Crown Castle contends that the above -referenced conditional use permit ("CUP") application —
CUP 2011-138 — is governed by: In the Matter of Petition for Declaratory Ruling to Clarify
Provisions of Section 332(c)(7)(B) to Ensure Timely Siting Review and to Preempt Under Section
253 State and Local Ordinances that Classify All Wireless Siting Proposals as Requiring a
Variance, FCC Order 09-99 (Nov. 18, 2009) (FCC Shot Clock Order).
Crown Castle also contends that under the FCC Shot Clock Order, (1) the deadline for City action
on CUP 2011-138 was May 27, 2013, and (2) Crown Castle's deadline for filing an action based on
the alleged expiration of the Shot Clock is June 26, 2013.
The CUP application was considered by the Planning Commission of the City of La Quinta on May
14, 2013. At that hearing, several residents voiced concern with the design and location of the
proposed node and in a unanimous vote, the Planning Commission decided to continue the matter
to allow Crown Castle more time to develop suitable alternatives.
To allow the additional time to address the Planning Commission's concems, Crown Castle is
requesting an approximately 60 day extension of its deadline to take action pursuant to the FCC
Shot Clock Order. The City has indicated it is willing to grant that request, while reserving any
rights it may have to argue that the City has complied with, or is not bound by, the FCC Shot Clock
Order.
Accordingly, by signing below, both parties agree and acknowledge that Crown Castle's deadline
for filing an action pursuant to the FCC Shot Clock Order is extended to August 31, 20013.
