CC Resolution 1985-037^ 2 RESOLUTION NO. 85-37
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, APPROVING, WITH CONDITIONS,
SPECIFIC PLAN NO. 83-001, AMENDMENT NO. 1, FOR
CERTAIN PROPERTY IN THE CITY.
WHEREAS, the Planning Commission has recommended approval of
Specific Plan No. 83-001, Amendment No. 1, pursuant to Government Code
Section 65450 et seq. of the California Planning and Zoning Law and has
transmitted the same to the City Council in compliance with Section 65453
of said law; and,
WHEREAS, the City Council has held at least one public hearing on
Specific Plan No. 83-001, Amendment No. 1, as required by Section 65453
of the California Planning and Zoning Law; and,
WHEREAS, the Specific Plan, as amended, is consistent with the
La Quinta General Plan; and,
WHEREAS, development of the project, as amended and in accordance
with the conditions of approval, will be compatible with the surrounding
area; and,
WHEREAS, the project will be provided with adequate utilities and
public services to ensure public health and safety; and,
WHEREAS, amendment of the Specific Plan is necessary to avert
potential conflicts with the proposed realignment of Avenue 52.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of La Quinta does hereby adopt Specific Plan No. 83-001, Amendment No. 1,
as amended, a copy of which is attached hereto and incorporated herein
by this reference, for certain property in and adjacent to the City,
subject to Conditions 1-6 as listed in attached *Exhibit 41, Conditions
of Approval Specific Plan No. 83-001, Amendment No. 1", which exhibit
is incorporated herein as though set forth at length.
APPROVED and ADOPTED this 16th day of April 1985, by the
following vote:
AYES: Council Members Allen, Bohnenberger, and Mayor Cox.
NOES: None.
ABSENT: Council Member Pena.

EXHIBIT 1"
1. The Applicant shall c*ly with E*ibit A", the catibined Environmental
Impact**t Report and *ecific Plan do*ur*t, and E*ibit B", Amendment No.
1, the land use sU[**ry map for Specific Plan No.83-001, and the following
conditions, wnich conditions shall take precedence in the event of any
conflict with the provisions of the Specific Plan.
2. The Applicant shall corply with the Conditions of Approval for Specific
Plan No.83-001 as adopted by Resolution No.84-34 on May 15, 1984, unless
otherwise IrDdified by the following conditions.
3. Specific Plan No.83-001 shall be itodified to show Avenue 52 as an arterial
highway through Phase 9, in accordance with Specific Plans Nos. 85-005A and
85-005B.
4. Condition No.37, as adopted by Resolution No.84-34, is revised as follows:
The Applicant shall ccrrply with the reguir*nents of the City' 5 adopted
corr[unity infrastructure fee program in effect at the tirre of issuance
of building pei*nits."
5. Condition No.39 relating to Phantom Assessment Districts), as adopted by
Resolution No.84-34, shall be deleted.
6. If Specific Plans No.s 85-005A and 85-005B are not adopted, approval of
Specific Plan No.83-001, Amendment No.1, shall be null and void, and
development of the site shall be in accordance with the conditions and
provisions of Specific Plan No.83-001, as adopted by Resolution No.
84-34 on May 15, 1984.
