CC Resolution 1992-014^!AP E RESOLUTION 92-* A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, RECOMMENDING CONCURRENCE WITH ENVIRONMENTAL ASSESSMENT 91 216 AND APPROVING GENERAL PLAN AMENDMENT 91- 038, A REQUEST TO AMEND THE LA QUINTA GENERAL PLAN LAND USE MAP FROM VERY LOW DENSITY RESIDENTIAL TO LOW DENSITY RESIDENTIAL. CASE NO. GPA 91-038 MADISON ESTATES/SEASTAR WHEREAS, the Planning Commission of the City of La Quinta, California did on the 22nd day of October, 1991, hold a duly noticed Public Hearing to consider the request of Madison Estates/Seastar to amend the City's General Plan Land Use Map from Very Low Density Residential to Low Density Residential for a +39 acre site, east side of Madison Street and 1/4 miles south of 54th Avenue, more particularly described as: APN 767-320-002 WHEREAS, the Planning Commission of the City of La Quinta, California did examine the testimony of the Applicant's and after lengthy consideration recommended denial of the General Plan Amendment 91-038 because the redesignation of the property was not consistent with long range population goals and needs of this area nor the community; and, WHEREAS, the City Council of the City of La Quinta, California did on the 19th day of November, 1991, the 3rd day of December, 1991, the 7th day of January, 1992, and the 21st day of January, 1992, hold duly noticed Public Hearings to consider the Planning Commission denial of General Plan Amendment 91-038, a request to amend the City's General Plan Land Use Map from Very Low Density Residential to Low Density Residential, and the Applicant's appeal of the Planning Commission action. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find the following facts and reasons to justify approving of said General Plan Amendment: 1. Traffic impacts caused by the implementation of General Plan Amendment 91- 038 could be mitigated to a large degree. 2. The request for a Low Density use is consistent with the intent of the La Quinta General Plan to allow land use policy changes if it can be found that the change is not detrimental to the City and further, that the change is consistent with the future growth projections for this area. 3. This General Plan Amendment application complies with the requirements of The Rules to Implement the California Environmental Quality Act of 1970" as amended) and adopted by City Council Resolution 83-68. That the above recitations are true and correct and constitute the findings of the Council in this case; 2. That the City Council does hereby overrides the Planning Commission denial of General Plan Amendment 91-038. WHEREAS, at said Public Hearing upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said City Council did find facts and reasons to override the Planning Commission? S recommendation to deny the General Plan Amendment.
