RESOLUTION NO. 91- 106
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA
QUINTA, CALIFORNIA, ANNOUNCING FINDINGS, ADOPTING A
NEGATIVE DECLARATION, AND ADOPTING AMENDMENTS TO
THE GENERAL PLAN OF LA QUINTA
WHEREAS, the Planning Commission has conducted a
duly-noticed public Hearing and has recommended approval of
each of the herein described requested Amendments; and,
WHEREAS, the City Council has conducted a
duly-noticed public Hearing on each of the herein described
Amendments and considered the recommendation of the Planning
commission; and,
WHEREAS, each General Plan Amendment request has
complied with the requirements of the California Environmental
Quality Act of 1970 as amended), and adopted by City Council
Resolution 83-68, in that the Planning and Development
Department has completed a Draft and Final EIR for each
Amendment and associated development applications, which have
been reviewed and certified by the City Council of the City of
La Quinta.
WHEREAS, at said public meeting, upon hearing and
considering all testimony and arguments, if any, of all
interested persons desiring to be heard regarding the
Amendments, and City Council did find the following facts to
justify the adoption of the proposed Amendments.
GENERAL PLAN AMENDMENT 90-029 LANDMARK LAND COMPANY
1. The proposed General Plan Amendment, as requested, is
consistent with the goals and policies of the La Quinta
General Plan.
2. The proposed General Plan Amendment is consistent with
the La Quinta General Plan and the Land Use Plan in that
the proposed Low Density Residential designation will
replace the inconsistent Riverside County Land Use
designation on the site.
3. The proposed land use designations are consistent and
compatible with surrounding land use and zoning
designations along with Change of Zone 90-054 as approved
by the City Council.
4. Approval of this proposal will not result in a
significant adverse impact on the environment, due to
mitigation measures contained in the EIR which will be
incorporated into the approval conditions for Specific
Plan 90-015, except where overriding considerations are
recognized in conjunction with the Final EIR prepared as
part of this proposal and certified by the City Council.

GENERAL PLAN AMENDMENT 90-030 LANDMARK LAND PGA 5TH COURSE)
1. The proposed General Plan Amendment, as requested, is
consistent with the goals and policies of the La Quinta
General Plan.
2. The proposed General Plan Amendment is consistent with
the La Quinta General Plan and the Land Use Plan in that
the proposed Low Density Residential designation will
replace the inconsistent Riverside County Land Use
designation on the site.
3. The proposed land use designations are consistent and
compatible with surrounding land use and zoning
designations along with Change of Zone 90-055 as approved
by the City Council.
4. Approval of this proposal will not result in a
significant adverse impact on the environment, due to
mitigation measures contained in the EIR which will be
incorporated into the approval conditions for Specific
Plan 90-017, except where overriding considerations are
recognized in conjunction with the Final EIR prepared as
part of this proposal and certified by the City Council.
GENERAL PLAN AMENDMENT 90 031 LANDMARK LAND CO. THE GROVE)
1. The proposed General Plan Amendment, as requested by the
Applicant, is inconsistent with the goals and policies of
the La Quinta General Plan in that a designation of
General Commercial does not effect the intent for
Commercial Land Uses in the La Quinta General Plan.
2. The recommended General Plan Amendment is consistent with
the La Quinta General Plan and the Land Use Plan.
3. The recommended land use designations of Low Density
Residential and Mixed Commercial and text amendments are
consistent and compatible with surrounding land use and
zoning designations along with Change of Zone 90-056 as
approved by the City Council.
4. Approval of this proposal will not result in a
significant adverse impact on the environment, due to
mitigation measures contained in the EIR which will be
incorporated into the approval conditions for Specific
Plan 90-016, except where overriding considerations are
recognized in conjunction with the Final EIR prepared as
part of this proposal and certified by the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of La Quinta, California, as follows:

"@ 1. That the above recitations are true and correct and
constitute the findings of the Council in this case;
2. That it does hereby confirm certification of the
Final EIR's for these General Plan Amendments by
the La Quinta City Council.
3. That it does hereby grant final approval of General
Plan Amendments 90-029, 90-030 and 90-031 for the
reasons set forth in this Resolution and as
illustrated in the maps attached as Exhibits A",
B", C11 & D", attached hereto.
PASSED, APPROVED and ADOPTED at a regular meeting
of the La Quinta City Council, held on this 3rd day of
December, 1991, by the following vote, to wit:

& Mayor Pena
