CC Resolution 1992-026^#A RESOLUTION 92-26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA, ANNOUNCING FINDINGS AND CONFIRMING THE ENVIRONMENTAL ANALYSIS FOR THE SOURCE REDUCTION AND RECYCLING ELEMENT EA 92-225), AND THE HOUSEHOLD HAZARDOUS WASTE ELEMENT EA 92-226). CASE NO. EA 92-225 & EA 92-226 WHEREAS, pursuant to the September, 1989 California Integrated Waste Management Act AB 939) and its companion bill, AB 2707, each California county and incorporated City must prepare a Source Reduction and Recycling Element SRRE) that demonstrates how they will meet the State's solid waste diversion goals of 25 percent by the year 1995 and 50 percent by the year 2000, and a Household Hazardous Waste Element HWWE) that identifies a program for the safe collection, recycling, treatment, and disposal of household hazardous wastes; and WHEREAS, in adopting a unified and coordinated approach to address Coachella valley's solid and household hazardous waste management needs and the requirements of AB 939 and AB 2707, CVAG has prepared one regional SRRE and one regional HHWE. The SRRE and HHWE includes City specific objectives and funding plans tailored to the existing conditions and needs of each of the nine CVAG incorporated Cities including the City of La Quinta; and WHEREAS, in order to streamline the environmental review process and prevent preparation of nine separate Negative Declarations for both the SRRE and HHWE, and pursuant to Section 15051 of the California Environmental Quality Act Guidelines, CVAG was designated as Lead Agency on behalf of the nine CVAG Cities at the June 3, 1991 Executive Committee public meeting for the purposes of preparing and approving one Negative Declaration for the SRRE and one Negative Declaration for the HHWE; and WHEREAS, on January 27, 1992, the CVAG Executive Committee, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, did adopt one Negative Declaration for the SRRE and one Negative Declaration for the HHWE; and WHEREAS, based upon the initial study conducted, there is no identified potential for this project to substantially reduce the habitat of a fish or wildlife species, cause a fish or wildlife population to drop below self sustaining levels, threaten to eliminate a plant or animal comunity or reduce the number or restrict the range of a rare or endangered plant or animal. That the above recitations are true and correct and constitute the findings of the City Council in this case; 2. That it does hereby confirm the conclusions of Environmental Assessment 92-225 and 92-226 in that the SRRE and HHWE will not result in a significant adverse impact on the environment and that a Negative Declaration is appropriate for filing.
