MA 2023-0012 Chevalier Residence at 54218 Martinez (Avenida) (08.04.2023)ta �W CALIFORNIA August 4, 2023 Zayda Braun Zayda Braun Designs 42920 Caballeros Dr Indio, CA 92203 SUBJECT: MINOR ADJUSTMENT 2023-0012 54218 AVENIDA MARTINEZ Dear Ms. Braun: The Design and Development Department has reviewed your Minor Adjustment application (MA 2023-0012), pursuant to Section 9.210.040 of the City of La Quinta Zoning Code. REQUEST: Grant up to one (1) 10% adjustment to increase the maximum yard structure height from 12 feet to 13 feet and 2 inches for a new Accessory Dwelling Unit located at 54-218 Avenida Martinez, per the attached exhibits. The adjustment is being utilized to accommodate the architectural design. DECISION: Approval is granted for the requested adjustment based on the following findings and subject to the conditions of approval listed below: 1. Minor Adjustment 2023-0012 is consistent with the La Quinta General Plan, in that the proposal does not alter the approved land use for the property or affect land use on surrounding similar properties. 2. Minor Adjustment 2023-0012 is consistent with the intent of the La Quinta Zoning Code in that the requested adjustment will be conditioned to comply with all other development standards as required under said Zoning Code. 3. Processing and approval of Minor Adjustment 2023-0012 is in compliance with the California Environmental Quality Act. The adjustment requested falls under CEQA Guidelines Section 15305(a) as a "Minor Alterations to Land" - Class 5 Categorical Exemption. 4. Approval of Minor Adjustment 2023-0012 is not detrimental to the public health, safety and general welfare, nor injurious or incompatible with other properties and land use in the vicinity. The adjustment has no impact on health or safety issues and will not affect_ taQ�W OALIFORNIA physical land use characteristics in the vicinity. The adjustment will be compatible with the architectural styles of the existing single-family homes. CONDITIONS OF APPROVAL: A building permit shall be obtained prior to construction. The proposed construction shall comply with all other development standards as required under the La Quinta Zoning Code. Please be advised that the City only approves three Minor Adjustments per lot, regardless of the percentage of the development standard adjusted. This approval relates only to the one minor adjustment referenced herein and does not imply any entitlement or approval of a building permit for any structures shown on the plans on file. All other development standards of the La Quinta Zoning Code are applicable and shall be adhered to in preparing plans for building plan check. She is her mother's care giver. As she is planning for the future, as her mother heath is no improving, she has decided to build an ADU on the large property for her own future use. Her current home is 1913 s.f. on a property of 14,810 sq. ft. The existing home have white cement plaster walls, wood painted fascia boards and red toned asphalt shingle roof. The top of fascia board is approximately 8 ft above finish grade and the roof slopes approx. 2.5 per ft with a maximum height of 12. Ft. The intention of the ADU is to blend and complement the existing house. We are proposing, smooth cement plaster walls and fascias, painted white to match existing house. Shingle Roof sloped roof to match material and pitch to existing. Katrina would like a higher ceiling than her current house, therefore we are proposing bottom of fascia at 8'-2" which give us a maximum height of 1 V-4". However, Katrina will like to enjoy of the cove mountain views. Therefore the new ADU has a roof deck above her porch. The spiral stairs that will be accessing the deck are proposed to be prefab metal with a white powder coat finish. Safety rail around the roof deck is proposed to be a monolithic tempered clear glass. The railing height per code is required to be 42" above finish floor for safety. We are applying for Minor Adjustment to increase the allowable maximum height 10%, from 12 ft allowance to 13'-2". Therefore we are proposing to lower the porch height so the deck glass railing, which is the highest point of the house, do not exceed 13'-2" height from finish grade.
