TUP 2023-1003 Lowes Christmas Tree Lot (11.30.2023)t(4j QWk& -[ i1.1JVkh1i- November 30, 2023 Arlen Rasmussen Lowes Home Improvement LLC 78865 Highway 111 La Quinta, CA 92253 SUBJECT: TEMPORARY USE PERMIT 2023-1003 LOWES CHRISTMAS TREE LOT Dear Arlen: The Design and Development Department has reviewed and approved your request to establish a temporary Christmas tree sales lot within the Lowes parking lot. The approval of the event is granted under Section 9.100.080 of the La Quinta Municipal Code subject to the following Conditions of Approval: 1. The Christmas tree sales lot shall shall be removed and the premises cleared of all debris and restored to pre -event conditions no later than January 8, 2023. Specifically, the event may be open on the following dates: November 30, 2023 - January 8, 2024; Monday through Sunday, between the hours of 8:00 a.m. and 9:00 p.m. 2. Please see the attached letter for the Fire Marshal Conditions of Approval. 3. The location of the event is limited to the Lowes parking lot, per the attached site plan. Traffic aisles shall not be blocked. 4. Applicant shall provide final payment for all permits, including this one, prior to any set up and/or operation. 5. The facility shall not engage in the sale of any merchandise not directly associated with Christmas trees and Christmas decorations. 6. The applicant shall apply for a Building Special Inspection Permit, which can be applied for The HUB Online Portal. 7. Per information on file, a tent was not proposed or approved as part of this permit. 8. All electrical wirings must comply with the California Electrical Code as well as Building and Safety Requirements. No zip cords will be allowed. All extension cords must be t(4j QWk& �[ i1.11�511sh1i� connected to a circuit protected outlet. Use of generators shall comply with the California Fire Code and Building Code. 9. All aisles between grouping of trees must be maintained a minimum of 36 -inches in width 10. All waste, trimmings, and dried trees must be removed from the site daily or placed in an approved waste container. 11. A temporary fence surrounding the Christmas tree lot is permitted. The proposed fence shall be constructed of chain link fencing material and shall not exceed a height of six (6) feet. No other temporary structures are proposed or permitted as part of this permit. 12. Temporary lighting shall not be directed towards surrounding properties. All temporary lighting shall conform to the City's Outdoor Lighting Ordinance; Section 9.100.150 of the City's Municipal Code. 13. If portable generators are used for electricity, they shall be shielded to prevent accidental contact with guests. If extension cords are used, they shall be ground -secured to prevent tripping. Power equipment (i.e. chain saws, etc.) shall not be operated before 7:00 a.m. 14. Smoking shall not be permitted in any part of the event area. 15. Furnishings, decorations or other objects shall not be placed so as to obstruct exits, access thereto, egress therefrom or visibility thereof. Hangings and draperies shall not be placed over exit doors or otherwise be located to conceal or obstruct an exit. 16. Roadways, parking areas, and pedestrian traffic aisles outside the proposed area shall be maintained accessible at all times. 17. Signs shall be restricted to one banner sign per street frontage, each sign not exceeding thirty-two square feet. Banners may be placed on the temporary fence or adjacent within the parking area, but not on Highway 111. Other signs and advertising devices such as pennants, flags, A -frame signs, are prohibited. 18. All trees sold for commercial use to businesses, schools, churches, or health care facilities shall be flame retarded and bear a tag with the information of when it was treated and what material was used during the treatment. Provide a copy of the CA State Fire Marshal registration of you or your company being recognized as a Limited Applicator. Flocking shall be done with non-flammable materials. The flocking area shall be noted on the site plan. 19. Adequate trash receptacles shall be provided. 20. A security guard is permitted on-site if needed during the operations of the Christmas tree t(4j QWk& �[ i1.11�511sh1i� sales lot. No overnight camping, either in tents or vehicles, is permitted as part of this permit. 21. By holding this Christmas tree sale, the applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the event of any legal claim or litigation arising out of the City's approval of this project. The City of La Quinta shall have the right to select its defense counsel at its sole discretion Adherence to these conditions, as outlined, will ensure that adverse impacts to surrounding properties and businesses will be minimized. This trees will be purchased inside so the lot is more for trimming and displaying trees. We will have trained employees in the lot. Lot size 62ft x 72ft Full chain link fence panels 12x8 in size and will have post for partitions. 7 partitions will divide the tree lot into 9 sections to hold the different trees and our cutting stations. We will have 2 exit/entrances at the long end of the lot. Secured by chains. Safety lights will be placed at the cutting stations and at the end of the partitions to light the entire lot. We will have illuminated exit signs Fire extinguishers Power will be pulled directly from the light pole. The lot will be decorated with Christmas themed lights Burlap will surround fence to help protect trees.
