Dear Mr. Laughter:
The City of La Quinta Design and Development Department has reviewed and approved
Temporary Use Permit (TUP) 2023-1000, for a seasonal sales business located at 79110
Highway 111, pursuant to Section 9.100.310 of the La Quinta Municipal Code and subject to the
information on file and the following findings and conditions of approval.
DESCRIPTION
Temporary Halloween store in the former Bed Bath and Beyond space. Spirit Halloween is a
retail store selling costumes and decorations. Space will have no permanent tenant
improvements to the space. Temporary fixtures and a temporary banner sign will be used.
Planned merchandising to begin 8-30-23 with a planned open date of 9-11-23. Planned closing
date of 11-6-23 with operating hours between 9am and 11 pm.
FINDINGS
• The proposal is consistent with the general plan and provisions of the zoning code. The
seasonal sales business is permitted in the Regional Commercial zone and in Specific
Plan 2003-066.
• The proposal would not create conditions materially detrimental to the public health,
safety and general welfare or injurious to or incompatible with other properties or land
uses in the vicinity.
CONDITIONS OF APPROVAL:
1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta
("City"), its agents, officers and employees from any claim, action or proceeding to attack,
set aside, void, or annul the approval of this Temporary Use Permit. The City shall have
sole discretion in selecting its defense counsel. The City shall promptly notify the applicant
of any claim, action or proceeding and shall cooperate fully in the defense.

2. The business is permitted to operate for up to 90 -days.
3. Permitted temporary sign material shall be limited to a minimum one -inch thick plastic
formed lettering affixed to the building fagade. All sign lettering shall promptly be removed
upon expiration of the temporary use permit and the fagade shall be restored to its prior
condition.
4. Any additional signage or banners are prohibited.
Fire Department
5. Extension cords shall be over -current protected and/or ground -fault interrupter protected.
No additional taps are to be in any device. All extension cords shall be of 12/3 gauge
wire or greater with approved connectors.
6. Extinguishers- At least one 2A10BC fire extinguisher, with a current service tag (within
one year), shall be provided within every 75 feet of travel distance. [CFC 3107.9] 3. The
means of egress pathway to additional emergency exits shall be available and
unobstructed. Exit signs shall be visible and an additional exit sign may required to lead
occupants to other exits.
7. Fire sprinkler system shall receive the annual inspection, testing and maintenance.
Maintenance report shall be provided to the Fire Inspector prior to final inspection.
8. Applicant/installer shall be responsible to contact the Fire Department to schedule
inspections. Requests for inspections are to be made at least 48 hours in advance and
may be arranged by calling (760)777-7131.
9. All questions regarding the meaning of these conditions should be referred to the Office
of the Fire Marshal staff at (760)777-7078.
The City of La Quinta reserves the right to revoke, suspend, or void this permit at any time. The
City may add further conditions to this application request to mitigate any problems that arise
not previously addressed herein. This decision may be appealed to the Planning Commission
by any party who submits the necessary paperwork to this office within 15 days of the date of
approval of this permit.
