RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA DESIGNATING THE
SUPERINTENDENT OF STREETS TO COLLECT
AND RECEIVE ASSESSMENTS AND DIRECTING
THE CITY TREASURER TO ESTA*LISH A
SPECIAL FUND FOR
Assessment District No. 89-2
WHEREAS, by Resolution No. 89-82, this City COuncil
confirmed an assessment on lands lying within Assessment
District No. 89-2 and ordered the assessment and diagram to be
filed in the office of the City Engineer, acting as the
Superintendent of Streets, and to be recorded in the Office of
the County Recorder; and
WHEREAS, it appears that the Superintendent of Streets and
the City Treasurer are covered by a blanket fidelity bond
covering the faithful performance of the duties impose by law
in an amount deemed by this City Council to be adequate; and
WHEREAS, under the provisions of Section 10424 of the
California Streets and Highways Code, funds collected by the
Superintendent of Streets pursuant to an assessment under the
Municipal Improvement Act of 1913 are required to be paid to
the City Treasurer and placed in a special fund designated by
the name of the improvement proceeding;
NOW, THEREFORE, the City Council of the City of La Quinta
DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows:
SECTION 1. There is hereby created a special fund to be
held by the City Treasurer known as the Assessment District
No. 89-2 Improvement Fund".
SECTION 2. The Superintendent of Streets is hereby
designated to collect and receive all funds paid on account of
the assessment levied upon lands in Assessment District
No. 89-2 and to turn over said funds to the City Treasurer and
the City Treasurer is directed to place all funds so received
in the aforesaid Assessment District No. 89*2 Improvement
Fund. In order to keep the investment earnings on the cash
proceeds separate from the investment earnings on the bond
proceeds, the Treasurer is authorized to establish within the
Improvement Fund a Cash Proceeds Account and a Bond Proceeds
Account.
