Good afternoon Laurie - Per your request to confirm that an affidavit notarized by an out of state notary is valid for purposes of government publication requirements pursuant to Gov. Code sections 6000 et seq., here are the results of our research: The Government Code which specifically deals with publication, including any caselaw which has interpreted such sections, are silent about the use of notaries. However, later sections in the Government Code, in a division about notaries, specifically allows for the usage of an out of state notary public. Please see the relevant provisions in Government Code section 8232.1 below: (a) A notarial act performed in another state shall be afforded the same legal effect under the law of this state as if performed by a notarial officer of this state, if the act performed in that state is performed by any of the following: (1) A notary public of that state. (2) A judge, clerk, or deputy clerk of a court of that state. (3) Any other individual authorized by the law of that state to perform the notarial act. (b)(1) The signature and title of an individual performing a notarial act in another state are prima facie evidence that the signature is genuine and that the individual holds the designated title. (2) The signature and title of a notarial officer described in paragraph (1) or (2) of subdivision (a) conclusively establish the authority of the officer to perform the notarial act. (Gov. Code § 8232.1.) Thus, if the Wisconsin notary is a valid notary of their state, their signature has the same effect as a California notary's signature. As there is no case law or code section that would indicate that section 8232.1 would not apply to the publication inquired about here, it appears valid that the Wisconsin notary can be used for publication purposes. The Project also proposes on-site and off-site drainage infrastructure, and recreational open space consisting of a 5 -mile public trail system, staging areas, gathering areas, and passive and active spaces on approximately 55.9 acres. Natural open space and uses are proposed on approximately 301.2 acres on the southern portion of the Project property for conservation and preservation purposes. General public access to the Project would be provided by a southerly extension of Jefferson Street and a westerly extension of Avenue 62. These roadways will extend into the Project site and create a spine roadway that will provide access to the neighborhood communities. An emergency vehicle access road will be provided along the unimproved portion of Madison Street. At full buildout, Project utility demand would be offset by a new electrical substation and up to five Coachella Valley Water District (CVWD) wells. During severe winter and summer storms, the existing Avenue 50 low water crossing is frequently inundated and damaged due to flows within the storm water channel. In the interest of public health and safety, and in response to community concerns regarding frequent closures of the low water crossing, the City has determined that replacement of the low water crossing with a new bridge is the best way to ensure all weather access is maintained to the community. The proposed improvements will provide Coachella Valley motorists and pedestrians a safe path of travel across the La Quinta Evacuation Channel at Avenue 50 regardless of adverse weather.
