CC Resolution 1986-008^ 3< RESOLUTION NO. 86-8 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA DECLARING CERTAIN PROPERTY TO BE A PUBLIC NUISANCE AND ORDERING THE ABATEMENT THEREOF 50-840 Washington St.). WHEREAS, Chapter 11.72 of the La Quinta Municipal Code declares it a public nuisance to maintain premises in such a manner that any of certain specified conditions are found to exist thereon; and WHEREAS, said Chapter 11.72 provides for the abatement of said property nuisance and said chapter further provides a procedure for said abatement; and WHEREAS, in accordance with said abatement procedures, the Community Development Director as agent of the City Manager, has determined that a public nuisance exists on the following described premises, and has given the notice required by law, and * WHEREAS, on February 4, 1986, at a regular meeting, the City Council conducted a hearing to consider all relevant evidence, objections or protests*ts, to determine whether the premises, or any part thereof, as maintained constitutes a public nuisance. NOW, THEREFORE, the City Council of the City of La Quinta does hereby RESOLVE as follows: 1. The City Council hereby finds, determines, and declares that the following premises is being maintained in the following condition, and thereby constitutes a public nuisance. Property Description and Address: 50-840 Washington Street A.P:N. # 769-072-001 Lot 77 The existing structure is in a state of disrepair and the property owner has made only a superficial effort to comply with the City's request concerning the unsafe conditions of the structure. 2. The City Council hereby orders the abatement of the above mentioned conditions of nuisance in the following manner: All structures, including foundations therefore, shall be demolished with materials disposed of in a legal manner. All utility connections shall be disconnected and removed from the premises. The existing private sewage disposal system shall be removed and/or abandoned in a manner which complies with the Uniform Plumbing Code. BIB] 06-12-1998-U01 03:15:56PM-U01 ADMIN-U01 CCRES-U02 86-U02 08-U02 ^ 3<RESOLUTION NO. 86-8 Page 2 Said abatement shall be completed within thrity 30) days; and if not so completed within said time period, the City Manager is directed to abate and report in accordance with Section 11,72.240 of the La Quinta Municipal Code. 3. Said abatement order, as contained in Section 2 above is hereby suspended upon condition that the owner of said premise shall perform the following work activities to complete the corrections on said structure in accordance with the following schedule: a. The structure to be vacated of all occupants within 60 days as follows: All occupants to be given written notice of termination of tenancy/occupancy within 5 days and copies thereof to be delivered to the Community Development Department within 2 days thereafter. Said termination notice shall require vacancy between the minimum time periods prescribed by state law and the 60 days period herein prescribed for vacancy. b. Permits to correct the violations to be secured within 10 days following vacancy of all structures. c. Violations to be corrected within 30 days of issuance of permits. Upon completion of all activities to the reasonable satisfaction of the City within the time above specified, said abatement order and declaration of public nuisance shall be deemed expunged. In the event of noncompliance with said activity and time schedule, said abatement order shall be in full force and effect. 4. The Community Development Director is hereby directed to mail a copy of this Resolution to the owners of said property.
