed equipment is intended to enhance community access to quality wireless communication services. 2. Consistency with Zoning Code: The proposed new equipment at the existing telecommunication facility will not create new adverse visual impacts. No change to the height of the antenna location or general configuration is proposed. The associated equipment will be placed entirely within the existing equipment cabinet. The Minor Use Permit is consistent with the provisions of LQMC Section 9.210.025 “Minor Use Permits” and Chapter 9.170 “Wireless Telecommunication Facilities”. 3. Compliance with CEQA. Processing and approval of the permit application are in compliance with the requirements of the California Environmental Quality Act. The Minor Use Permit is exempt from the California Environmental Quality Act (CEQA), pursuant to Section 15301, Existing Facilities. 4. Surrounding Uses: Approval of the application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. CONDITIONS 1. The applicant/property owner agrees to defend, indemnify, and hold harmless the City of La Quinta (the “City”), its agents, officers and employees from any claim, or litigation arising out of the City’s approval of this project. This indemnification shall include any award toward attorney’s fees. The City of La Quinta shall have the right to select its defense counsel in its sole discretion. The City of La Quinta shall promptly notify the applicant of any claim, action, or proceeding and shall cooperate fully in the defense. 2. The applicant shall comply with all provisions of La Quinta Municipal Code Section 9.170 “Wireless Telecommunication Facilities”. 3. The applicant shall comply with any applicable provisions contained in Conditions of Approval for Conditional Use Permit CUP2004-085 and CUP2004-085, Amendment No. 1. 4. The applicant is permitted to install and remove the equipment identified on the scope of work on the approved and attached plans for MUP2022-0005. All new and replacement equipment shall be painted to match the color on the array. Applicant is also permitted to install all other related equipment within existing equipment cabinets located in the lease area. All missing and damaged palm fronds shall be replaced. 5. The applicant shall obtain all necessary building permits from the City’s Building Division and is responsible for meeting all applicable plan check submittal requirements. Plans submitted for building permit plan check shall include an accurate vicinity map. This decision may be appealed to the Planning Commission by any party who submits the necessary paperwork and filing fee of $1,526.00 to this office within 15 days of the date of approval of this permit.
