A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA,
CALIFORNIA, AMENDING RESOLUTION NO. 84-14 BY ESTABLISHING
A *AXIMUM FEE FOR MITIGATION OF LOCAL SCHOOL IMPACT ION.
WHEREAS, on March 6, 1984, the City Council of La Quinta adopted
Resolution No. 84-14, providing a fee on new residential construction
to mitigate school impact ion with the Desert Sands Unified School
District; and
WHEREAS, it is deemed necessary and desirable to amend said
Resolution No. 84-14 to establish a maximum mitigation fee in the
sum of $628.00 per residential dwelling unit.
NOW, THEREFORE, the City Council of the City of La Quinta,
California, hereby amends Section 3.B. of Resolution No. 84-14 to
read as follows:
B. No building permit shall be issued for new develop-
ment of any residential unit upon a lot or parcel of property
within this City and the District which exceeds the number of
residential units on said lot or parcel on February 19, 1985,
unless or until the applicant for such building permit in
addition to payment of any fees or charges otherwise required to
be paid to the City of La Quinta) provides evidence of payment
to the Desert Sands Unified School District the amount necessary
to mitigate school impaction caused by such development. Provided,
that the maximum fee shall not be greater than $628 per residential
dwelling unit.
