MUP 2023-0002 Piazza Serena Model Home Complex Temporary Flags (03.30.2023)ta �W CALIFORNIA March 30, 2023 Ms. Amelia Villegas Fusion Sign and Design 2280 Wardlow Circle Suite 100 Corona, CA 92880 SUBJECT: MINOR USE PERMIT 2023-0002: AMENDMENT TO MUP2022-0008 FOR TEMPORARY FLAGS AT PIAZZA SERENA MODEL HOME COMPLEX Dear Ms. Amelia: The City of La Quinta Design and Development Department has reviewed and approved Minor Use Permit (MUP) 2023-0002, an amendment to MUP2022-0008, for (8) temporary flags located on the perimeter of the Piazza Serena development, subject to the information on file and attached and the following findings and conditions of approval. The approval of this Minor Use Permit amendment does not extend the operational time limit of two (2) years as set forth in M U P2022-0008. • The proposal is consistent with the general plan and provisions of the zoning code. The proposal is in compliance with the requirements of the California Environmental Quality Act (CEQA) and would be exempt from CEQA pursuant to Section 15304, Minor Alterations to Land. • The proposal would not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. • The proposed flag poles are temporary in nature and would be placed in an area that does not block the line of sight. CONDITIONS OF APPROVAL: 1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta ("City"), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Minor Use Permit amendment. The City shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or proceeding and shall cooperate fully in the defense. ta �W CALIFORNIA 2. Minor Use Permit 2023-0002 shall comply with all applicable conditions and/or mitigation measures for the following related approval: Minor Use Permit 2022-0008 In the event of any conflict(s) between approval conditions and/or provisions of these approvals, the Design and Development Director shall adjudicate the conflict by determining the precedence. 3. Time limits for display of flags shall be concurrent with that of the permitted model home complex. 4. A building permit (BOTH2O23-0002) shall be obtained prior to construction. 5. Flags shall not be posted in a manner which obstructs the visibility of traffic or street signs or signals or emergency equipment. The City may elect to add Conditions to this application request to mitigate any problems that arise not previously addressed herein. This decision may be appealed to the Planning Commission by any party who submits the necessary paperwork and filing fee of $1,526.00 to this office within 15 days of the date of approval of this permit.
