CC Resolution 1989-060^ 9NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LA QUINTA HEREBY FINDS, DETERMINES, RESOLVES AND ORDERS AS FOLLOWS: Section 1. 1'Whereas, the City Council of the City of La Quinta hereinafter referred to as the City Council') has previously formed Landscape and lighting District No. 1 pursuant to the provisions of the Landscaping and Lighting Act of 1972, being Part 2 of Division 15 of the California Streets and Highways Code, commencing with Section 22500 hereinafter referred to as the Act"); and Section 2. The City Council hereby proposes formation of a City-wide Landscape and Lighting Assessment District and upon its formation, dissolve Landscape and Lighting District No. 1 pursuant to the provisions of the Act and to levy and collect assessments for the fiscal year commencing July 1, 1989 and ending June 30, 1990 to pay for the costs and expenses of the improvements described in Section 4 hereof." Section 3. The City Council hereby finds 1) that the public interest requires and 2) declares its intention to order the formation of a new City-wide Landscape and Lighting Assessment District pursuant to the provisions of the Act which assessment district shall include all of the territory located within the boundaries of all landscape and lighting districts within the City and all the territory located outside the boundaries of such districts but within the boundaries of the City and to levy and collect assessments for the fiscal year commencing July 1, 1989 and ending June 30, 1990 to pay for the costs and expenses of the improvements described in Section 6 hereof. Section 4. The City Council hereby further finds 1) that the public interest requires and 2) declares its intention to dissolve Landscaping and Lighting Assessment District No. 1. Secti*on 5. The proposed City-wide assessment district shall be designated La Quinta Landscape and Lighting Assessment District No. 89-1" hereinafter referred to as the Assessment District"). Section 6. The territory proposed to be included within the boundaries of the Assessment District shall include all of the land included within the boundaries of the City. Section 7. Reference is hereby rnade to the report of the Engineer on file with the City Clerk of the City of La Quinta for a full and fair description of the improvements, the boundaries of the proposed Assessment District and any zones therein and the proposed assessments upon assessable lots and parcels of land within the proposed Assessment District. BIB] 07-22-1998-U01 11:33:31AM-U01 ADMIN-U01 CCRES-U02 89-U02 60-U02 ^ 9 RESOLUTION NO. 89-60 A RESOLUTION OF THE CITY COUNCIL OF THE CITY DECLARING ITS INTENTION TO ORDER THE FORMATION OF A CITY-WIDE LANDSCAPE AND LIGHTING ASSESSMENT DISTRICT AND THE DISSOLUTION OF LANDSCAPE AND LIGHTING ASSESSMENT DISTRICT NO. 1 AND TO PROVIDE FOR THE LEVY AND COLLECTION OF ASSESSMENTS PURSUANT TO THE PROVISIONS OF FART 2 OF DIVISION 15 OF THE CALIFORNIA STREETS AND HIGHWAYS CODE. WHEREAS, the City Council by its Resolution No. 89-9 initiated proceedings pursuant; to the provisions of the Landscaping and Lighting Act of 1972, being Part 2 of Division 15 of the California Streets and Highways code, commencing with Section 22500 hereinafter referred to as the Act"), for the formation of a Landscape and Lighting Assessment District designated La Quinta Landscape and Lighting Assessment District No. 89-1 shall include all of the territory located within the boundaries of the City and for the dissolution of previous Landscape and Lighting District located in the City of La Quinta; and WHEREAS, pursuant to Article 2 of Chapter 2 of the Act, proceedings for the formation of a new assessment district formed pursuant to the Act and the dissolution of an existing Assessment District may be undertaken and any of the required resolutions, notices, or other instruments provided by the Act may be combined into single documents; and WHEREAS, the City Council desires to levy and collect assessments within proposed La Quinta Landscape and Lighting Assessment District No. 89-1 for the fiscal year commencing July 1, 1989 and ending June 30, 1990, to pay the costs and expenses of operating, maintaining, and servicing landscaping, lighting and appurtenant facilities located within public places in the City; and WHEREAS, the Engineer selected by the City Council has prepared and filed with the city Clerk of the City of La Quinta and the City Clerk has presented to the City Council a report in connection with the proposed La Quinta Landscape and Lighting Assessment District No. 89-1 and the City Council did by previous Resolution approve such report; BIB] 07-22-1998-U01 11:33:31AM-U01 ADMIN-U01 CCRES-U02 89-U02 60-U02 ^ 9 Section 8. Notice is hereby given that on the 13th day of June, 1989 at 7:30 p.m. at the La Quinta Community Center, 77-865 Avenida Montezuma, La Quinta, California 92253, is the time and place fixed for a public hearing by the city Council on the question of the consolidation of the above-described landscape and lighting distri*t and formation of proposed Landscape and Lighting Assessment District No. 89-1 and the levy of the proposed assessment. Any interested person may file a written protest with the City Clerk prior to the conclusion of the hearing, or, having previously filed a protest may file a written withdrawal of that protest. A written protest shall state all grounds of objection and a protest by a property owner shall contain a description sufficient to identify the property owner by such property owner. At the hearing, all interested persons shall be afforded the opportunity to hear and be heard. Section 9. The City Clerk is hereby authorized and directed to give notice of such hearing as provided in the Act. Section 10. The City Council hereby designates the Desert Sun as the newspaper in which notice of the public hearing shall be published.
