CC Resolution 1992-039^#A RESOLUTION 92-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA QUINTA, CALIFORNIA DECLARING ITS INTENTION TO SEEK A SPHERE OF INFLUENCE AMENDMENT, ANNEXATION TO THE CITY'S LIGHTING AND MAINTENANCE DISTRICT, DETACHMENT FROM THE CITY OF INDIO, AND CONCURRENT ANNEXATION TO THE CITY OF LA QUINTA OF 1.6 ACRES FOR PROPERTY EAST OF THE CURRENT CORPORATE LIMITS, CONFIRMING THE ENVIRONMENTAL DETERMINATION WITH THE ADOPTION OF A NEGATIVE DECLARATION, AND DIRECTING THAT APPLICATIONS FOR THESE PURPOSES BE EXECUTED AND FILED WITH THE RIVERSIDE COUNTY LOCAL AGENCY FORMATION COMMISSION CASE NO.: SPHERE OF INFLUENCE AMENDMENT #8 AND ANNEXATION #7 WHEREAS, the City Council of the City of La Quinta, California seeks to amend the current Sphere of Influence boundaries with the City of Indio, annex the property to the City's Lighting and Maintenance District, detach the property from Indio and concurrently annex an area of real property located within the City of Indio, State of Cailfornia, and which is described on Exhibit 1A'1, attached hereto and by this reference incorporation herein; and, WHEREAS, the City of Indio, on February 7, 1990 approved the request of Cherokee Homes to de-annex 1.6 acres with the condition that the Applicant pay all processing fees; and, WHEREAS, the La Quinta City Council has determined that the Sphere of Influence Amendment, annexation to the Lighting and Maintenance District, detachment from the City of Indio, and concurrent annexation is a logical and contiguous expansion of the orderly growth of the City of La Quinta; and, WHEREAS, an Environmental Assessment has been completed regarding the requests and it has been found that these will not have a significant adverse effect on the environment, and therefore, a Negative Declaration shall be adopted; and, WHEREAS, for the above stated reasons and subject to approval of the Riverside County Local Agency Formation Commission, the City of La Quinta proposes a Sphere of Influence Amendment annexation to the Lighting and Maintenance District, detachment from the City of Indio, and concurrent annexation to include all the territory depicted on attached Exhibit 1'A" defined as uninhabited territory, pursuant to the provisions of Government Code. That the La Quinta City Council has determined that this action will not have a significant adverse impact on the environment and adopts a Negative Declaration for the project proposal and hereby authorizes the City Manager of the City of La Quinta to process a Notice of Environmental Determination regarding this decision. SECTION 2. That the La Quinta City Council hereby authorizes the City Manager of the City of La Quinta to commence proceedings with the Riverside County Local Agency Formation Commission for the property as herein described and as depicted in Exhibit *A". WHEREAS, the City of La Quinta, California, was incorporated an May 1, i982; and WHEREAS, areas within the City of La Quinta have postal delivery addresses with designations of communities outside of the City of La Quinta, specifically Palm Desert and India; and WHEREAS, mailing addresses and city designations which differ from each other cause significant confusion among citizens and visitors in a community; and WHEREAS, the City of La Quinta risks the lass of significant sales tax and other tax revenue through misallocation of business registrations because of differences in mailing addresses; and WHEREAS, several business persons who would be adversely affected by such confusion have requested a change in their mailing addresses to the City of La Quinta. NOW, THEREFORE, the City Council of the City of La Quinta does resolve as follows. SECTION i. The United States Postal Service is requested to change the mailing address designation for all property within the City of La Quinta to carry the name of the City of La Quinta. SECTION 2. The City Clerk is directed to transmit copies of this resolution to the U.S. Senators representing California, the members of Congress representing La Quinta, the Postmaster General, the Management Sectional Center/Postmaster, the Postmaster of the La Quinta Past Office, the Postmaster of the Palm Desert Post Office and the Postmaster of the India Past Office.
