Code Section 66499(a)(4)) THIS AMENDMENT TO LIEN CONTRACT AND DEED OF TRUST ("Lien Contract Amendment") is entered into this 27th day of March, 2024, by and between the CITY OF LA QUINTA, CALIFORNIA, a municipal corporation of the State of California ("City") and Project LQ, LLC, a California limited liability company ("Owner"). RECITALS A. Owner is the owner if fee of that certain unimproved real property located in the State of California, County of Riverside, City of La Quinta, more particularly described in the legal description attached hereto as EXHIBIT "A" and incorporated herein by this reference (the "Property"). B. Owner and City executed that certain Lien Contract and Deed of Trust recorded as Document # 2021-0201427 on March 31, 2021 (the "Lien Contract"), which, pursuant to authorization from the City, allowed for the temporary substitute security for Owner's obligations under the Final Map and SIAs, as those terms are defined in the Lien Contract. The Lien Contract, as authorized by the City to serve as temporary security, was set to expire on March 31, 2024. C. Pursuant to applicable provisions in the La Quinta Municipal Code, the City has approved another amendment to the Final Map and the Conditions of Approval therein, which authorizes the Lien Contract to remain as temporary substitute security for Owner's obligations under the Final Map and SIAs until March 23, 2029. NOW, THEREFORE, for good and valuable consideration, including the obligations herein and the trust herein created, the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree as follows: This Lien Contract and Deed of Trust shall continue to remain in full force and effect and serve as temporary substitute security, in accordance with City of La Quinta Director Hearing Resolution No. 2024-001, until such time as released and reconveyed by the City; provided, however, that in DOC #2024-0092165 Page 2 of 7 no event shall the Lien Contract and Deed of Trust remain in effect and serve as temporary substitute security after March 23, 2029. Tract Map 31732 was subsequently amended in 2016. • Amended Final Tract Map 2021-0001 (Tract Map 31732) and Amended Final Tract 2021-0002 (Tract Map 31733) were approved in 2021 to allow lien contracts to serve as substitutes for the required performance bonds for a three-year period. • The owner is requesting a five-year extension of the existing lien contracts. No changes to the actual map configurations are being proposed as part of this amendment. BACKGROUND/ANALYSIS Final Tract Map 31732, a 39.7 -acre property and Final Tract Map 31733, a 38.3 -acre property were both approved in 2004 as neighboring single-family residential projects with no internal access, located on the southeast corner of Avenue 60 and Monroe Street (Attachment 1). Tract Map 31732 and Tract Map 31733 were subsequently amended in 2006 and recorded in 2007 to combine the projects into one and to allow for internal access between both projects, consequently each Tract Map lost 2 residential lots. Tract Map 31732 was later amended in 2016 to remove the alleys and revise the existing lot lines (Attachment 2). The conditions of approval were amended in 2021 to allow for lien contracts to serve as replacement for the performance bonds required for a three year period. A five year extension is being requested by the applicant to deal with the lack of available power from Imperial Irrigation District (IID). The lien contracts currently serve as the substitute security for completion of on-site and off-site improvements required under the project's subdivision improvement agreement. Prior to the issuance of any permit for the improvements required under the subdivision improvement agreement, the owner shall procure and post for the benefit of the City the payment/performance bonds required. If the owner fails to replace the lien contract with the payment/performance bonds at the end of the five year period, the City may record the pending Final Tract Map No. 37959-R and Final Tract Map No. 37960-R, providing for reversion to acreage of project site (Attachment 3). Final Tract Map No. 37959-R and Final Tract Map No. 37960-R were conditionally approved by the City Council on November 17, 2020, for reversion to acreage purposes which reverts both Tracts into two numbered and four lettered lots and would nullify rights and obligations effected by Tract Map 31732 and Tract Map 31733. 5 AGENCY AND PUBLIC REVIEW Public Agency Review This request was sent to all applicable City departments and outside agencies, including the City's Public Works Department and City Attorney. The City Engineer and City Attorney have reviewed and approved of the proposal, subject to the Conditions of Approval. Public Notice This project was advertised in The Desert Sun newspaper on March 15, 2024, and mailed to all property owners within 500 feet of the site. To date, no comments have been received. ENVIRONMENTAL REVIEW Mitigated Negative Declarations (MND) were adopted by the City of La Quinta City Council on January 20, 2004, under Environmental Assessment 2003-492 for Tract Map 31732 and 2003-493 for Tract Map 31733. The Design and Development Department has determined that the proposed project is consistent with the adopted MN Ds, as no changes to the map itself are proposed.
