MBA 2021-0008 Stuft Pizza (06.14.2023)June 13, 2023 John Bertram Stuft Pizza Bar and Grill 78-015 Main Street La Quinta, CA 92253 SUBJECT: MBA 2021-0008 OUTDOOR DINING PATIO IMPROVEMENTS - STUFT PIZZA 78015 MAIN ST Dear Mr. Bertram: The Design and Development Department has reviewed your request to make site improvements to an existing building site located at 78015 Main Street. The proposal includes minor modifications to the existing patio area. The plan modifications are minor and will not result in a significant change in the original project as approved by the decision-making authority. Therefore, the modification is approved as shown on the attached exhibit, subject to the following conditions of approval: The applicant agrees to defend, indemnify, and hold harmless the City of La Quinta ("City"), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Modification By Applicant. The City shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or proceeding and shall cooperate fully in the defense. 2. The applicant shall conform to all other corresponding conditions of approval for Village Use Permit 2004-020. 3. The applicant shall inform the City of La Quinta's Planning Division of any subsequent changes. Additional modifications may require subsequent review and may result in additional condition(s) of approval. 4. The applicant shall apply for and obtain all necessary building (BCOM2023-0013) and grading City of La Quinta permits as required. 5. Plans shall be prepared to the applicable code at the time of submittal for building permit. Currently the 2022 California Building Codes. On each sheet of submitted Plans, provide the preparer's name and telephone number and electronic signature and his/her stamp as prescribed by California Business and Professions Code '5536. For the allowance of the construction proposed over the north property line, a recordable encroachment agreement shall be completed for the benefit of Stuft/Building Owner (as approved by City Attorney) on the Main St Parcel (Lot E on PM 30850) prior to the issuance of Certificate of Occupancy. 7. Fire Hydrants: a. 3 -feet clearance: Fire hydrants and other Fire Protection Equipment shall be provided with a minimum 3 -feet radius clearance around the circumference of the device. (CFC 507.5.5, 509.2.1 & 912.4.2) 8. Fire Department Access: Provide a site plan for fire apparatus access roads and signage. Access roads shall be provided to within 150 feet to all portions of all buildings and shall have an unobstructed width of not less than 24 -feet exclusive of curb -side parking, bike lanes and other roadway features. The construction of the access roads shall be all weather and capable of sustaining 40,000 lbs. over two axles for areas of residential development and 60,000 lbs. over two axels for commercial developments. Ref. CFC 503.1.1 and 503.2.1 as amended by the City of La Quinta. a. Fire Lane marking: Identification and marking of fire lanes, including curb details and signage shall be in compliance with Riverside County Fire Department Standards. 9. Requests for installation of traffic calming designs/devices on fire apparatus access roads shall be submitted and approved by the Office of the Fire Marshal. Ref. CFC 503.4.1 10. Construction Permits Fire Department Review: Submittal of construction plans to the Office of the Fire Marshal for development, construction, installation and operational use permitting will be required. Final fire and life safety conditions will be addressed when the Office of the Fire Marshal reviews these plans. These conditions will be based on occupancy, use, California Building Code (CBC), California Fire Code, and related codes, which are in effect at the time of building plan submittal. 11. Fire Sprinkler System: As the proposed project does not identify any additional horizontal covered areas to be added to the building area, no modification/addition to the fire sprinkler system is expected. 12. Fire Alarm and Detection System: The cumulative occupant load of the non -separated (CBC 508) Assembly Occupancies located within the building exceeds 300. Improvements to the Building Fire Alarm System to add notification appliances to the Stuft Pizza tenant space is necessary. This also brings in the requirement to monitor the existing kitchen hood suppression system appropriately. Ref. CFC 903.4, CFC 907.2 and NFPA 72 13. The proposed trellis structure(s) are not permitted to have any added covering of any type and shall be maintained a minimum 50% open to the sky. 14. Conditions Timeframe: Conditions of approval are subject to change with adoption of new codes, ordinances, laws, or when building permits are not obtained within twelve months.
