He said there is work Moreno in progress a full blown pool remodel with electrical etc. James stated the owner has had the front of the pool jack hammered out. Definitely requires a permit from Building & Safety per CBC 105.1. I door knocked at metal decorative gate and observed cameras at numerous locations and ring door bell. I announced my presence and no reply. I walked across the street and spoke to gentleman who said he was on the HOA board and they are in litigation with owner Dennis Sodorra. I went back and posted a cease and desist for any remodel, improvement or alteration to existing improvements and for the owner to provide an inspection. A female drove up in a grey Honda ca license 5VNX68. I introduced myself and informed her I left a notice on the gate for the owner and if she can have him call me. She said yes. He said he has a lawsuit with the HOA and it was funny he now has a notice from City. I told Mr. Sadorra I cannot say who reported it, but I can say who did not. I advised the report was not from the HOA in any way. He was kind and cooperative. He agreed to an onsite inspection at his residence on Friday July 17, 2020 at 8:30 a.m. I told him I would be accompanied by a Building Inspector and would have a Consent Form for him to sign for the inspection. I informed her that I went to the house to conduct an inspection due to a report of construction without a permit that could create an electrical safety issue. When I arrived and door knocked no one answered the door. I left a notice requesting a cessation of unpermitted work, a call back, and an inspection. Mr. Sadorra called back as requested and voluntarily agreed to provide an inspection on Friday at 8:30 a.m. I informed him a Building Inspector (Jake Fuson) would accompany me and we would have a Form for him to sign giving us consent to do the inspection out of respect for his private property rights. She was good with the purpose of our inspection and we ended our call. Inspection Anthony 07/17/2020 8:30 am 0.50 1 met with Plans Examiner Jacob Fuson at the exterior of the property. I Moreno updated on how case initiated complaint -driven, and the building without a permit at this time is an allegation. We met with the owner Dennis Sadorra. He greeted us and escorted us to the northern gate. I asked him to sign a Consent to Inspect Form and he did. He escorted us to the rear yard poolside. He showed how the pool had some imperfections at the bottom. He had a pool company acid wash the bottom. He had some paint he showed us and he painted the bottom of the pool and the interior masonry block wall. In our conversation he asked Jacob about his desire to construct a masonry block wall around the perimeter of the residence in the front yard. Jacob stated the Building & Safety Dept would issue a permit as long as the location for the footing would be entirely on the private property. With regards to observed un-permitted construction, these items will require a permit: 1) patio cover attached to the main dwelling; and 2) the window change -out on the north portion of rear yard. A secondary patio cover in the n/e corner of property won't require a permit however will require a 5' minimum clearance of the existing masonry block wall. Meredith was gathering the records to fulfill the request he noticed that Officer Ponder had not attached the Finaled Permit for the two patio covers and window change out as noted in his July 14, 2022 case entry. When Sup. Meredith attempted to get the permit (BPAT2020-0045) from Trakit in order to property attach it to the Code Case and provide it to the requestor, he observed that the permit had not been issued, inspected, finaled or even paid for. The case is being reopened and is not eligible to be provided in a records request until resolved. The City Clerk's office advised. REOPENED/REASSIGNED. I contacted Grace Gower 619-400-8000, she asked how the case came about and I explained the P/O did a records request and that when my supervisor observed the case was closed prematurely and needed to be reopened due to the building code violations of not acquiring permits and a structure in the rear setbacks. I informed the city typically would only deal with building and safety issues in the gated communities and allow the HOA to resolve the property maintenance issues. I informed I cannot not get into further detail and she would need to do a records request as well if she requests more info and explained due to the California Public Records Act, we cannot deliver that records while the case is open. Unless requested by law enforcement or subpoena by court. I emailed Grace Gower a Public Records Request form (ggower@klinedinstlaw.com). See attached. I spoke with P/O Dennis Sadorra 760-880-8416 and informed I have not seen any new permit applications in the system. I asked that he at least apply by 12/6/22 to avoid a citation. I searched on Trak-it and observed new application BRES2022-0881 applied for on 11 /27/22. P/O Dennis Sadorra was emailed from PT Aaron Hickson "Regarding the above permit submittal. This is incomplete and the incorrect permit types. We can keep the permit number above for the window change out. But we will require the CF1 R form to be uploaded to the permit number above for review. For the Flagpole apply for a STRUCTURE OTHER THAN BUILDING (WEB) permit. We will require a site plan, the footing engineering, and HOA approval for review. The patio cover will be a PATIO COVER (WEB) permit. This will also require a site plan. Hello Mr. Villanueva, I understand from a family member that you visited my home today and left your card. I would like to inform you that for the past 4 years I have been harassed by my HOA who agreed to a landscaping plan for me to install, but then 3 weeks into the project the HOA placed a Cease and Desist on the project through their attorney, stopping any and all work on the property. Last month in mediation my attorney asked the HOA to lift the Cease and Desist so I could at least move forward with maintenance and clean up of the property, but they refused. Since the HOA is being stubborn in providing a release from the Cease and Desist order, I am requesting a letter from the City of LaQuinta to allow me to conduct the maintenance work on my property in order to bypass the HOAs Cease and Desist order. I feel the HOA is playing a game in suing me in court while placing a hold on any work on my property while both the neighbors and myself have to suffer watching this eyesore of a property become more and more dilapidated over time. I want to say im enlightened by your comments regarding the city of LQ municiple code really outweighing the HOAs attempt to place a cease and desist and keeping me from any work or maintenance on my property. I am encouraged to move forward and begin cleaning and maintaining the empty lot that is my property. I am a bit concerned though that my patio cover permit was completed, but now has been flagged as incomplete and I will now have to file for another permit. I am also concerned that an existing flag pole and base that has been in front of my property for years will now require a permit. You explained that there is an existing City policy that an existing outstanding permit must be closed before you can release the request for information that I recently asked of the LQ City Clerks office. I request that you please provide that policy number so I may review it.
